This is with reference to your request received on December 01, 2016 to modify State Permit #67-
16 on behalf of Nicholas Foy Nixon III and Catherine Elizabeth Connell, for their property at 115 and 125
Hollis Lane, Wilmington. State Permit #67-16 was issued to you on October 4, 2016 via a variance through
the Coastal Resources Commission (CRC-VR-16-06) authorizing a new residential dwelling, driveway,
and private docking facility within Masonboro Sound. State Permit #67-16 is due to expire on December
31, 2019.
The action proposed in your submittal is to allow for the modification of the original docking
facility alignment that followed parallel to the property lines, to be realigned so that it is perpendicular to
the riparian corridor, without any modification to the dock components. The proposed modifications are
shown on a survey provided by Patrick C. Bristow Land Surveying, PC, dated November 29, 2016.
Upon reviewing the information provided, the Division of Coastal Management has determined
that the proposed action is consistent with existing State rules and regulations and is in keeping with the
original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State
Permit #67-16 as described in your letter dated December 01, 2016, and plans dated November 29, 2016.
Please note this refinement does not alleviate the need to obtain any other local, state or federal permits.

Dear Sir/ Mam:
It is our understanding that the permit application for Nick Nixon's proposed pier at 115 and 125
Hollis Lane was submitted inadvertently with the pier parallel to the property line instead of
perpendicular to the riparian corridor. This is to confirm that we have no objection to the pier being
rotated to be perpendicular to the riparian corridor or parallel with our adjacent pier, in fact, we would
prefer the pier be aligned with the adjacent piers.
Please let us know if we can be of further assistance in this matter.

RE: Nick Nixon Dock Alignment
To Whom it May Concern:
I am the owner of the land and the dock that is adjacent to Mr. Nixon's planned dock
directly to the south. Mr. Nixon has indicated that his permitted plans as they stand
would result in his dock being in line with his house but not in line with the adjacent
docks. He has also informed me that he is exploring the possibility of adjusting the
location of the dock slightly so that it will be in line with the docks on both sides of him.
Although we are fine with it either way, we support Nick's proposed changes and
believe that the alignment of the docks will enhance the overall aesthetics of our coastal
community.
If needed, consider this our agreement with the proposed change and if you need to

We had a modification request to change the orientation of the proposed dock at 115 Hollis Ln., Wilmington, to better
match the neighbors dock orientation. It is a slight re -angling of the pier which requires no new structures and reduces
the facility's width across the waterbody (See attached site plan). DCM Staff and I have reviewed the modification
information submitted by Mr. Nixon, and Staff concluded that the change was a smaller distance across the waterbody
than that approved through the variance, that the change is de minimis in nature, that Staff believe no further action is
needed by the Commission on authorizing this change, and that Staff plans to make the permit modification. Please
review the attached Letter of Refinement and plans and let me know if you have any comments regarding the new
alignment.
