This permit, issued on Julv 3, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may De suoijeci to Imes, imprisonment or ctvu action; or may cause the permn to oe nuu ana voto. 1) Unless specifically altered herein, this Minor Modification authorizes the wooden accessways and/or wooden decking associated with lots 1-27 (decks and accessways), 28-49 (accessways), lots 50-63 (decks and accessways), lots 64-72 (decks), all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. 2) In order to ensure compliance with the conditions of this Permit, the permittee and his contractor shall schedule a pre -construction conference with the Division of Coastal Management prior to the initiation of any construction activities. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The permittee shall receive a Stormwater Management permit modification from DEMLR prior to the initiation of any construction. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA permit. 4) This Minor Modification shall be attached to the original Permit No. 21-16, which was issued on 2/11/16, as well as all subsequent modifications, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 5) All conditions and stipulations of the active permit remain in force unless specifically altered herein. NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW- 2008-03241. NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2008-1740 V2. NOTE: A minor modification application processing fee of $100 was received by DCM for this project. Your petition for a hearing must be filed in accordance with NCGS Chapter 150E with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. This permit, #21-16, was issued on 2/11/16, modified on 6/7/17 and is set to expire on 12/31/19. The permit authorized upland development, marina facility, excavation and spoil disposal and shoreline stabilization. Subsequent to the issuance of this permit, the applicant is proposing to add seventy-two 10' x 18' uncovered decks for each condominium lot and sixty-three 3' wide perpendicular walkways for lots 1-63 that would tie into the previously permitted boardwalk. Each walkway would vary in length depending on location (17' to 38' long). All decks and walkways would be slatted and above grade per the applicant. I didn't see a question or any indication that a response was needed. As long as there is no change to the BUA, I have no comments. Decks usually are not considered BUA. However, I had previously noted some other changes to the site layout from the plans I had previously approved and had advised the consultant that a modification to the state stormwater permit would likely be needed to address changes to the site layout (see attached email). Please let me know if I can be of additional assistance. The increased area would be subject to the 2017 rules. The rest remains subject to the rules in place when the permit was approved. As for the change in the type of pavement surface, if it is changing from what was previously approved and that was the only change, then you could either submit a minor modification to document the change or identify the change as part of your certification. Either way, you'd have to be careful of any changes to the elevations of the system. I do not remember changing these so I went back and looked at the two versions and yes at some point and for some reason the grass cell emergency access lengths did grow and by approximately 423 square feet. I checked the other parking areas and they have remained constant. Since pervious pavements are now 100% credit, is a permit modification required for this small amount. We do not remember why but will shorten them in the interim as previously permitted if required so the CAMA minor modification can move forward. Ron and I will revisit and determine the need for the change in length and be back in touch if need be. Secondly if you recall we discussed some time ago the possibility of the developer/permittee being able to install whichever permeable pavement system (pavers, asphalt, concrete, etc.) desired (detail on this project mentions pervious concrete). At that time, given the way the permit and applications were set up, the permittee could only install the type listed in the permit or request a modification for a different type. Have any policies been adopted to allow for any type of pervious pavement to be installed or will a modification be required? Thanks for keeping me straight! Ginger From: Hall, Christine <Christine.
