Shoreline Stabilization — Offshore Sill
The alignment of the authorized offshore sill shall be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be re -staked by DCM within a maximum of 30 days prior to the new expected start of
construction.
The offshore sill alignment shall be constructed as depicted on the attached workplan drawings.
The offshore sill material shall consist of clean rock or masonry materials such as, but not limited to,
granite, marl, broken concrete, or oyster shell. It shall be of a size sufficient to prevent its movement
from the approved alignment by wave or current action.

The offshore sill shall have at least one, five foot opening at every 100 feet. The offshore sill sections may
be staggered and overlap as long as the five-foot separation between sections is maintained. Overlapping
sections shall not overlap more than 10 feet.
The height of the permitted offshore sill shall not exceed one foot above normal high water level.
The offshore sill shall be marked at 50 foot intervals with yellow reflectors extending at least three feet
above normal high water.
Offshore sill sections shall be setback 15 feet from the adjoining property lines and the riparian access
dividing line. The line of division of riparian access shall be established by drawing a line parallel to the
channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point
where the upland property line meets the water's edge.
Docking Facility
This permit authorizes only the addition of 8 boat lifts in the existing formalized slips, and other structures
and uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a pernianent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or over
"Public Trust waters without permit modification.
;_No `sewage, whether treated or untreated; shall be discharged at any time from any boats using the docking
,-facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for
-which the pennittee is responsible. This prohibition shall be applied and enforced throughout the entire
,,,existence of the permitted structure.
This permit does not authorize the creation of any additional formalized boat slips.
°In order to satisfy concerns of the resource agencies, physical stops shall be placed on all boat lifts at a
minimum height of 18 inches above the bottom substrate to prevent the boat lifts from disturbing the bottom
substrate. The physical stops shall remain in place for the life of the permitted docking facility.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
:waters at or adjacent to the authorized work.

Narrative Description:
This is a modification request to CAMA Major Permit #127-16. 127-16 was issued on December
12, 2016 for the emergency replacement of an imminently threatened bulkhead.
The property is located adjacent to Bogue Sound at 1700 Salter Path Road in Indian Beach, Carteret
County. This property is developed with condominium units, a docking facility, and two vinyl
bulkheads. The adjacent property to the east used to be a campground and the property to the west is
undeveloped.
The average elevation of the high ground of the parcel is about 8' above the normal high water level
(nhw). There is 1,076' of continuous shoreline along Bogue Sound on this tract of land. Vegetation
on the property mainly consist of palm trees, coastal wetlands, and lawn grasses. Immediate
offshore water depths adjacent to the parcel range from —0.3' to —4' normal low water level (nlw).
The subaqueous substrate is firm with shell. There is submerged aquatic vegetation in the nearby
vicinity of the project area.
There is not a cultural resource in the nearby vicinity of the project area. This waterbody is
approximately 2.3 miles across at this location. These coastal waters are not classified as a Primary
Nursery Area and submerged aquatic vegetation habitat is present at this location. This area is open
to shellfish harvest and is classified as Outstanding Resource Waters (ORW). There is not a defined
Federal Channel in the nearby vicinity of this project area. This project area is within the White Oak
River Basin.
Proposed Development:
The applicant wishes to construct two oyster rock sills and reconfigure the authorized community
docking facility (ref. CAMA Major Permit #108-03) within Bogue Sound, in Indian Beach. The
proposed development will take place at 1700 Salter Path Road, Carteret County. The proposed
development will serve a private community condominium complex.
The applicant wishes to install eight 11' by 28' boatlifts within the existing boat slips of the
community docking facility. There would be four 4' by 30' finger piers to support the eight proposed
boat lifts. This proposed development would take place on the outsides of the eastern and western
platforms. As a part of this proposed reconfiguration, the eastern and western platforms would be
reduced in overall length by more than 50%, or 60', of what was originally authorized.
The applicant wishes to construct two oyster bag sills immediately waterward of mean low water,
approximately 38' waterward of the normal high water level. The sill to the west would be 300' long,
3.5' wide, and 2' tall with 3'-wide openings every 100'. The sill to the east would be 400' long, 3.5'
wide, and 2' tall with 3'-wide openings every 100'. There is no earthen fill or marsh planting being
proposed in conjunction with these sills at this time. The applicant hopes that the area landward of
the proposed sills will become stable and naturalize over time with native Coastal Wetland species.

Anticipated Impacts:
The proposal will not pose a hazard to navigation. The proposed docking facility reconfiguration will
reduce the overall incorporated footprint by approximately 18%. The proposed sills would extend
approximately 38' waterward into Bogue Sound. The proposed sills would fill 3,500 square feet of
shallow bottom habitat, and the proposed docking facility would shade 912 square feet of Public Trust
Waters.
Traditional marine construction methodology will be utilized during the construction of this private
project. Minimal temporary turbidity impacts are anticipated during construction.
There is not a cultural resource in the nearby vicinity of the project area. These waters of Bogue
Sound are not classified as a Primary Nursery Area and the presence of submerged aquatic
vegetation was not observed in the immediate vicinity of the project area, but should not be
impacted by this proposal. This area is open to shellfish harvest and is classified as Outstanding
Resource Waters. There is not a defined Federal Channel near the project area.

Modification on the Bogue Sound
This project consists of various tasks associated with installation of an offshore sill and installation
of pile supported (non floating) main dock with finger piers at end of an existing community pier.
This community pier was permitted along with other features as part of the original development of
the site. '
The original installation of shoreline features and pier at Ocean Club were permitted originally by
Division of Coastal Management with permit DCM 108-03. This permit was modified in on March
29, 2006 to install bulkheads on the Bogue sound shoreline, and a renewal of the permit was issued
on January 9, 2007 to allow completion of the previously permitted bulkhead installation. Due to
deterioration of the bulkhead and erosion of the shoreline, an emergency permit was issued for the
eastern segment of the bulkhead for replacement on (DCM permit number 127-16) December 12,
2016. Lastly, the western segment of the bulkhead (also experiencing deterioration and erosion but
not critical to failure) was permitted (DCM general permit number 69875) on January 6, 2017. This
application is to modify the existing DCM permit 127-16 which is an active permit.
The following items are proposed in this permit
INSTALLATION OF OFFSHORE SILL
To prevent further loss of coastal marsh and for potential expansion of the existing coastal marsh,
sills will be placed along the shoreline. The location of the sills is at approximately the mean low
water line which is just offshore of where the coastal marsh limits were located 5 years ago (2011).
The sills will be constructed with oyster shells placed in mesh tube socks that are stacked to achieve
the desired height and width. This width and height was selected to achieve a desired reduction in
the transmitted wave from the incoming wave.
As noted, the location of the sills is approximately at the mean low water location where mudline
elevation is expected to range from -1 ft to -1.5 ft NAVD88 datum (mean low water is elevation -
1.29 ft NAVD88). Due to variable depth along the sills, the height of the sills can vary with a
maximum and minimum top of sill elevation at +0.84 ft NAVD and +0.5 ft NAVD, respectively.
Thus the maximum top of sill elevation will be no greater than 0.5 ft above mean high water (mean
high water at 0.34 ft NAVD). These range of elevations allows a minimum and maximum height
of the sills to be 1.5 ft and 2.34 ft, respectively. The typical width is expected to be less than 4 feet;
however, a maximum of 6 feet is proposed to allow for unexpected conditions.
Since the mean high water line along the shoreline is not tangent, the distance from mean high water
varies. The average and maximum distances from the shoreline mean high water are:
38 ft and 58 feet, respectively, for the 3 100 feet sill segments on west side of pier; and
66 ft and 100 feet, respectively, for the 4 100 feet sill segments on east side of pier.
No fill will be placed landward of the sills. In the future with expected natural accrR er @EwE D
of the sills, marsh grass may be planted to enhance voluntary expansion of the existing marsh areas

INSTALLATION OF BOAT LIFTS
The original permit for the community pier provided 8 30 feet slips on the outside of two finger piers
(length of finger pier on outside of finger was 120 feet) that were 6 feet wide which was constructed
per the permit. During a storm event, the finger piers were damaged. In rebuilding the pier, the
finger piers were not re -constructed to the permitted length.
Due to available water depths, the installation of eight boat lifts is proposed. While a different
layout is proposed, the proposed square footage of the piers for 8 boat lifts replacing the permitted
8 wet slips is less square footage (shading) than the originally permitted finger piers.
Finger pier and main pier construction will involve the installation of piles and decking. The
approximate number of piles will be 64 for the pier structure and boat lifts.

The following is my assessment and consequent recommendations of the above referenced proposal: This
proposal fills 450 square feet of Public Trust Waters and 945 square feet of Coastal Wetlands. These waters of
Bogue Sound are open to shellfish harvest and classified as Outstanding Resource Waters (ORW). This
waterbody is not a Primary Nursery Area. This proposal will not pose a hazard to navigation. Assuming that
state and federal agencies concur with the proposal, I recommend the project be authorized as proposed,
contingent upon the following conditions:
1) In order to protect juvenile shrimp and finfish populations, no excavation or filling will be permitted
between April 1 and October 31 of any year without the prior approval of the Division of Coastal
Management, in consultation with the Division of Marine Fisheries;
2) Offshore sill sections shall be setback 15 feet from the adjoining property lines and the riparian access
dividing line. The line of division of riparian access shall be established by drawing a line parallel to the
channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point
where the upland property line meets the water's edge. The setback may be waived by written
agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are co -applicants.
Should the adjacent property be sold prior to the commencement of the breakwater, the permittee shall
obtain a written agreement from the new owner waiving the minimum setback and submit it to the
Division of Coastal Management prior to initiating construction of the breakwater;

3) Sills shall be marked at 50 foot intervals with yellow reflectors extending at least three feet above mean
high water;
4) The fill material will be clean and free of any pollutants except in trace quantities. Metal products,
organic materials, or unsightly debris will not be used;

approvals or authorizations that may be required.

Consistency Determination: The request is consistent with/not in conflict with the Town of Indian Beach
Core Land Use Plan certified by the CRC on November 20, 2007.
Overview: The applicant is requesting to construct two (2) oyster rock sills and reconfigure the
authorized private community docking facility adjacent to Bogue Sound at 1700 Salter Path Road, Indian
Beach, Carteret County, North Carolina. The project site has 1,076' of continuous shoreline. Existing site
improvements include: condominiums, two vinyl bulkheads, and a docking facility. Vegetation mainly
consists of palm trees, coastal wetlands, and lawn grasses. Bogue Sound is classified as ORW
(Outstanding Resource Water), is not a Primary Nursery Area (PNA), and is open to the harvesting of
shellfish. There is SAV present in the vicinity of the project area. The subaqueous substrate is firm with
shell. There are no cultural resources in the nearby vicinity of the project area.
Two (2) oyster bag sills are proposed to be installed 38' waterward of normal high water level. The
western sill would be 300' long, 3.5' wide, and 2' tall with 3' wide openings every 100'. The eastern sill
would be 400' long, 3.5' wide, and 2' tall with 3' wide openings every 100'. No earthen fill of march
planning is proposed. Applicant hopes that the area will naturalize over time with native Coastal Wetland
species.
The proposed reconfiguration of the docking facility includes: eight (8) 11' x 28' boatlifts within the
existing boat slips, four (4) 4' x 30' finger piers, and the reduction in length of the eastern and western
platforms by 50% or of 60' it's original size. The proposed development would take place on the outside
of the eastern and western platforms.
Anticipated impacts: The proposed docking facility will not pose a hazard to navigation. The
reconfiguration will reduce the overall incorporated footprint by approximately 18% and extend 38'
waterward into Bogue Sound. The proposed Sill will fill 3,500 ft2 shallow bottom, and the proposed
docking facility would shade 915 ft2 of Public Trust Waters7,239ft2.

Basis for Determination:
The project site is located in Carteret County and is subject to the 2007 Town of Indian Beach Core Land
Use Plan. The Future Land Use Map (FLUM) designates the site as Multi -Family Residential.
The following LUP policies may be applicable to this request:
P.17, pg. 105: "Except as otherwise permitted in this plan, residential, multi-family/mixed use, and
office/institutional development should not be supported in natural heritage areas, conservation areas,
or coastal wetlands. Residential and commercial development which meets 15A NCAC 7H (complies with
state and federal environmental regulations) use standards will be allowed in estuarine shoreline,
estuarine water, and public trust areas".
P.46, pg. 115: The town supports the guidelines of the Coastal Area Management Act the efforts and
programs of the North Carolina Department of Environment and Natural Resources, Division of Coastal
Management, and the Coastal Resources Commission to protect the coastal wetlands, estuarine waters,
estuarine shorelines, and public trust waters of the town.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed
the subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes a series of oyster shell bag sills waterward of the existing bulkhead as well as reconfigure the
community docking facility and install boatlifts in the existing slips. The bagged oyster shell sills are
proposed to be placed just waterward of mean low water which is approximately 38' ahead of normal
high water level. In total 700' of sill that will be approximately 2'tall and 3.5' wide will be placed along
the shoreline. The application describes 3' openings every 100': The currently permitted docking will be
reduced in length and boat lifts are proposed in each slip to prevent boats from resting on bottom at low
tide. There is submerged aquatic vegetation in the area and one bed exists near the docking facility, none
was observed by the DCM field representative in the footprint of the proposed sill.
DCM fisheries does not have objects to the project as proposed but there are some changes recommended
to reduce the potential resource impact of the proposed development. The plan should be modified to
have 5' gaps between the bag sills measured toe -toe. This will allow for passage of fish and other
organisms behind the structure when tide waters allow. Second as this area is mapped SAV habitat and
the depth in the vicinity of the proposed boat slips is -1.3ft at normal low water stops should be placed on
the boat lifts 18" above substrate. In shallow water such as this the potential from prop scour in high at
low water and stops are intended to discourage use at times when this negative impact to habitat is most
likely to occur.

Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act
(48 Stat 401, as amended, 16 U.S.C. 661 et seq.).
The applicant proposes to construct a series of oyster rock sills in front of existing bulkheads, reconfigure
the community docking facility, and install eight boat lifts within existing slips. The Bogue Sound is
classified ORW by the Environmental Management Commission and is open to shellfish harvesting.
The NCWRC has reviewed the permit application and although we do not object to the installation of a
sill, we note inconsistencies within the application as to the design of the stricture. Sills should extend
approximately 1' above NWL and have 5' openings every 100'. The narrative states openings will vary in
size and be as small as 3'. Therefore, we request a design modification to include 5' openings every 100'
as well as a commitment from the applicant to monitor the integrity of the sill and remove any material or
bags that are dislodged from the original footprint.

permit application. I have recently moved into the position of Assistant Major Permits Coordinator and
had a few questions to clear some things up for me and in case any of the commenting agencies asked
the same questions as well.
1. There is mention of different gap sizes between each sill section (3', 5' and one mention of
6'). Is there a gap distance that the applicant prefers as a standard for each opening?
2. There is a typical sill width identified and a potential range as well. Are there locations, (such as
deeper water depths requiring a larger base width to accommodate a higher profile), where this
may be required?
I appreciate the additional information for reference purposes. The 75 day deadline for the application
is 3/27/2017, and we are gathering comments at this point in the process.

NOAA's National Marine Fisheries Service (NMFS) reviewed the public notice for Action ID No. SAW-
2003-00886 dated December 14, 2016. The applicant, Ocean Club Master Association, requests
authorization to construct a vinyl bulkhead to replace a failing wooden bulkhead in waters adjoining
Bogue Sound in Indian Beach, Carteret County. The Wilmington District's initial determination is the
proposed project may affect essential fish habitat (EFH) or associated fisheries managed by South
Atlantic Fishery Management Council (SAFMC), the Mid -Atlantic Fishery Management Council, or
NMFS. As the nation's federal trustee for the conservation and management of marine, estuarine, and
diadromous fishery resources, the NMFS provides the following comments and recommendations
pursuant to the authorities of the Fish and Wildlife Coordination Act and the Magnuson -Stevens Fishery
Conservation and Management Act (Magnuson -Stevens Act).
Description of the Proposed Project
The applicant proposes construction of a vinyl bulkhead as part of a shoreline stabilization project to
replace a wooden bulkhead likely to fail imminently. The new bulkhead structure would be 389 feet long
and 7.5 feet high as measured from the surface of the substrate. The bulkhead would extend an average
of 2.5 feet and up to a maximum of 13 feet waterward of the existing wooden bulkhead. Approximately
50 square feet of riprap is proposed on the exposed western terminus of the vinyl bulkhead to protect this
corner from heavy wave action and strong erosional forces. The eastern end of the bulkhead would tie
back into the property boundary and adjacent bulkhead. The project would impact approximately 450
square feet of shallow bottom habitat and 945 square feet of salt marsh through constructing the bulkhead
and backfilling.
Consultation History
The NMFS reviewed plans for the emergency shoreline stabilization project with the project engineer on
December 21, 2016. The NMFS shared wave energy model predictions for the project area and expressed
concerns regarding long-term shoreline stabilization using a vinyl bulkhead because the site is exposed to
high wave energy. The NMFS participated in a site visit with the property manager to further review
plans and assess shoreline erosion on December 22, 2016.
Essential Fish Habitat
Pursuant to the Magnuson -Stevens Act, the SAFMC designates EFH within the study area to encompass
shallow bottom habitat, intertidal non -vegetated flats, and estuarine emergent wetlands (salt marsh).
Intertidal and subtidal communities along the shoreline provide feeding, resting, and staging habitat for a
variety of commercially, recreationally, and ecologically important fish species. Penaeid shrimp, blue
crab, flounder, Spanish mackerel, cobia, and species among the snapper -grouper complex utilize these
estuarine habitats as nursery, foraging, and refuge areas. The waters within the project area are not
designated by the State of North Carolina as a Primary Nursery Area (PNA); however, this area provides
important nursery services. Based on available aerial imagery, GIS data, and field observation,
submerged aquatic vegetation (SAV) has not been mapped in the project area and most likely is not
present due to the high energy of the system.
Impacts to Essential Fish Habitat
Bulkheads protect the shoreline by absorbing and reflecting wave energy. They are commonly used for
shoreline protection in Carteret County (63.5 miles of bulkhead) and throughout coastal North Carolina
(497 miles of bulkhead) 1. Shoreline stabilization techniques do not need to create a barrier between land
and water. New "soft" stabilization options, like vegetative plantings and living shorelines, are viable
alternatives to bulkheads and seawalls. In many cases where bulkheads are used, erosion rates increase
waterward of the structure and along adjacent areas resulting in increased construction and maintenance
activities for shoreline protection and leading to a cumulative environmental impact on fisheries, habitat,
and the shoreline hydrology.
Bulkheads can cause deepening of adjacent shallow subtidal waters via wave refraction and scour,
resulting in loss of salt marsh habitat. With rising sea levels, bulkheads prevent the landward retreat of
salt marsh vegetation. Bulkheads are generally associated with reduced abundances of upland coastal
marsh plant species, fish, crustaceans, and benthic infauna3,',5. Bulkheads abruptly disconnect upland and
coastal marsh habitats preventing an integrated vegetation buffer resulting in a loss of ecosystem services,
especially nutrient and pollutant filtration. Bulkheads prevent wildlife from traversing between aquatic
and terrestrial habitats. Bulkheads can reduce surface water and groundwater storage capacity by creating
an impermeable surface that prevents water exchange. The net result is a disruption of biogeochemical
cycling in the soil, which helps maintain benthic communities within salt marsh habitats.
The NMFS recognizes this application is an urgent request to protect homes and associated infrastructure
from severe shoreline erosion exacerbated by Hurricane Matthew. The NMFS believes the applicant
working with state and federal agencies has conducted a practicable alternatives analysis and has avoided
and minimized environmental impacts. The NMFS recommends further minimization of the
environmental impacts from construction by the permit requiring best management practices to reduce
impacts to emergent salt marsh vegetation, oyster reefs, and shell bottom. For long-term shoreline
stabilization, the applicant should consider installation of a living shoreline thereby diminishing long-term

impacts to remaining salt marsh vegetation. NOAA provides additional information in the publication

EFH Conservation Recommendation
Section 305(b)(4)(A) of the Magnuson -Stevens Act requires NMFS to provide EFH Conservation
Recommendations for any federal action or permit which may result in adverse impacts to EFH.
Therefore, NMFS recommends the following to ensure the conservation of EFH and associated fishery
resources:
• The permit should require best management practices, such as field marking salt marsh
vegetation, oyster reefs, and shell bottom, to keep construction equipment and activities from
encroaching into these habitats.
Section 305(b)(4)(B) of the Magnuson -Stevens Act and implementing regulation at 50 CFR Section
600.920(k) require the Wilmington District to provide a written response to this letter within 30 days of
its receipt. If it is not possible to provide a substantive response within 30 days, in accordance with the
"findings" with the Wilmington District, an interim response should be provided to the NMFS. A
detailed response then must be provided prior to final approval of the action. The detailed response must
include a description of measures proposed by the Wilmington District to avoid, mitigate, or offset the
adverse impacts of the activity. If the response is inconsistent with the EFH conservation
recommendations, the Wilmington District must provide a substantive discussion justifying the reasons
for not following the recommendations.

impact 0.08 acres (3,500 square feet) of shallow bottom open water and 0.02 acres (912 square
feet) of open water to construct approximately 700 linear feet of an oyster sill waterward of a new
vinyl bulkhead, and reconfiguration of an existing community docking facility within Bogue
Sound as described within your application received by the Division on January 17, 2017. After
reviewing your application, we have decided that the impacts are covered by General Water
Quality Certification Number 3900 (GC 3900).
You should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your pre j ect including (but not limited to) Erosion and Sediment Control,
Non -discharge, and stormwater regulations. Also, this approval to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration
of the 404 Permit. This Certification can also be found on line at:

change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must be
given a copy of this approval letter and General Certification and is responsible for complying
with all conditions. Any new owner must notify the Division and request the Certification be
issued in their name {I5A NCAC 02H .0501 and .0502).
Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.

contractors (and/or agents) to comply with all of the terms of this Certification, and shall
provide each of its contractors (and/or agents) a copy of this Certification.
Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be
exceeded as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion
control practices must be used to meet this standard. Turbidity curtains shall be used as
appropriate. Please notify this Office if any turbidity issues arise at 910.796.7215
This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project,
regardless of the expiration of this Certification.
5 The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [I5A

6 Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a
manner consistent with State water quality standards (including any requirements
resulting from compliance with 303(d) of the Clean Water Act), and any other
appropriate requirements of State and Federal law. If the Division determines that such
standards or laws are not being met, including failure to sustain a designated or achieved
use, or that State or Federal law is being violated, or that further conditions are necessary
to assure compliance, than the Division may reevaluate and modify this General Water

7 All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands :from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington
Regional Office at 910.796.7215 and after hours and on weekends call lsoof 858-0368.
Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3),'15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC

This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
10 Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications; the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division, of Water Resources,1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:

wetlands provided that the applicantcan.provide documentation showing the
histodo dimensions of the dredged channel, and no Submerged Aquatic Vegetation
or shellfish beds are excavated or filled;
v. Projects; that involve only shading of waters or wetlands;
vi. Utility lines, except wastewater lines and potable water discharge lines which are
subject to an NPDES Permit, as long as wetland or water Impacts are temporary;
vii. Upland developmentwhich involves no more than 1110 of an acre of excavation or
filling of -non coastal wetlands, with the exception than no more than 2,000 square
feet of the non -coastal excavation or.filling may take place Within, a Coastal
Shoreline Areaof Environmental Concern (AEC). For the purposes of this area
calculation, the excavation or filling Impacts of the entire project.must be
considered, which may include boat ramps;. bulkheads or other shoreline .

viii. Single family home construction that results in fill of 404 wetlands as long as
written concurrence is not required from DWQ for the applicable Corps of
Engineers Nationwide Permit; or
b) Any stream relocation; or
c) Any impact associated with a Notice of Violation or an enforcement action for violation(s)
of DWQ Wetland Rules (15A NCAC 02H..0500), Isolated Wetland Rules (15A NCAC 02H
.1300), DWQ Surface Water or Wetland Standards, or Riparian Buffer Rules (15A NCAC
02B .0200); or
d) Any impacts to streams and/or buffers in the Neuse or Tar -Pamlico River Basins (or any
other basin or watershed with Riparian Area Protection Rules (Buffer Rules) in effect at
the time of application) unless the activities are listed as "EXEMPT" from. these rules or a
Buffer Authorization Certificate is issued through N.C. Division of Coastal Management
(DCM) delegation for "ALLOWABLE" activities.
In accordance with North Carolina General Statute 143-215.3D(e), written approval for a 401
Water Quality General Certification must include the appropriate fee. If a project also requires a
LAMA Permit, then one payment to both'agencies shall be submitted and will be the higher of the
two fees.
Activities Included In this General Certification that do not meet one of the thresholds
listed above do not require written approval from the. Division as long as they comply with
the Conditions of Certification listed below. Activities authorized by Coastal Area
Management Act (LAMA) General Permits do not require written approval from the
Divislon as long as they comply with the Conditions of Certification listed below. If any of
these Conditions cannot be met, then written approval from the Division is required.
Conditions of Certification:
1. No Impacts Beyond those Authorized in the Written Approval or Beyond the Threshold of Use
of this Certification
- No waste, spoil, solids; or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond th87ootpririf'oftfie iinpacts'depicfed'in'the'Pre-Construdtion'Notificatlon;"as
authorized in the written approval from the Division or beyond the thresholds established for
use of this Certification without written authorization, including incidental impacts. All
construction activities, Including the design, Installation, operation, and maintenance of
sediment and erosion control Best Management Practices shall be performed so that.no
Violations of state water quality standards, statutes, or rules occur. Approved plans and
specifications for this project are incorporated by reference and are enforceable parts of this
permit.
2. Standard Erosion and Sediment Control Practices.
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices and if applicable, comply with the specific conditions and
requirements of the NPDES Construction Stormwater Permit issued to the site:
a). Design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal or exceed the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
Including contractor -owned or leased borrow pits associated with the project.

b) For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina. Surface Mining Manual,
c) Reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act and the
Mining Act of 1971.
d) Sufficient materials required for stabilization and./or repair of erosion control measures
and stormwater routing and treatment shall be on site at all times.
e) If the project occurs in waters or watersheds classified as Primary Nursery Areas (PNAs),
SA, WS-I, WS-II, High Quality (HQW), or Outstanding Resource (ORW) waters, then the
sedimentation and erosion control designs must comply with the requirements set forth
in 15A NCAC 04B .0124, Design Standards in Sensitive Watersheds.
3. No Sediment and Erosion Control Measures in Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters.
Exceptions to this condition require application submittal to and written approval by the
Division. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, then design and placement of temporary erosion control measures shall not be
conducted in -a manner that may result in dis-equilibrium of wetlands, stream beds, or banks,
adjacent to or upstream and downstream of the above structures. All sediment and erosion
control devices shall be removed and the natural grade restored within two (2) months of the
date that the Division of Land Resources (DLR) or locally delegated program has released
the specific area within the project.
4. Construction Stormwater Permit N,CG.010000
An NPDES Construction Stormwater Permit Is required for. construction projects that disturb
one (1) or more acres of land. This Permit allows. stormwater to be discharged during land
disturbing construction activities as stipulated in the conditions of the. permit. If your project
is.covered 6yJhis. pertnit, full compliance with,.pefmitconditions including the erosion &
sedimentation control plan, inspections and maintenance, self -monitoring, record keeping
and reporting requirements is required. A copy of the general permit (NCG010000),
inspection log sheets, and other information may be found at

The North Carolina Department of Transportation (NCDOT) shalt be required to be.in full
compliance with the conditions related to construction activities within the most recent version
of their individual NPDES (NCS000250) stormwater permiL
5. Construction Moratoriums and Coordination
if activities must occur during periods of high biological activity (i.e. sea turtle nesting, fish
spawning, or bird nesting), then biological monitoring may be required at the request of other
state or federal agencies and coordinated with these. activities.
All moratoriums on construction activities established by the NC Wildlife Resources
Commission (WRC), US Fish and Wildlife Service (USFWS), NC Division of Marine Fisheries
(DMF), or National Marine Fisheries Service (NMFS) to lessen impacts on trout, anadromous
fish, larvallpost-larval fishes and crustaceans, or other aquatic species of concern shall be
implemented. Exceptions to this condition require written approval by the resouroe.agency
responsible for the given moratorium.

Work within the twenty-five (25) designated trout counties or identified state or federal
endangered or threatened species habitat shall be coordinated with the appropriate WRC, -
USFWS, NMFS, and/or DMF personnel.
6. Dredging shall not cause Shellfish Closures
The effluent water from the dredge spoil should not be released into open shellfish waters.
Shellfish Sanitation and the Division of Water Quality must be notified if this is to occur.
7. Work in the Dry
All work in or adjacent to stream waters shall be conducted so that the flowing stream does
not come in contact with the disturbed area. Approved best management practices from the
most current version of the NC Sediment and Erosion Control Manual, or the NC DOT
Construction and Maintenance Activities Manual, such as sandbags, rock berms, cofferdams,
and other diversion structures shall be used to minimize excavation in Flowing water.
Exceptions to this condition require application submittal to and written approval by the
Division.
8. Riparian Area Protection (Buffer) Rules
Activities located in the protected riparlan areas (whether jurisdictional wetlands or not),
within the Neuse, Tar -Pamlico, or Catawba River Basins or in the Randleman, Jordan, or
Goose Creek Watersheds (or any other basin or watershed with buffer rules) shall be limited
to "uses" identified within and constructed in accordance with 15A NCAC 02B ,0233, .0259,
.0243, .0250, .0267 and .0605r and shall be located, designed, constructed, and maintained
to have minimal disturbance to protect water quality to the maximum extent practicable
through the use of best management practices. All buffer rule requirements, including diffuse
flow requirements, must be met. I
9. If concrete is used during the construction, then all necessary measures shall be taken to
prevent direct contact between uncured or curing concrete and waters of the state. Water
that inadvertently contacts uncured concrete shall not be discharged to waters of the state
due to the potential for elevated pH and possible aquatic fifel fish kills.
10. Compensatory Mitigation
In accordance with 16A NCAC 02H .0506 (h), compensatory mitigation may be required for
losses of equal to or greater than 150 linear feet of streams (intermittent and perennial)
and/or equal to or greater than one (1) acre of wetlands. For linear public transportation
projects, impacts equal to or exceeding 150 linear feet per stream shall require mitigation.
Buffer mitigation may be required for any project with Buffer Rules in effect at the time of
application for activities classified as "Allowable with Mitigation" or "Prohibited" within the
Table of Uses.
A determination of buffer, wetland, and stream mitigation requirements shall be made for any
General Water Quality .Certification for this Nationwide and/or Regional General Permit.
Design and monitoring protocols shall follow the US Army Corps of Engineers Wilmington
District Stream Mitigation Guidelines (April 2003)'or its subsequent updates. Compensatory
mitigation plans shall be submitted to the Division for written approval as required in those
protocols. The mitigation plan must be implemented and/or constructed before any impacts '
occur on site. Alternatively, the Division will accept payment into an in -lieu fee program or a
mitigation bank. In these cases, proof of payment shall be provided to the Division before
any Impacts occur on site.

11. Placement of Culverts and Other Structures in Waters and Wetlands
Culverts required for this project shall be designed and Installed in such a manner that the
original stream profiles are not altered and allow for aquatic life movement during low flows.
Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal
profile) must be maintained above and below locations of each culvert.
Placement of culverts and other structures in waters and streams must be below the
elevation of the streambed by one foot for all culverts with a. diameter greater than 48 inches,
and 20 percent of the culvert diameter for culverts having a diameter less than or equal to 48
inches, to allow low flow passage of water and aquatic life:
When topographic constraints indicate culvert slopes of greater than 5%, culvert burial is not
required, provided that all alternative options for flattening the slope have been investigated
and aquatic life movement/ connectivity has been provided when possible (rock ladders,
crossvanes, etc). Notification to the Division including supporting documentation to include a
location map of the culvert, culvert profile drawings, and slope calculations shall be provided
to the Division 60 days prior to the installation of the culvert.
When bedrock is present in culvert locations, culvert burial is not required provided that there
is sufficient documentation of the presence of bedrock. Notification to the Division including
supporting documentation such as, but not limited to,:a location map of the culvert,
geotechnical reports, photographs, etc shall be provided to the Division a minimum of 60
days prior to the installation of the culvert. if bedrock is discovered during construction, then
the Division shall be notified by phone or email within 24 hours of discovery.
If other site -specific topographic constraints preclude the ability to bury the culverts as
described above andlor it can be demonstrated that burying the culvert would result in
destabilization of the channel, then exceptions to this condition require application submittal
to, and written approval by, the Division of Water Quality, regardless of the total impacts to
streams or wetlands from the project
Installation of culverts in wetlands must ensure continuity of water movement and be
designed to adequately accommodate high water or flood conditions. Additionally, when
roatlways, causeways, or otFier'fill"projects are constructed actors FEMA=designated`
floodways or wetlands, openings such as culverts or bridges must be provided to maintain
the natural hydrology of the system as well as prevent constriction of the floodway that may
result in destabilization of streams or wetlands.
The establishment of native, woody vegetation and other soft stream bank stabilization
techniques must be used where practicable instead of riprep or other bank hardening
methods.
12. All temporary fill and culverts shall be removed and the impacted area returned to natural
conditions within 60 days of the determination that the temporary impact is no longer
necessary. The impacted areas shall be restored to original grade, including each stream's
original cross sectional dimensions, plan form pattern, and longitudinal tied and bed profile,
and the various sites shall be stabilized with natural woody vegetation (except for the
approved maintenance areas) and restored to prevent erosion.
13. All temporary pipes/ culverts/ rprap pads etc, shall be installed in all streams as outlined .in
the most recent edition of the North Carolina Sediment and Erosion Control Planning and
Design Manual or the North Carolina Surface Mining Manual so as not to restrict stream flow
or cause dis-equilibrium during use of this General Certification.

14. Any riprap required for properculvert placement, stream stabilization, or restoration of
temporarily disturbed areas shall be restricted to the area directlyimpacted by the approved
construction activity. All rip -rap shall buried and/or "keyed in" such that the original stream
elevation and streambank contours are restored and maintained. Placement of rip -rap or
other approved materials shall not result in de -stabilization of the stream bed or banks
upstream or downstream of the area.
15. Any rip -rap used for stream stabilization shall be of a size and density so as not to be able to
be carried off by wave, current action, or stream flows and consist of clean rock or masonry
material free of debris or toxic pollutants. Rip -rap shall not.be installed in the streambed.
except in specific areas required fo'r velocity control and to ensure structural Integrity of bank
stabilization measures.
15. If this Water Quality Certification is used to access building sites, then all lots owned by the
applicant must be buildable without additional impacts to streams or wetlands. The applicant
is required to provide evidence that the lots are buildable without requiring additional impacts
to wetlands, waters, or buffers if required to do so in writing by the Division. For road
construction purposes, this Certification shall only be utilized from natural high ground to
natural high ground.
17. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional
wetlands, waters, and protective buffers within the project boundaries in order to assure
compliance for future wetland, water, and buffer impact. These mechanisms shall be put in
place at the time of recording of the property or of individual lots, whichever is appropriate. A
sample deed notification can be downloaded from the Division's web site at
http://portal ncdenr omlweblwalswoiws/401/certsandpermitslapgA forms. The text of the
sample deed notification. be modified as appropriate to suit to a specific project..
Documentation of deed notifications shall be provided to the Division upon request.
1 B. If an environmental document Is required under the National or State Environmental Policy
Act (NEPA orSEPA), then this General Certification is not valid until a Finding of No
Significant Impact (FONSI) or Record of Decision (ROD) is Issued by the State
Clearinghouse.
19. In the twenty (20) cbastal counfies;lhe appropriate DWQ Regional Office mustbe Contacted
to determine if Coastal Stormwater Regulations will be required.
20. This General Certification does not relieve the applicant of the responsibility to obtain all other
required Federal, State, or Local approvals.
21, The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (Including any requirements resulting from
compliance with §303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal Law. If the Division determines that such standards or laws are not being
met, Including failure to sustain a designated or achieved iise,.or that State or Federal law is
being violated, or that further conditions are necessary to assure compliance, then the
Division may reevaluate and modify this General Water Qualify Certification.
22. When written authorization Is required for use of this certification, upon completion of all
permitted impacts Included within the approval and any subsequent modifications, the
applicant shall be required to return the certificate of completion attached to the approval.
One copy of the certificate shall be sent to the DWQ Central Office in Raleigh at 1650 Mail
Service Center, Raleigh, NC, 27699-1650.
23. Additional site -specific conditions, Including monitoring and/or modeling requirements, may
be added to the written approval letter for projects proposed under this Water Quality

Certification in order to ensure compliance with all applicable water quality and effluent
standards.
24. This certification grants permission to the director, an authorized representative of the
Director, or DENR staff, upon the presentation of proper credentials, to enter the property
during normal business hours.
This General Certification shall expire on the same day as the expiration date of the
corresponding Nationwide and/or Regional General Permit. The conditions in effect on the date
of issuance of Certification for a specific project shall remain in effect for the life of the project,
regardless of the expiration date of this Certification.
Non-compliance with or violation of the conditions herein set forth by a specific project may result
in revocation of this General Certification for the project and may also result in criminal and/or civil
penalties.
The Director of the North Carolina Division of Water Quality may require submission of a formal
application for Individual Certification for any project in this category of activity If it is determined
that the project is likely to have a significant adverse effect upon water quality, including state or
federally listed endangered or threatened aquatic species, or degrade the waters so that existing
uses of the wetland or downstream waters are precluded.
Public hearings may be held for specific applications or group of applications prior to a
Certification decision if deemed in the public's best interest by the Director of the North Carolina
Division of Water Quality.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of The Ocean Club Master Association Inc's property located
adjacent to Bogue.Sound at 1700 Salter Path Road in Indian Beach, Carteret County. It was
received on January 11, 2017, and appears to be adequate for processing at this time. The
projected deadline for making a decision is March 28, 2017. An additional 75-day review period
is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from January 11, 2017, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice at
a conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-
of-way fronting your property, or at a point along the road right-of-way where a private road
would lead one into your property. Failure to post this notice could result in an incomplete
application.

This project consists of various tasks associated with installation of an offshore sill and existing pier
modification with installation of pile supported (non floating) main dock with finger piers at end of
pier. The following items are proposed in this permit
The location of the sills is at approximately the mean low water line which is just offshore of where
the coastal marsh limits were located 5 years ago. The sills will be constructed with oyster shells
placed in mesh tube socks that are stacked to achieve the desired height and width
The installation of eight boat lifts is proposed. The pier was previously permitted for 8 slips and
the pier sections were washed away in a storm. The proposed layout provides the same 8 slips via
boat lifts with less square footage of pier surface area than originally permitted.
WAIVER SECTION

must be set back a minimum distance of 15' from my area of riparian access unless waived by

their original permit to install offshore sills and modification of existing pier at 1700 Salter Path
Road, Indian Beach NC in Carteret County. The specifics of the proposed work are in the attached
correspondence and drawings that are included with this letter.
As the adjacent riparian property owner to the aforementioned project, I am required to notify you
of the development in order to give you the opportunity to comment on the project and request that
you complete the attached "Adjacent Riparian Property Owner Statement". Please review the
attached permit drawings.
Should you have any objections to this proposal, please send your written comments to Roy
Brownlow, District Manager, Morehead City Regional Office, 400 Commerce Avenue, Morehead

On January 17, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources
received a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and
specifications on January 20, 2017 has determined that the development activities proposed at this time will not pose
a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed
and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the
stormwater management permitting requirements of 15A NCAC 211.1000, the stormwater rules. By copy of this letter,
we are informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization

Modification on the Bogue Sound
This project consists of various tasks associated with installation of an offshore sill and installation
of pile supported (non floating) main dock with finger piers at end of an existing community pier.
The following items are proposed in this permit
INSTALLATION OF OFFSHORE SILL
To prevent further loss of coastal marsh and for potential expansion of the existing coastal marsh
along the shoreline, sills will be placed shoreline. The location of the sills is at approximately the
mean low water line which is just offshore of where the coastal marsh limits were located 5 years
ago.
The sills will be constructed with oyster shells placed in mesh tube socks that are stacked to achieve
the desired height and width. Thiswidth and height was selected to achieve a desired reduction in
the transmitted wave from the incoming wave.
INSTALLATION OF BOAT LIFTS
The original permit for the community pier provided 8 30 feet slips on the outside of two finger piers
(length of finger pier on outside of finger was 120 feet) that were 6 feet wide which was constructed
per the permit. During a storm event, the finger piers were damaged. In rebuilding the pier, the
finger piers were not re -constructed to the permitted length.
Due to available water depths, the installation of eight boat lifts is proposed. While a different
layout is proposed, the proposed square footage of the piers for 8 boat lifts replacing the permitted
8 wet slips is less than the permitted finger piers.
