This permit, issued on Aueust 18, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may )e subject to tines, imprisonment or civu action; or may cause me permit to oe nun ana voia. 1) Unless specifically altered herein, this permit authorizes the modification of the terminal groin structure and associated fillet, the construction of an additional construction access point, increase in the staging area and construction corridor, all as expressly and specifically set forth in the attached permit application letters. Any additional land development and/or construction activities may require a modification of this permit. Contact a Division of Coastal Management (DCM) representative at (910) 796-7215 for this determination. 2) This Minor Modification modifies the moratorium found in Condition No. 4 of the original of Permit No. 107-16 to allow construction seaward of the fast line of stable natural vegetation until April 30, 2018. As of May 1, 2018, the Condition No. 4 of the original permit shall apply. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The Town has requested the following modifications to the permit: 1. An extension of the environmental window from March 31 to April 30 2. The addition of a construction access point. 3. An expansion of the footprint of the staging areas and construction corridor 4. A reduction of the footprint of the rubble mound component of the terminal groin 5. An increase in the volume of material required to fill the template of the sand fillet. As you may know, the Service has been coordinating with the Corps Civil Works Program on the timing of the Wrightsville Beach CSDR and Ocean Isle Beach CSDR this winter. Due to the high usage of the south end of Wrightsville Beach by nesting shorebirds during spring. we requested that the Wrightsville Beach project be completed first, which likely will result in the Ocean Isle Beach CSDR project being conducted, at least in part, past March 31. We agree that it makes sense to leverage the Corps CSDR beach placement for this project. The existing BO includes an environmental window of November 16 to April 30, so no amendment is needed to address the proposal to extend the work window to April 30. Our review of the modification request indicates that the overall impacts to sea turtles, piping plovers, red knot, and seabeach amaranth remain unchanged. Accordingly, the revisions in the enclosed Attachment are made to the BO issued to your agency on August 6, 2015. The amendment only addresses statements in the BO that need revision in order to be consistent with the proposed permit modifications. Staging areas for earth -moving equipment must be located off the beach during the early (April 15 through April 30) and late (November 16 through November 30) portions of the nesting season. Nighttime storage of earth -moving equipment not in use must be off the beach to minimize disturbance to sea turtle nesting and hatching activities. All excavations and temporary alteration of beach topography will be filled or leveled to the natural beach profile prior to 9:00 p.m. each day. Please note that Condition # 5 of the original permit dated November 7, 2016 must be implemented. * The footprint of the staging areas and construction corridor may be expanded from 0.85 acres to 0.997 acres around the terminal groin as a result of the Mean High Water Line moving seaward. * Due to changes in the dimensions of the terminal groin, the overall footprint of the structure will be reduced from 69,250 square feet to 61,188 square feet. * Due to erosion along the oceanfront shoreline between the time of the previous survey and the March 2017 survey, the fill template will require 337,530 cubic yards of sand instead of 264,000 cubic yards. This is an additional volume of 73,530 cubic yards, but the fill template remains the same and will cover 758,882 square feet. The new volume of 337,530 cubic yards of sand is needed to fill the terminal groin fillet to capacity. These requested modifications include relief from the environmental window for one month (extending the permissible construction time period from March 31 to April 30) such that the Town's permit is in alignment with the environmental window authorized for the USACE's CSDR Project.. As you know, the CSDR project is anticipated to go to construction this fall/winter. The Town is hoping to "piggyback" off the USACE's contract dredge rather than mobilize their own dredge for the construction of the required sand fillet which would result in considerable cost savings. After discussions with USACE Civil Works, it has been determined that a modification of the Town's permit to align with the environmental window authorized for the CSDR project will help negate potential contracting issues between the USACE Civil Works and the prospective contract dredging companies. As you know, the U.S. Fish and Wildlife Service (Service) issued a final Biological Opinion for the project on August 6, 2015. I discussed the proposed modifications to the permit by phone with you, Brad Rosov, and Ken Riley (three separate phone calls) on August 10, 2017. The Service does not have any significant concerns with or objections to the proposed modifications. As you may know, the Service has been coordinating with the Corps Civil Works Program on the timing of the Wrightsville Beach CSDR and Ocean Isle Beach CSDR this winter. Due to the high usage of the south end of Wrightsville Beach by nesting shorebirds during spring, we requested that the Wrightsville Beach project be completed first, which likely will result in the Ocean Isle Beach CSDR project being conducted, at least in part, past March 31. We agree that it makes sense to leverage the Corps CSDR beach placement for this project. In addition, we have reviewed the other requested modifications, and have the following comments: 1. The Service does not object to the proposed extension of the 2018 environmental window for this project from March 31 to April 30. The extension should only be for 2018, and should not apply to maintenance activities in future years. All work should be completed and equipment should be off the beach by April 30. 2. The Service does not object to the proposed addition of one construction access point at Greensboro Street, although we are concerned with the distance between the Greensboro Street proposed access point and the terminal groin, which is over 0.75 miles. We recommend that vehicle movement up and down the beach be limited to the maximum extent possible, and that equipment use the East 4th Street access point as much as possible. 3. The Service does not object to the proposed expansion of the footprint for the staging areas and construction corridor, although it is unclear that this is a necessity. The July 12, 2017 request for permit modification appears to request this expansion just because as described in the project documents, the surveyed area is actually bigger. However, the request does not appear to be made because a larger area is needed. The Service recommends that the staging area be minimized to the maximum extent possible, and that vehicle movement up and down the beach also be limited to the maximum extent possible. 4. The Service does not object to the proposed reduction in the footprint (square footage) of the rubble mound component of the terminal groin. S. The Service does not object to the proposed increase in volume of material required to fill the template of the sand fillet. I believe that the BO should be modified to address the proposed modifications. I spoke with Pete about it and he believes that he can sign an amendment without having to go through Regional review. I will work on a BO amendment and get it to you as soon as possible. Many of the USACE projects have been established for some time under the consistency process and are under the May 1 date. This can be problematic in some areas (i.e. south end of Wrightsville) when the work extends into April and birds are present. Survey work is being done for the groin project and it has been noted that piping plovers and red knot are using the area, though I believe they are on the west end of Holden. Wilson plovers and willets have been using the east end of Ocean Isle this season. These birds are the reason why we requested the April 1 date in our comments for the groin project. Our biologists would like to revisit the May 1 date for the USACE projects whenever the opportunity arises. If it is determined an extension would need to be allowed, measures must be taken to protect shore birds. This would include delineating habitat, daily monitoring, and then if territories are present, a buffer establish around them marked with posts, string, and flagging. This project involves the construction of a terminal groin and an associated sand fillet which have been designed to help curb the erosion at the eastern end of the island. Since receiving all necessary permits and authorizations to construct this project, several factors have changed warranting a request for a number of modifications to the CAMA and Department of Army permits. Specifically, the Town of Ocean Isle Beach would like to request: • An extension of the environmental window from March 31 to April 31 • The addition of a construction access point • An expansion of the footprint of the staging areas and construction corridor • A reduction of the footprint of the rubble mound component of the terminal groin • An increase in the volume of material required to fill the template of the sand fillet The justification for each requested modification is as follows: 1. An Extension of the Environmental Window from March 31 to April 31 The US Army Corps of Engineers (USACE) has informed the Town that funding has been included in their F/Y 2017 work plan for the Town's Coastal Storm Damage Reduction (CSDR) Project. According to the USACE announcement, $5,460,000 has been earmarked in this plan for the Ocean Isle Beach Coastal Storm Damage Reduction (CSDR) Project segment of Brunswick County Beaches to be accomplished along with $4.85 million in Flood Control and Coastal Emergencies (FCCE) funds for a total of $10.310 million. The Town is still awaiting final approval of the FCCE funds, however, funding in the USACE work plan means the 3.25 mile CSDR project should proceed this coming fall/winter. With this in mind, the Town is seeking assistance from the USACE for the approval of a Memorandum of Agreement (MOA). This MOA would provide a means for the Town to pay the USACE for the dredging and placement of material to fill the portion of the Town's Shoreline Protection Project sand fillet that is situated outside of the CSDR project's fill template. The sand fillet spans the oceanfront shoreline from Station 0+00 (the location of the terminal groin) to Station 30+00. The CSDR project begins and Station 10+00 and will extend westward to Station 180+00 (final design to be determined by the USACE). In this regard, the only portion of the sand fillet that would not be included in the CSDR project is the 1,000-foot segment from Station 0+00 to Station 10+00. The borrow area for both the CSDR project and the Town's Shoreline Protection Project are the same- the Shallotte Inlet Borrow Area. With the issuance of the MOA, the Town would no longer need to to hire a separate dredge to perform the dredge and fill work for the construction of the sand fillet due to the fact that the USACE contract dredge would perform the this fill. Thus, without the need to mobilize an additional dredge to the site, the cost savings to the Town as a result of the MOA may approximate upwards of $750,000. One hurdle to the MOA at this point, however, is the fact that the CSDR project authorization and the Town's permits for the Shoreline Protection Project includes differing environmental windows. From a contracting point of view between the USACE and their prospective dredge contractor, it will be important for both projects to include the same window. The CAMA and Department of Army permits issued for the Ocean Isle Beach Shoreline Protection Project includes an environmental window that limits construction of the project between November 16 through March 31. However, the USACE Authorization for the Ocean Isle Beach CSDR Project includes an environmental window limiting the construction to November 16 through April 30. Should the USACE move forward this coming fall/winter to construct the CSDR project and include the additional placement of material within the Shoreline Protection Project's sand fillet, it will be highly beneficial for both components of the dredge contractor's work to include the same environmental window. Therefore, the Town is seeking a modification to their CAMA and Department of Army permits to allow for relief of the environmental window allowing construction activity to continue to April 30 in alignment with what has been authorized for the CSDR project. Because the construction of the CSDR project would entail construction equipment and pipes on the beach within the area between the Shallotte Inlet borrow area and the footprint of the CSDR project, the sand fillet area (which is situated between the borrow area and the CSDR project) may be disturbed through April regardless of a modification to the Town's CAMA permit. Therefore, the requested modification to extend the construction window through April 30 would not be expected result in additional environmental impacts. Should the CSDR project not be implemented this coming fall/winter causing the Town to contract their own dredge, this request would no longer be warranted. 2. The Addition of a Construction Access Point Town would also like to request a minor modification to the CAMA and Department of Army permits to allow for one (1) additional construction access point. Currently, the permits allows for one (1) access point to the beach for construction equipment and to the staging area located at the existing CAMA access point on East 4' Street (see Sheet 4 of 12 in Appendix A in the CAMA permit application). The Town would like to request an additional construction access point at the corner of East I' Street and Greensboro Street as well. This existing CAMA access point has been used for construction equipment in the past for other similar project including the CSDR project. As shown in Figures 1 and 2 below, the access point at Greensboro Street is ideal due to the lack of dunes, vegetation, or sandbags. The roughly 160' long and 15' wide (2,400 square feet) pathway between the street and the beach is composed primarily of sand and is located approximately 1,000 feet to the west of the terminus of the fill template. The addition of this construction access point for heavy machinery will be logistically beneficial to the project because the existing access point on East 4a' Street is located in proximity to the footprint of the groin which could lead to congestion. The extra access point would allow for the delivery of construction equipment and machinery associated with the beach fill component of the Shoreline Protection Project to the beach while avoiding the terminal groin work area. An Expansion of the Footprint of the Staaine Areas and Construction Corridor As permitted, the project includes two staging areas- one located in proximity to the AIW W where a barge may offload the stones for the terminal groin and another on the oceanfront beach in proximity to the footprint of the terminal groin. A construction corridor was also permitted around the footprint of the sheetpile section of the groin extending to the MHW mark. The total area of the two staging areas and the construction corridor was determined to be 37,132 square feet, or 0.85 acres. RIS4 AUG 2 3 Z017 r- C\:r-M CITY conducted in March 2017 moved the MHW seaward and therefore increased the area of the construction corridor. In consideration of keeping the total area to be disturbed below one acre, this modification requests an additional 6,305 square feet such that the total area within the staging areas and construction corridors will be 43,437 square feet, or 0.997 acres. 4. A Reduction of the Footprint of the Rubble Mound Component of the Terminal Groin As shown in the MP-2 form of the CAMA Major Permit application, the rubble mound portion of the terminal groin structure was initially designed and permitted to include a 69,250 square foot footprint. In light of changes to the bathymetric conditions since the time the permit application was developed, the design of the structure has been modified slightly. The crest length will remain 750 feet; however the width of the structure will be reduced. The permitted crest width was 15 feet. The new crest width will vary from 11 feet to 13 feet along the length of the structure. Due to changes in the design, the overall footprint of the structure now encompasses 61,188 square feet reflecting a reduction of 8,062 square feet of softbottom (sandy) habitat area to be permanently disturbed by the construction of the groin. 5. _An Increase in the Volume of Material Required to Fill the Template of the Sand Fillet The preliminary designs of the sand fillet, as described in the permit application, was developed using the most recent survey data available at that time. Since then, project engineers have used a more recent survey performed in March 2017 to determine the required volume of material required to fill the template based on the updated data. Initially, and as specified in the EIS and MP-2 form of the Major CAMA Permit application, the sand fillet was designed to incorporate the placement of 264,000 cubic yards of material. Due to erosion along the oceanfront shoreline since the time of the previous survey and the March 2017 survey, the fill template will now require 337,530 cubic yards of material to fill the same template. Therefore, the Town is requesting a minor modification to the permit to allow for this increased amount of material to be placed within the fill template. It should also be noted that the MP-1 form of the permit application erroneously indicated that the fill template for the sand fillet would cover a total of 535,738 square feet.
