Upland Development 1) This permit authorizes only the land disturbing activities associated with reconfiguration of the road and emergency turnarounds within Cedar Point Subdivision, including roadways and associated utilities that are expressly and specifically set forth in the permit application and depicted on the attached work -plat drawings. Any additional land disturbing activities and/or construction shall be evaluated on a case -by - case basis by a representative of the Division of Coastal Management (DCM) to determine additional permit requirements. Any violation of the permit approved by the DEMLR will be considered a violation of this CAMA permit. Sedimentation and Erosion Control 4) All disturbed areas shall be properly graded and provide a ground cover sufficient to retain erosion shall be established within thirty days of project completion. 5) Appropriate sedimentation and erosion control devices, measures or structures (e.g. silt fence, diversion swales or berms, etc.) shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and/or properties. General 6) This permit does not authorize the excavation or filling of any wetlands or open water areas, even temporarily. 7) The permittee and/or his contractor shall meet on site with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern (AECs). Bull dozer or Motor grader will scrap the top 3 - 4" of topsoil and grass off the proposed private drive and northern turnaround and place on the future house pads of Lots 18 - 20 as shown on the plan. A backhoe will remove soil and asphalt from Lot 17 and place within the spoil site on Lot 18. Dump trucks will deliver gravel and it will be installed with a motor grader or bull dozer and compacted on the private drive and northern turnaround. Upon completion of gravel installation, asphalt will be laid. After this construction the GrassPave2 System will be installed on Lot 17 to serve as the southern emergency turnaround. d. PROJECT SUMMARY: The applicants propose to reconfigure the previously permitted access road and emergency turnarounds for Lots 17-20 within the Cedar Point Subdivision. Zachary and Susan Salmon Page 2 9. PROJECT DESCRIPTION: The applicant has requested that the subject CAMA Major Permit application be processed under the Express Review Permitting Program. The Cedar Point Subdivision is located off NC Hwy 50 (South Shore Drive) in the town of Surf City in Pender County. The project is located adjacent to Topsail Sound and Banks Channel. To get to the project site from Wilmington, head north on US Hwy 17. At the intersection of US Hwy 17 and NC Hwy 210, turn right onto NC Hwy 210 towards Surf City. Cross the AIWW in Surf City and turn right at the stoplight onto NC Hwy 50. Travel approximately 2.9 miles south to Katelyn Drive (Cedar Point Subdivision). Turn right onto Katelyn Drive and travel approximately 0.08 miles and veer to the left and the road becomes Abigail Court. Continue on Abigail Court approximately 0.09 miles to the end of the pavement which will be adjacent to the last dwelling which is 108 Abigail Court (Lot 17). The project site extends from Lot 17 northward through Lots 18, 19 and 20. Existing development on Lot 17 (108 Abigail Ct.) includes a single family residence, docking facility, bulkhead, road and driveway. Existing structures on Lots 18, 19 and 20 include a bulkhead around the entire peninsula and docking facilities. Water and sewer lines have been installed on all the lots. The tract has an approximate elevation of 4.5 feet above normal high water (NHW). The four lots have a combined size of approximately 1.38 acres with a total shoreline length of approximately1,027 lineal feet. High ground vegetation consists of various wild grasses, Four-leaf Clover (Trifolium Mpens) and Pampas Grass (Cortaderia selloana). Vegetation water ward of the existing bulkhead consists of §404 type wetland areas which include Southern Wax Myrtles (Wica cerifera), Yaupon (Ilex vomitoria), Marsh elder (Iva frutescens) and Sea Ox-eye (Borrichia frutescens). The vegetation then transitions to Coastal Wetland species which consists primarily of Smooth Cordgrass Marsh (Spartina alternj7ora) as well as Salt Grass (Distichlis spicata), interspersed with Sea Lavender (Limoium carolinanum) and Salt Meadow Hay (Spartina patens). CAMA Major Permit No. 68-04 was issued to S & W Investments c/o Mr. Lawrence Ward on 5/17/04 for development of Cedar Point Subdivision. The permit authorized development of a subdivision including: lot grading/preparation, street access and utilities installation, maintenance dredging within the existing canal and access channel, construction of 2,000 linear feet of bulkhead along the canal's southern shoreline, construction of a 40' X 12' boat ramp with a 34' X 4' handling pier, five (5) piers (20' x 4') within the canal, and a 6' x 100' pier extending into Banks Channel with a 6' x 20' t-head platform, a 20' x 20' gazebo and two (2) 4' x 15' floating docks (one located on each side of the platform). A Major Modification to CAMA Major Permit No. 68-04 was issued on 11/12/04 for the construction of a community boardwalk/access pier and elevated docking system, however, these structures were never constructed. Permit No. 68-04 expired on 12/31/07. The Developer (S & W Investments) never completed the installation of the road through Lots 18-20 and these lots eventually went into foreclosure. The applicants bought Lot 17 in October 2011 and is currently under contract to purchase Lots 18, 19 and 20 from the bank. On March 28, 2016, Cedar Point Subdivision received an Approved Plan Revision to State Stormwater Permit No. SW8 030526 for the reallocation of built upon area for Lots 18, 19 and 20 and the access road in order to accommodate the emergency vehicle turnarounds which is being requested in this proposal. The waters of the Topsail Sound and Banks Channel, adjacent to the proposed project area, are classified "SA" by the Division of Water Quality. This section of Topsail Sound is NOT designated as a Primary Nursery Area by the Division of Marine Fisheries. According to maps provided by Shellfish Sanitation, the area is O//P++ D harvesting of shellfish. "W60 MAY 2 6 2.016 Zachary and Susan Salmon Page 3 PROPOSED PROJECT: The applicants propose to reconfigure the previously permitted access road and emergency turnarounds for Lots 17-20 within the Cedar Point Subdivision. According to the consultant (Charles Riggs), the originally permitted road and turnaround which were never constructed thru Lots 18, 19 and 20 must be completed prior to the issuance of any building permits. Therefore, the applicants have redesigned the previously authorized road and turnaround. As proposed, the existing asphalt turnaround located on Lots 17 and 18 would be removed with the exception of a 20' wide section thru the middle of this area for the existing road which is to remain. The areas, which were previously asphalt, would be converted to a GrassPave 2 System (see Sheet 2 of 2) within the same footprint. A new asphalt road approximately 14' wide by 300' in length would extend from the existing asphalt and run thru Lots 18, 19 and 20. At the terminus of the road would be a "hammerhead" turnaround which would extend approximately 30' in length by 20' in width towards the west. As proposed, approximately 3" - 4" of topsoil and grass would be removed for the proposed roadbed area and replaced with gravel and asphalt. The application states that all earthen material which is to be removed will be contained on the high ground area of Lots 18, 19 and 20 (see Sheet 1 of 2). According to the submitted site plan, all areas of disturbance would be located landward of the 30' Coastal Shoreline buffer. 10. ANTICIPATED IMPACTS: As proposed, the reconfiguration of the existing road and installation of the road extension and emergency turnarounds would disturb approximately 14,912 sq. ft. of high ground area. The entire project area is located within the 75' Coastal Shoreline AEC and landward of the 30' Coastal Shoreline buffer. Submitted by: Debra Wilson Date: 5/20/16 Office: Wilmington RECEIVED MAY 2 6 2016 DCM- MHD CITY Narrative for Salmon/Cedar Point Applicant, Zachary and Susan Salmon, is requesting a Major CAMA Permit for Lots 17 thru 20 of Cedar Point (CP) subdivision, located in Surf City (SC), Pander County, North Carolina, to complete the development and install a fire emergency turnaround as required by SC's ordinances and its fire department. Applicant is the owner of a single family house on Lot 17 and the contract purchaser of Lotsl8-20.SC requires a fire emergency turnaround to be within 150 feet of all houses in order for its fire department to effectively suppress house fires. The original CP subdivision, approved by SC in 2005, provided for a fire emergency turnaround at the end of Abigail Drive, principally on lot 18 and partially on lot 17; however, due to a surveying error the area for such a turnaround does not exist on Lot18. The developer of CP, Stephenson & Ward Realty and Development, Inc. (Developer) failed to install the same resulting in lots 14 thru 17 being out of compliance and unsafe for suppression fire suppression purposes (Please see Rademacher and Fire Department letter of February 11, 2015, attached as CPointSCApprovalEmerg). Neither Applicant nor other owners of Lots 14-17 of CP can sell or mortgage their lots as a result of this defect and they are exposed to an increase risk of harm. Applicant is seeking, among other things, to cure the problem and eliminate the risk. As your records reflect, the Developer failed to complete its storm water plan, SW8 030526, and was notified by your department in 2011 of its failure. The Developer was determined to be insolvent and / or dissolved causing the stormwater permit to be assigned to Cedar Point Home Owners Association (CPHOA) who corrected the failure. The Developer, also, defaulted on its loan with Four Oaks Bank and Trust (Four Oaks) and Four Oaks acquired by foreclosure Lots 18-20. Four Oaks is unable to install the turn around on Lot 18 because it has neither access nor land where the turnaround was designed to be installed due to a surveying error. The Applicant has sufficient area for the turn around on Lot 17, if combined with the eastern portion of Lot18, and has agreed to purchase Lots 18-20 to correct the problem. Applicant proposes to relocate the turnaround approximately 30 feet east of the its original designed location; however, to do so requires a revision to the storm water plan for Lot 17 thru 20. The Applicant prepared a revision, which corrected the problems and did not increase the BUA of Lots 17-20. On December 10, 2014, the surveyor of the Applicant delivered the revised plan to the president of CPHOA for his approval and signature. Some confusion evolved and Applicant sent an email fully explaining the need for the revision on December 11, 2014, attached as CPHOALtrZCS20141211. CPHOA, also, requested a plan of development sealed and signed by surveyor, which Applicant provided on Decemberl2, 2014. CPHOA responded on December 18, 2014 advising it would not sign the revised plan, please see attached letter, labelled CPHOARejection20141218. Applicant responded on December 23, 2014 with a letter providing additional information and requesting execution, labelled, CPHOALtrZCS20141223 . CPHOA again refused and sent a second refusal letter labelled CPHOARejection20141230. Later on January 9, 2015, CPHOA sent an email advising it would recommend approval to its Architectural Review Committee if Applicant would replace some of the asphalt in the emergency turnaround with a GrassPav2 system, please see CPHOARejectionAlt201519. Although the original plan of development provided for an asphalt turnaround, Applicant, to avoid conflict and delay, agreed to use the GrassPav2 system as demanded by CPHOA even though such system is more expensive to install and maintain than asphalt. Applicant revised their plan to incorporate the GrassPav system in the turnaround and submitted the plan to SC, who approved the same. On May 8, 2015, the amended stormwater plan, incorporating the approved GrassPav2 system, was submitted to CPHOA for its signature but CPHOA continues to refuse to sign. The Cedar Point Homeowners have signed the required paperwork and the State has revised the Stormwater Permit, SW8 030526 to accommodate the construction of the private drive and the emergency turnarounds. If the permittee sets up an Architectural Review Committee (ARC) to review plans for compliance with the restrictions, the plans reviewed must include all proposed built -upon area (BUA). The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specked in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 13. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the apprcREC E IV E D plans, including, but not limited to, those listed below: a. Any revision to any of the items shown on the approved plans, including the MAY 26 2016 stormwater management system, design concept, built -upon area, details, etc. b. Project name change. DCM- MHD CITY C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, or selling of the project area. f. Filling in, altering or piping any vegetative conveyance shown on the approved plan. 14. The Director may determine that other revisions to the project should require a modification to the permit. 15. Stormwater conveyances will be located in either dedicated right-of-way (public or private), recorded common areas or recorded drainage easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. III. GENERAL CONDITIONS Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with I1IVED Carolina General Statutes 143-215.6A to 143-215.6C. The sale or conveyance of the common areas to the HOA or POA where the requirements of Session Law 2011-256 have been met; c. The dissolution of the corporate entity, LLC, or General Partnership; d. Bankruptcy and/or foreclosure proceedings; e. A name change of the permittee; f. A name change of the project; g. A mailing address change of the permittee. 6. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the permit transfer request. More than $ 200,000 has been spent improving the property, over $ 150,000.00 has been paid in real estate taxes and HOA dues since 2004, over $ 1,000,000.00 has been paid for the purchase of the three lots all in reliance upon the approval of these three lots by the USACE for use for home construction. The original application to CAMA and other governmental entities, including the USACE, included maps dated January 29, 2004 and March 2, 2004, prepared by Hanover Design Services showing the Lots with initially condominiums and later duplexes. In fact, page 78 of the CAMA Permit 68-04, in the first Note states "As such, only single duplex units are allowed on Lots 19 and 20.
