This permit, issued on February 8, 2016 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Docking Facility
1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this expanded docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the docking facility shall be considered a
violation of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 4 formalized boat slips
6) The expanded dock and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor.
7) The authorized structures and associated activity shall not exceed the established Wrightsville Beach pier
head line.
8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
10) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2015-02650), which was issued on 12/30/15.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

Recommendations for State Permit — Ray Sito 12/21 /2015
The total area of floating docks and platforms was calculated as follows.
Shoreline length = 50 x 8 sq. ft. = 400 sq. ft. allowable
Existing Fixed Platforms = 18' x 22' = 396 sq. ft.
(credit applied for access (18'X6') remaining 18'x16'= 288 sq. ft.
Proposed Floating Docks = two (2) 6' x 20' = 240 sq. ft. (credit applied for access)
Total = 288 sq. ft.
Based on the riparian survey, square footage for the existing docking facility is currently approximately 580 sq. ft.
Total square footage of the proposed docking facility and remaining platform decking is approximately 636 sq. ft.
Credit for access is not calculated in total square footage.
The proposed facility would continue to provide docking space for the total up to four (4) vessels at this location. It
appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the %
width rule, the pier width rule. The proposed structures would be located entirely over open water. If the project is
determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should
include standard docking facility conditions:
This permit authorizes a maximum of four (4) boat slips. At no time shall more than four (4) vessels be
moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel
types, including but not limited to motorboats, sailing vessels and personal watercraft.

This project is consistent with the 2005 Wrightsville Beach Land Use Plan Update.
The applicant proposes to reconfigure an existing docking facility within Motts Channel.
The property is located at 462 Causeway Drive in Wrightsville Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are PTA and EW.
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Wrightsville Beach Land Use
Plan Update and offer the following comments.
The general area of the project is classified as Developed and Conservation.
In general, the Wrightsville Beach Land Use Plan contains policies, which allows
development in Developed and Conservation classified AECs, which is consistent with
the State's minimum use standards. The Wrightsville Beach Land Use Plan contains
some policies, which exceed the State's minimum use standards. However none of these
policies appear to be applicable to this project.
This project is consistent with the 2005 Wrightsville Beach Land Use Plan Update.

If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work

9. PROJECT DESCRIPTION:
The project site is located at 462 Causeway Drive, adjacent to Motts Channel, between the Atlantic Ocean
and Greenville Sound. The site is located within the Town of Wrightsville Beach, in New Hanover County.
To locate the property from the Wilmington Regional Office, travel east from Military Cut -Off Road (N.C.
Highway 76) approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east
on Causeway Drive (N.C. Highway 76) approximately 0.75 miles and the property of interest will be located
on the right hand side.
The applicant currently maintains a two-story single family residence on the project site. The property is
adjacent to residential properties with existing single family structures and private docking facilities.
Highground vegetation consists of maintained lawn grasses and ornamental landscaping. The lot is
approximately 0.12 acres in size and has an average elevation of approximately 7' above normal high water
(NHW). The project site has approximately 50 linear feet of shoreline frontage stabilized by a wooden
bulkhead and rip -rap extending approximately 18' in width into Motts Channel.
The applicant currently maintains a private docking facility within Motts Channel. An existing platform
extends from the bulkhead, measuring approximately 18' in length by 22' in width of which 13'x22' is located
waterward of NHW. The existing platform encroaches into the adjacent 15' Riparian Corridor Setback Area
requirement approximately 1' to the east and 2' to the west. There is an access ramp which leads down to a
floating dock measuring approximately 23' in length by 8' in width, which runs perpendicular to the shoreline.
The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of project
site as Conservation. There are no known archaeological sites located in the project vicinity. The waters of
Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest
of shellfish.
PROPOSED PROJECT:
The applicant proposes to reconfigure an existing private docking facility within Motts Channel. The
application states that the existing 23' in length by 8' in width floating dock would be removed and replaced
by two (2) 20' in length by 6' wide floating docks attached end to end. The proposed docking facility would
extend perpendicular to the shoreline and 17' further into the waterbody than the existing docking facility.
The application states that the new configuration would accommodate up to four (4) slips within existing
water depths of -5' to -6.5' at NLW (See Sheets 1 and 2 of 2 and Project Narrative).
10. ANTICIPATED IMPACTS:
The floating dock addition would incorporate approximately 240 sq. ft. of Estuarine Waters and Public Trust
Area, which is an increase of 56 sq. ft. impacts from the existing floating dock. The proposed floating dock
would not encroach into the adjacent 15' Riparian Corridor Setback Area. The docking facility would extend
approximately 63' into a waterbody, which measures 960' across. This distance conforms to the 1 /4 width
rule and the locally established pier head line. Minor increases in turbidity should be expected during
construction.

We wish to add a second floating dock so that we can have four slips. With the boat lifts
in place we will not have anywhere to load and unload our company safely. We also will
have small ones that would like to swim and we feel that it will be safer for them to stay
away from the boat lifts when entering and exiting the water. Thank you for your

Wilmington, in New Hanover County. It was received as complete on Decem , d appears to be adequate
for processing at this time. The projected deadline for making a decision is ebrua 016. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have not been notified of
a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided
on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 9, 2015, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review, the agencies may contact you
directly.

The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for a development permits in
Areas of Environmental Concern as designated under the CAMA in New Hanover County: On
November 24, 2015, Larry Warshaw proposed to replace an existing docking facility at 914
Santa Maria Ave., adjacent to Pages Creek, in Wilmington; on December 1, 2015, Ray Sito

construct a new docking facility at 712 Waynick Blvd, adjacent to Banks Channel, in
