Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Permit Number 31-16 Issued to Pirates Cove Homeowners Association, Inc., 1 Sail Fish Drive, Manteo, NC 27954 Authorizing development in Dare County at adjacent to Pamlico Sound, 37-44 Ballast Point Drive, Pirates Cove S/D, in Manteo ,as requested in the permittee's application dated 11/20/15 including attached workolan drawines (3) 2-4 of 4 all dated I2/23/15. This permit, issued on March 4, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April 1 and -September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) Excavation shall not exceed -4 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires fiuther Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 31-16� Page 2 of 3 ADDITIONAL CONDITIONS Excavation shall not occur within five feet of any Coastal Wetlands. No excavation of any vegetated wetlands is authorized by this permit. Spoil Disposal All excavated materials shall be confined above normal water level and landward of regularly or ;irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Maintenance Clause The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of :any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. General The permittee and/or his or her contractor shall meet with a representative of the Division prior to initiation of any phase of this project. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. TE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit 198000291 and assigned SAW 2016-00317, which was issued 3/1/16. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. The Pirates Cove Homeowners Association (PCHOA),owns a piece of property that is located on the Roanoke sound and attached to the mainland. The property extends from the mainland into the Roanoke Sound, It forms a protective cove behind Lots 37 thru 44 on Ballast Point Drive. The south end of this cove has an opening to the sound. This cove allows the mainland homeowners on the above mentioned lots to keep their boats and other watercraft behind their house in a safe environment from storms and wakes of passing boats. There are several piers and floating docks located inside of this cove. Periodically, on almost a yearly basis, the existing channel fills in with sand and prevents safe passage into and out of the cove. Since 2006, 1 as one of the landowners (40 Ballast Point Drive) have assisted and requested permits to maintain this channel . On a separate page, I have identified at least 9 permits that have been issued in an attempt to keep the cove open. Most of these are permits for dredging but, several permits include the construction of 4 replacement groins ( jetties) on the soundward side of the cove to capture the North to South migration of sand in the sound. The first two on the south side have worked extremely well. We have just constructed two additional groins last month North of the others. We hope that these will delay somewhat the time it takes for the channel to fill. In addition, we constructed a 200 foot bulkhead on the sound side at the Northern tip of the property. This has been very helpful with preventing erosion from over wash during northeast storms. The purpose of this application is to be able to dredge on an unscheduled basis without having to file for a permit every year. We basically have been recycling sand from the inlet and disposing of it on to the land that PCHO owns. The sand from the sound fills in the channel and we recycle again. WE would like to be able to dredge smaller amounts more often without having to bring in large excavators. If we do maintenance dredging more often, we can probably get by with using a backhoe. As our street has built out with houses, it has become more difficult to transport large equipment into the neighborhood. We have always disposed of the dredged sand onto the property owned by PCHOA. We propose to continue placing the dredge spoils in that location. There is ample reserve space for future disposal on this area. There is a well maintained area of coastal wetlands that is located inside of the cove. We have been very careful to protect that area with silt screens and the wetlands continues to prosper. After each new dredging, an abundance of naturally occurring grasses grow on the fresh sand. The sound side of the cove doesn't have hardly any wetlands due to the constant over wash during NE storms. The land is also low enough that we will be able to elevate it as we continue to dredge in the future. We know that nature is all powerful and sometimes you cannot prevent things happening. We know that we will probably always have to dredge in the future. We have taken many steps to help prevent the filling of the channel with the construction of groins and bulkhead. DCM- MHD CITY Field Investigation Report Page 2 Project Setting The development site is within the six acre subdivision of Pirates Cove located adjacent to the Manteo Causeway (US 64/264) and on the northwest side of the Washington Baum bridge, Roanoke Island, Dare County, and adjacent to the Roanoke Sound. The site is a peninsula or spit of sand that forms a protective cove adjacent to lots 37-44 on Ballast Point Drive. The elevation of the project site is approximately 5 ft above Normal Water Level (NWL). Man-made features on the property are 4 groins, a section of bulkhead, and breakwaters. The peninsula does have approximately 4,675 sq ft of coastal wetlands located on the landward side that are vegetated mainly with juncus romererians and spartina patens. The Pirates a piece of property that is located on the Roanoke sound (tends from the mainland into the Roanoke Sound, It forms a protective cove behind Lots 37 thru 44 on Ballast Point Drive. The south end of this cove has an opening to the sound. This cove allows the mainland homeowners on the above mentioned lots to keep their boats and other watercraft behind their house in a safe environment from storms and wakes of passing boats. There are several piers and floating docks located inside of this cove. Periodically, on almost a yearly basis, the existing channel fills in with sand and prevents safe passage into and out of the cove. Since 2006, 1 as one of the landowners ( 40 Ballast Point Drive) have assisted and requested permits to maintain this channel . On a separate page, I have identified at least 9 permits that have been issued in an attempt to keep the cove open. Most of these are permits for dredging but, several permits include the construction of 4 replacement groins ( jetties) on the soundward side of the cove to capture the North to South migration of sand in the sound. The first two on the south side have worked extremely well. We have just constructed two additional groins last month North of the others. We hope that these will delay somewhat the time it takes for the channel to fill. In addition, we constructed a 200 foot bulkhead on the sound side at the Northern tip of the property. This has been very helpful with preventing erosion from over wash during northeast storms. The purpose of this application is to be able to dredge on an unscheduled basis without having to file for a permit every year. We basically have been recycling sand from the inlet and disposing of it on to the land that PCHO owns. The sand from the sound fills in the channel and we recycle again. WE would like to be able to dredge smaller amounts more often without having to bring in large excavators. If we do maintenance dredging more often, we can probably get by with using a backhoe. As our street has built out with houses, it has become more difficult to transport large equipment into the neighborhood. We have always disposed of the dredged sand onto the property owned by PCHOA. We propose to continue placing the dredge spoils in that location. There is ample reserve space for future disposal on this area. There is a well maintained area of coastal wetlands that is located inside of the cove. We have been very careful to protect that area with silt screens and the wetlands continues to prosper. After each new dredging, an abundance of naturally occurring grasses grow on the fresh sand. The sound side of the cove doesn't have hardly any wetlands due to the constant over wash during NE storms. The land is also low enough that we will be able to elevate it as we continue to dredge in the future. We know that nature is all powerful and sometimes you cannot prevent things happening. We know that we will probably always have to dredge in the future. We have taken many steps to help prevent the filling of the channel with the construction of groins and bulkhead. The project site is located adjacent to 37-44 Ballast Point Dr, Pirates Cove Subdivision in Manteo, Dare County on the Roanoke Sound. The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW) and Estuarine Shoreline (ES) Areas of Environmental Concern (AEC). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 07H.0206 Estuarine Waters (c) Management Objective. To conserve and manage the important features of estuarine waters so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing estuarine waters so as to maximize their benefits to man and the estuarine and ocean system. (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule 07H.0208. To protect public rights for navigation and recreation and to conserve and manage the public trust areas so as to safeguard and perpetuate their biological, economic and aesthetic value. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Consistent: The applicant proposes to maintenance dredge an existing channel. 07H.0208 Use Standards (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The development proposal meets the intent of this rule. (a)(2)(A) requires that the location, design and need for development, as well as the construction activities involved be consistent with the stated management objective. Consistent: The development proposal meets the intent of this rule. (a)(2)(B) requires that no suitable alternative site or location outside of the AEC exists for the use of development. It further states, "that the applicant has selected a combination of sites and design that will have a minimum adverse impact upon the productivity and biologic integrity of coastal marshland, shellfish bed, beds of submerged aquatic vegetation, spawning and nursery areas, important nesting and wintering sites for waterfowl and wildlife, and important natural erosion barriers. Navigation channels, canals and boat basins shall also comply with the following standards: Consistent: The development proposal meets the intent of this rule. (A) Navigation channels and canals may be allowed through fringes of regularly and irregularly flooded coastal wetlands if the loss of wetlands will have no significant adverse impacts on fishery resources, water quality or adjacent wetlands, and if there is no reasonable alternative that would avoid the wetland losses; Consistent: The development proposal meets the intent of this rule. New dredged material disposal areas shall not be located in the buffer area as outlined in 15A NCAC 07H .0209(d)(10); Consistent: The development proposal meets the intent of this rule, all dredge spoil will be properly contained and stored. The management objective is to ensure that shoreline development is compatible with both the dynamic nature of coastal shorelines as well as the values and the management objectives of the estuarine and ocean system. Overview: The project area consists of two (2) sites, a .91 acre peninsula extending from the northeast side of the Pirates Cove subdivision into the Roanoke Sound, and a 50 foot wide by 340 foot long entrance channel and cove to the south and west of the peninsula. The peninsula has a combined shoreline of approximately 1,250 linear feet along the Roanoke Sound, the channel, and the cove. Approximately 4,675 sq. ft. of Coastal Wetlands are located on the west side of the peninsula. The remainder of the land contains sparse vegetation with natural grasses. Elevations on the peninsula are approximately 5 feet above Normal Water Level (NWL). The peninsula is located within the VE (EL 12) Floodzone. Water depths within the entrance channel and cove range from 4.8 feet to 1.4 feet with an average depth of 2.5 feet. Water depths within the Roanoke Sound at the peninsula are approximately 6 feet. Existing shoreline improvements on the peninsula consist of four (4) groins, a 200 foot section of bulkhead and breakwaters along the eastern and southern shorelines. The channel to the south and west shoals frequently due to sand migration. Approximately nine (9) General Permits have been issued over the past nine (9) years for dredging of the channel and placement of spoil on the peninsula. Issuance of a CAMA Major Permit would allow maintenance dredging and spoil placement to be an ongoing activity. Maintenance dredging of the 50 foot by 340 foot entrance channel and placement of dredge spoil on the peninsula are proposed. The spoil site will be accessed from Ballast Point Drive between the properties at 36 and 37 Ballast Point Drive. Dredge spoil will be contained by silt fencing until dried and then spread on the high ground area. Coastal wetlands will not be disturbed. The applicant is proposing to dredge a navigation channel near lots 37-44 in the Pirates Cove community, Manteo, NC. This channel has been maintained on a smaller scale via general permits since 2006. The proposed channel would be 340' x 50' to an average depths of -4' at NWL. This will require the removal of approximately 944 cubic yards of material that will be placed on the nearby spoil area. Since the area has been maintained as a channel for the past 10 years DCM Fisheries has no objection to the continued maintenance of this channel. However to avoid potential slough of coastal wetlands adjacent tb the channel alignment no dredging should occurwithin 8' of coastal wetlands. This should allow for a 2-1 slope of the sediments in the area adjacent to the dredged channel and reduce the chances for negative impacts to coastal marsh. Field Investigation Report Page 2 Proiect Setting The development site is within the six acre subdivision of Pirates Cove located adjacent to the Manteo Causeway (US 64/264) and on the northwest side of the Washington Baum bridge, Roanoke Island, Dare County, and adjacent to the Roanoke Sound. The site is a peninsula or spit of sand that forms a protective cove adjacent to lots 37-44 on Ballast Point Drive. The elevation of the project site is approximately 5 ft above Normal Water Level (NWL). Man-made features on the property are 4 groins, a section of bulkhead, and breakwaters. The peninsula does have approximately 4,675 sq ft of coastal wetlands located on the landward side that are vegetated mainly with juncus romererians and spartina patens. The remaining land is high ground sparsely vegetated with natural grasses. The shoreline on the waterward side is protected by an existing breakwater and 200 ft of existing bulkhead near where it meets the mainland and has 4 existing groins located near the terminus of the peninsula. The water depths in the Roanoke Sound near the peninsula are approximately 6 ft and the depths in the channel between the mainland and peninsula range from 4.8 ft to 1.4 ft. The waters of the Roanoke Sound are classified as SA by the Division of Environmental Management and are closed to shellfish harvesting. Development Proposal The applicant proposes to maintenance dredge the existing channel located between the mainland and the peninsula. This area shoals in frequently due to the migration of sand along this area and prevents navigation for the property owners adjacent to the area. Multiple general permits have been issued for this project and the applicant is applying for a CAMA Major Permit to allow for ongoing maintenance dredging to continue (General permits issued A64314 in 2015, A63428 in 2014, A62413 in 2013, A6O417 in 2012, A58994 in 2012, A559O7 in 2010, A51615 in 2008, A46813 in 2007, A42194 in 2006). The applicant proposes to dredge an approximately 340 ft by 50 ft channel to an average depth of 4 ft. The dredged spoil would be placed on the peninsula and would be contained by silt fencing until dried and then spread on the high ground area. The existing water depths now are an average of 2.5 ft therefore the proposal would involve the removal of approximately 944 cu yd of sand material. Anticipated Impacts The proposed project would dredge 17,000 sq ft of shallow water bottom within the Public Trust Estuarine Waters Area of Environmental Concern and fill approximately 12,500 sq ft of high ground within the Estuarine Shoreline Area of Environmental Concern. November 20, 2015 This project is located in the gated gom"k"f Pirates Cove, which - Cove Homeowners Association (PCHOA),Qwns a piece of property thatis and attached to the mainland. The property page 6A Manteo, NC. The Pirates ted'on the Roanoke sound the Roanoke Sound, It forms a protective cove behind Lots 37 thru 44 on Ballast Point Drive. The south end of this cove has an opening to the sound. This cove allows the mainland homeowners on the above mentioned lots to keep their boats and other watercraft behind their house in a safe environment from storms and wakes of passing boats. There are several piers and floating docks located inside of this cove. Periodically, on almost a yearly basis, the existing channel fills in with sand and prevents safe passage into and out of the cove. Since 2006, 1 as one of the landowners (40 Ballast Point Drive) have assisted and requested permits to maintain this channel . On a separate page, I have identified at least 9 permits that have been issued in an attempt to keep the cove open. Most of these are permits for dredging but, several permits include the construction of 4 replacement groins ( jetties) on the soundward side of the cove to capture the North to South migration of sand in the sound. The first two on the south side have worked extremely well. We have just constructed two additional groins last month North of the others. We hope that these will delay somewhat the time it takes for the channel to fill. In addition, we constructed a 200 foot bulkhead on the sound side at the Northern tip of the property. This has been very helpful with preventing erosion from over wash during northeast storms. The purpose of this application is to be able to dredge on an unscheduled basis without having to file for a permit every year. We basically have been recycling sand from the inlet and disposing of it on to the land that PCHO owns. The sand from the sound fills in the channel and we recycle again. WE would like to be able to dredge smaller amounts more often without having to bring in large excavators. If we do maintenance dredging more often, we can probably get by with using a backhoe. As our street has built out with houses, it has become more difficult to transport large equipment into the neighborhood. We have always disposed of the dredged sand onto the property owned by PCHOA. We propose to continue placing the dredge spoils in that location. There is ample reserve space for future disposal on this area. There is a well maintained area of coastal wetlands that is located inside of the cove. We have been very careful to protect that area with silt screens and the wetlands continues to prosper. After each new dredging, an abundance'of naturally occurring grasses grow on the fresh sand. The sound side of the cove doesn't have hardly any wetlands due to the constant over wash during NE storms. The land is also low enough that we will be able to elevate it as we continue to dredge in the future. We know that nature is all powerful and sometimes you cannot prevent things happening. We know that we will probably always have to dredge in the future. We have taken many steps to help prevent the filling of the channel with the construction of groins and bulkhead.
