Fresh Pond Drive, Unit 1, Kill Devil Hills, NC 27948 development in Road, in Dare County at adjacent to Roanoke Sound, at 361 Mother as requested in the permittee's application dated 9/1/16, including attached workplan nit, issued on November 14, 2016 , is subject to compliance with the application (where consistent permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ;t to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility This permit authorizes the construction a shore parallel pier, tie pilings, and a boat lift, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this dokcing facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Owens III Permit No. 118-16 # Page 2 of 3 ADDITIONAL CONDI-TIONS This permit authorizes a maximum of four (4) formalized boat slips. Should either adjacent lot be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15-foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. Shoreline Stabilization The alignment of the permitted bulkheads shall be verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. The bulkheads shall be constructed in accordance with the alignment on the attached workplan drawings. The bulkheads shall be constructed prior to any backfilling activities. The temporary placement or double handling of fill materials within water or vegetated wetlands is not authorized. The bulkheads shall be structurally tight so as to prevent seepage of backfill materials through the structures. All backfill material shall be clean and free of any pollutants except in trace quantities. All backfill material shall be obtained from a high ground source and confined behind the permitted bulkheads. The bulkheads shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. Robert V. Sedimentation and Erosion Control 17) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 20) No excavation or filling of any vegetated wetlands is authorized by this permit. 21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 22) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project and assigned SAW 2016- 002168. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 201601005. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. (NCSR 1120) on Roanoke Island, Manteo NC. The applicant proposes to install approximately 1021.f. , of estuarine shoreline timber bulkhead on the east side of the property, (Roanoke Sound) and approximately 1021.f. of estuarine shoreline timber bulkhead along the west side of the property, (man-made canal) in conjunction with an elevated 6' wide dock and (4) wet boat slips with (1) boat lift. The site can be accessed by heading east on US 64/264, turning right onto Mother Vineyard Rd. and following east and then south to 361 Mother Vineyard Rd.. The property is currently undeveloped with a dense stand of trees and understory. The property has approximately 102 linear feet of estuarine shoreline along the Roanoke Sound and 102 liner feet of estuarine shoreline along the manmade canal. The intent of this application is to mitigate erosion along the shoreline in association with developing boat access to the subject property via the manmade canal. Project Description: The project consists of the following elements; • Construction of approximately 1021.f. of bulkhead along the Roanoke Sound • Construction of approximately 102 Lf. of bulkhead along the adjoining man made canal • Construction of (4) 8' x 25' boat slips with (1) of the boat slips containing a 8'x10' boat lift Existing Conditions: The site is currently undeveloped on the eastern and western portions of the property. It should be noted that the adjoining property owners, to the north and south, have installed supplemental erosion control measures in an effort to protect their existing shoreline retaining walls, which currently encroach onto the subject property. There was no observed evidence of submerged aquatic vegetation (SAV) along the estuarine shorelines or coastal wetlands in the proximity of the subject property. Stormwafer Management: No upland improvements, pavements, walkways or other impervious surfaces will be constructed as part of the project. No stormwater management or additional stormwater measures are proposed for this project. Methods of Construction: Dock and bulkhead components shall be timber and or vinyl/composite material frame construction. Installation will be by conventional marine construction marine methods. The property has an area of approximately 20,213 sq. ft., an elevation of approximately 3 feet above normal water level (NWL) and has sandy soils. The property is vegetated with Pine, Wax Myrtle, Yaupon, cat brier, Virginia Creeper, Live Oak Magnolia, Red Bay, wild grape and native grasses. The property has approximately 102 feet of shoreline on a manmade canal on the western boundary and 102 feet of shoreline on the Roanoke Sound on the eastern boundary. The north and south boundaries are adjacent to lots that are developed with single family dwellings, shoreline stabilization bulkheads and various boating use structures. The eastern shoreline has a small section of a relic bulkhead at the northeastern corner as well as a small area of riprap rubble. Based on aerial photography, the relic bulkhead section appears to be a remnant of a bulkhead that had severe failure between July 2006 and October 2008. Currently there is a crescent shaped erosion area with an erosion escarpment along that shoreline. A small area of riprap located at the end of the southern adjacent property owner's return wall is present. Erosion along the western shoreline, while not as aggressive, has resulted in some undermining of vegetation. The waters of Roanoke Sound in this area are classified as SA and are open to shellfish taking. The waters of Shallowbag Bay are classified as SC and are closed to shellfish taking. Development Proposal In order to prevent further erosion along the Roanoke Sound shoreline, the applicant proposes to construct a 102-foot long bulkhead to connect with the corner of the adjacent lots and have a straight alignment. The proposed bulkhead alignment will have a maximum distance of 35 feet from the shoreline and an average distance of 23 feet. The canal is approximately 41 feet wide at this location with water depths ranging from 2 to 4 feet. The site elevation is approximately 3 feet above Normal Water Level (NWL). The right-of-way of Mother Vineyard Road crosses the property to the west, parallel to and approximately 20 feet from the shoreline. The property is vegetated with trees and native grasses. The property is located in the VE (EL10) Floodzone. Existing shoreline improvements along the sound consist of approximately 20 linear feet of riprap wall and relic bulkhead to the north and approximately 15 feet of riprap rubble to the south. The relic bulkhead appears to be a remnant of a bulkhead that had severe failure between July 2006 and October 2008. An erosion escarpment is located along the sound shoreline. The shoreline along the canal is unimproved. Erosion along the canal has resulted in some undermining of vegetation. Installation of 102 linear feet of bulkhead along the Roanoke Sound and 102 linear feet of bulkhead along the manmade canal, construction of a 6 foot wide by 102 foot long shoreside dock with thirteen (13) integral tie pilings and an 8 foot by 10 foot boat lift on the canal, and clearing and filling of the lot are proposed. The soundside bulkhead will tie into adjacent bulkheads to the north and south and will be aligned a maximum of 35 feet and an average of 23 feet from the shoreline. The bulkhead along the canal will be located along the NWL. The waters of Shallowbag Bay in this area are designated as Class SC waters and are closed to shellfish taking. A review of potential historic or archaeological resources was not provided. A review of submerged aquatic vegetation (SAV) was not provided. Anticipated Impacts resulting from this project are expected to include: the filling of 2,335 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AECs) and .39 acre of Coastal Shoreline AEC, and; the shading of 612 sq. ft. of Public Trust Area/Estuarine Waters AEC Basis for Determination: The Dare County Land Classification Map identifies the subject property as "Community Residential".
