This permit, issued on October 17, 2016 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
Dockina Facility
1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this expanded docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the expanded docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third parry.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 3 formalized boat slips, and a jet dock platform for 2 vessels.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owners' riparian access corridors.
7) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
8) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
9) The authorized covered platform shall be single story, and shall not be designed to allow.for second story
use.
10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
11) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.

12) The permittee and/or his or her contractor shall meet with a representative of the Division prio
project initiation. LV
13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party Woul-the
written approval of the Division of Coastal Management.
14) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.

ADDITIONAL CONDITIONS
15) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2016-01738), which was issued on 9/6/16.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
16-0823.
NOTE: An application processing fee of $250 was received by DCM for this project.

package to be complete. Items (a) — (f) are always applicable to any major development applicaton. Please consult the application
instruction booklet on how to properly prepare the required items below.

b. An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale. Please give the present status of the
proposed project. Is any portion already complete? If previously authorized work, clearly indicate on maps, plats, drawings to distinguish
between work completed and proposed.
c. A site or location map that is sufficiently detailed to guide agency personnel unfamiliar with the area to the site.
d. A copy of the deed (with state application only) or other Instrument under which the applicant claims title to the affected properties.

f. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners and signed return receipts as proof that such

Recommendations for State Permit — Anthony Roberts 8118/2016
The total area of platforms was calculated as follows:
Shoreline length = 365'x 8' = 2,920 sq. ft. allowable (2,000 sq. ft. cap)
Proposed fixed platform = 20' x 30'. = 600 sq. ft.
Authorized floating dock = 30' x 6' =180 sq. ft.
Authorized floating platforms =12' x 10' =120 sq. ft.
Total = 900 sq. ft.
The reconfiguration would continue to provide docking space forthe total up to three (3) vessels at this location. It appears that the
project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the %width rule, the eight square foot
rule and the pier width rule. The proposed structures would be located entirely over open water. This office has no objection to the
proposed work. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit
issued should include standard conditions for private docking facilities.

CONSISTENCY DETERMINATION:
This project is consistent with the 2006 Wilmington -New
Land Use Plan Update.
The applicant proposes to expand a previously authorized private docking facility
docking facility within the Cape Fear River. The project is located at 7156 River Road,
adjacent to the Cape Fear River in New Hanover County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SC and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Conservation.
In general, Wilmington -New Hanover County allows development in Conservation
classified AECs, which is consistent with the State's minimum use standards. The
Wilmington -New Hanover County Land Use Plan contains some policies, which exceed
the State's minimum use standards, however none of these policies are applicable to this
project.
This project appears to be consistent with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update.

On August 18, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and
Land Resources received a copy of the CAMA Major Permit Application for the subject project.
Staff review of the plans and specifications on August 24, 2016 has determined that the
development activities proposed at this time will not pose a threat to surface water quality from
stormwater runoff. The Director has determined that projects that are reviewed and approved by
the Division as not posing a water quality threat from stormwater runoff should not be subject to
the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater
rules. By copy of this letter, we are informing you that this project will not require a stormwater
management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater
runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES)
stormwater discharge requirements. You are required to have an NPDES permit for stormwater
discharge from projects meeting these criteria. All temporary built -upon area associated with the
construction of the project must be removed within 30 days of completion of the project, or when
it is no longer needed, whichever occurs first.

Tbrough coordination with the North Carolina Division of Coastal Management we have
learned of your request to expand an existing docking facility at 7156 River Road along the Cape
Fear River in Wilmington, New Hanover County, North Carolina. Coordinates are: 34.0997 N, -
77.9233 W.
On January 1, 2011, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
All work authorized by this permit must be performed in strict compliance with the
submitted plans and the revised plans received on 1 September 2016, which are a part of
this permit.
2. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines
(copy enclosed), and strictly adhere to all requirements therein.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies

My name is David Logan. I am the Authorized Agent representing Mr. Roberts for this permit. I have spoken with Mr.
Roberts and we have decided to reduce the size of the platform in order to expedite the permitting process. Please find
attached revised work plan drawings indicating the reduction.
Please note that we anticipate an Access Credit through the platform in order to access the floating dock. Here is our
proposed square footage summary:
Platform 20'x28.5' = 570 SF
Access Credit 6x28.5' _ (171 SF)
Total Square Footage = 399 SF
Please advise if this will comply under your General Permit 56 at your earliest convenience.

Permit Process, which is a much more detailed and time/resource consuming process. We ask that you provide, via
email, confirmation or calculations/plans that show your project will not exceed 400 square feet. Since your project
exceeds that amount, please consider reducing the amount to comply with the General Permit 56.

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for a development permits
in Areas of Environmental Concern as designated under the CAMA in Wilmington, New
Hanover County. On August 5, 2016, Robert Peyton proposed to reconfigure an existing
docking facility at 8108 Bald Eagle Lane, adjacent to the AIWW & Middle Sound, and on
August 9, 2016, Anthony Roberts proposed to expand an recently authorized docking facility
at 7156 River Rd., adjacent to the Cape Fear River. On August 5, 2016, CC & FT Oldman,
LLC proposed to construct a bulkhead with approx. 125 sq. fG of coastal wetland fdl at 408
Marlin St., adjacent to a manmade canal off of the AIWW, in Sunset Beach, Brunswick

9 PROJECT DESCRIPTION:
The project site is located at 7156 River Road, adjacent to the Cape Fear River, in New Hanover County. To locate the
project site from the Wilmington Regional Office (WiRO), travel from Wilmington towards Carolina Beach on College
Road (NC Hwy 132) and then Carolina Beach Road (NC Hwy 421) for approximately 12 miles south until you reach River
Road, which will be located on the right just before the Snows Cut Bridge over the AIWW. Travel on River Road for
approximately 4.4 miles until your reach the property of interest, which will be located on the left. If you plan to do a site
visit, please call our office at 910.796.7215 to get the code to enter the property.
The applicant currently maintains a single family residence on the approximately 6.9-acre tract. There is approximately 365
linear feet of shoreline which is stabilized by vegetation. Upland vegetation includes ornamental landscaping, maintained
lawn grass and live oaks. There is an area on the southwestern portion of the property which exhibits §404 Wetlands.
Waterward of the most western end of the property towards the Cape Fear River is an area of Coastal Wetlands, measuring
approximately 120' in width, which consists primarily of Smooth Cordgrass (Spartina aftemiflora).
The applicant recently obtained CAMA General Permit No. 67164 on 8/5/2016 for a private docking facility into the Cape
Fear River. The docking facility isjust under construction which consists of an access pier, measuring approximately 370' in
length by 6' in width. The pier terminates into a partially covered platform, measuring approximately 20' in length by 20' in
width. An access ramp leads to a floating dock from the northern side of the fixed platform, measuring approximately 30' in
length by 6' in width which runs parallel to the shoreline and channel. Two (2) floating modular platforms ('Jet -Docks"),
measuring a total of approximately 12' in length by 10' in width are to be located on the landward side of the floating dock.
The authorized docking facility accommodates up to two (2) vessels within waterdepths between-2.5'to -3.0' @ normal low
water (NLM. These soundings were obtained by the NCDCM on 8/9/2016 at low tide.
The New Hanover County Land Use Plan classifies the area as Conservation and the remaining uplands as Transition. The
area is not designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries. The waters are classified SC, by
the N.C. Division of Water Resources, and Closed for shellfish harvest. The Cape Fear River is approximately 1,400' wide in
the project area, which is located on a back channel on the eastern side of the river and not adjacent to the federal shipping
channel.
PROPOSED PROJECT:
The applicant is proposing to expand a previously authorized private docking facility within the Cape Fear River. The
partially covered fixed platform would be expanded from 20' in length by 20' in width to 30' in length by 20' in width. A
new boatlift, measuring approximately 13' in length by 13' in width would be installed on the southern side of the partially
covered platform. The application states that the proposed platform and boatlift would be located in water depths of
approximately -2.5' to -3.0' @ NLW. The application also states that the new configuration would accommodate up to
three (3) vessels (See Sheets 1 and 2 of 2 and Project Narrative).
10. ANTICIPATED IMPACTS:
The proposed structures would incorporate an additional approximately 369 sq. ft. of Estuarine Waters and Public Trust
Area. According to the application, the proposed structure would extend approximately 325' into the waterbody, which
measures approximately 1,400' across. This distance would conform to both the 1/4 width rule and the established pier
lengths. As proposed, the applicant's proposal would not encroach into the USACE 80-foot setback or into either adjacent
15' Riparian Corridor Setback Area. The proposed structures would be located in water depths of approximately-2.5'to -
3.0' @ NLW. Minor increases in turbidity should be expected during construction.

75-day review period is provided by law when such time is necessary to complete the review. If you have
