This permit, issued on March 7, 2022 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

1} This Renewal shall be attached to Permit No. 21-16, which was transferred to the pennittee on
6/2/21, as well as all subsequent modifications, refinements, and renewals, and copies of all
documents shall be readily available on site when a Division representative inspects the project for
compliance.
2) All conditions and stipulations of the active permit remain in force under this renewal.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No.
2008-1740 0.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No.
2008-0324I.
NOTE: A permit renewal application processing fee of $100 was received by DCM for this project.
This permit action may be appealed by the pumittee or Signed by the authority of the Secretary of DEQ and the Chair

Authorizing development in Carteret County at adjacent to Morgan Creek. at 100 Olde
Towne Yacht Club Rd., in Beaufort
, as requested in the permittee's letter dtd 12/10/20,
including; the attached workplan drawings (2) Sheet 1 of 2 dtd 12/10/20 and Sheet 2 of 2 dtd "Rev 11/19/20".
This permit, issued on June 2, 2021 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to he null and void.
1) This minor modification/transfer must be attached to copies of the following permit documents,
which includes all application forms and workplan drawings:
a. The New Permit 21-16 issued on 2/11/16;
b. The Minor Modification issued 6/7/17;
C. The Minor Modification issued on 7/3/19;
d. The Renewal issued on 2/7/20.
2) Copies of all referenced documents shall be readily available on site when a Division representative
inspects the project for compliance. In accepting this transfer, the new permittee agrees that all
conditions and stipulations of the active permit remain in force.
This permit action may be appealed by the pennittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.

3) Unless specifically altered herein, this Minor Modification authorizes reduction in dwelling units from
72 to 61 and the reconfiguration of portions of the marina from fixed to floating structures, all as
expressly and specifically set forth in the attached letter and workplan drawings. Any additional
development activities may require a modification of this permit.
4) This Minor Modification does not authorize any new formalized boat slips. The marina is authorized for
no more than 122 formalized boat slips.
5) No attempt shall be made by the pemvttee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
General
7) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
9) This Minor Modification shall be attached to the original Permit No. 21-16, which was issued on
2/11/16, as well as all subsequent modifications, refinements, and renewals, and copies of all documents
must be readily available on site when Division personnel inspect the project for compliance.
10) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2008-03241.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2008-1740 v3.
NOTE: A minor modification and transfer application processing fee of $200 was received by DCM for
this project.
