This permit, issued on March 29, 2021 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this Minor Modification authorizes reconfiguration of the marina,
all as expressly and specifically set forth in the attached letter and workplan drawing. Any additional
development activities may require a modification of this permit.
2) This permit authorizes the reduction of formalized boat slips for a maximum of 40 formalized boat
slips at this manna.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
4) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
General
5) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
6) This Minor Modification shall be attached to the original Permit No. 102-16, which was issued on
10/19/16, as well as all subsequent modifications, refinements, and renewals, and copies of all
documents must be readily available on site when Division personnel inspect the project for compliance.
7) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2006-101716.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 05-1169 v4.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

On behalf of New Bern River Station TTMAM, I would like to request a Minor Modification to Permit
Number 102-16 for reconfiguration of the marina. The reconfiguration remains within the permitted
extents of the marina and is a reduction of structure square footage, total number of slips and shading
impacts. Specifically, the permitted 53 slips have been reduced to 40 permanent and 6 temporary tie-
up/day slips. Permitted structures and shading totaling 11,933 s.f. has been reduced to 8,671 s.f. As
mentioned, the proposed reconfiguration remains within the extents of the permitted marina and
increases the distance of the marina from both riparian lines and the USACE channel setback. Please find
enclosed a figure showing both the proposed reconfiguration and permitted marina for reference. Also
find enclosed the $100 Minor Modification fee and adjacent notifications with certified mailing receipts.

Please find correspondence enclosed dated March 10, 2021 from Mr. Andy Dortch with
Land Management Group requesting a permit modification. State Permit #106-16 was
issued for marina construction adjacent to 227 East Front Street within the Neuse River,
Craven County. The permit expires on December 31, 2021.
The request by the permittee is to modify the size and configuration of the authorized
marina facility. This reconfiguration would remain within the existing footprint of the
previously authorized marina facility. The proposal would reduce the overall square
footage and reduce the total number of formalized boat slips.
The Morehead City District staff would recommend approval of the proposed
reconfiguration. A processing fee of $100 (check # 2036) has been received in order to
process the request.

Marina Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this marina facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification. .
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina facility. Any sewage discharge at the marina facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

3) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no in
water work shall be permitted between February 15 and June 30 of any year without the prior approval
of the Division of Coastal Management, in consultation with appropriate resource agencies.
4) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit authorizes a maximum of fifty-three (53) formalized boat slips.
7) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal
facility shall be installed in an easily accessible location and maintained in operable condition for the life
of the marina.
8) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on -site with a
representative of the Division to ensure that the required pumpout facility is in place and operable.
9) The marina shall display a sign showing the location of the on -site pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from the main pier(s).
10) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
11) The roof of the covered platform shall not be designed for second story use.
12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Wave Attenuators
13) The wave attenuators shall have staggered sections in accordance with the design indicated on the
attached workplan drawings.
14) The permitted wave attenuators shall be constructed of treated wood, plastic lumber, metal or vinyl sheet
piles or other suitable materials approved by De�artt eft rgoppel,.

Easement
15) An Easement from the Department of Administration's State Property Office may be required under
N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of
construction of any structures over state-owned submerged lands to determine if such an easement will
be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal
Management, prior to the construction of any new boat slips or other docking facilities authorized tinder
this permit.
Cultural Resource Protection
16) The project site is located in an area having a probability of containing cultural resources, such as
shipwreck remains. The permittee shall exercise all precautions to avoid damage to any potential historic
structures or shipwrecks. If such materials are encountered, the permittee shall immediately stop work
and notify the NC Underwater Archaeology Unit at 910-458-9042.
General
17) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
19) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
20) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
21) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.

Street and Queen Street in New Bern, NC. The applicant, New Bern River Station TTMAM, LLC, proposes the reduction of
the permitted 53 slips to 40 permanent and 6 temporary tie-up/day slips as depicted in the attached drawing.
