This letter of refinement is about the 05/11/2020 correspondence from Andy Dortch of Land Management
Group, requesting a modification of Major CAMA Permit No. 102-16 issued to New Bern River Station
TTMAM, LLC on 10/19/2016 and renewed on 01/29/2020. Permit No. 102-16 authorizes a 53-slip marina
docking facility on property located at East Front Street on the Neuse River in New Bern, Craven County,
North Carolina.
Your request to install 48 boat lifts within the authorized boat slips is hereby authorized. No other slips or
expansions are authorized. Any other reconfiguration or changes will require a review by the Division of
Coastal Management before commencing work. All permit conditions including the 12/31/2021 expiration
date still apply and remain unchanged. Please append this letter to the permit file to document authorization
to proceed with this proposal.

Major Permit Number 102-16. Modification to the permit involves the addition of 48 boat lifts within the
existing permitted boat slips (53 total) as depicted in the attached drawings.
Enclosed is a drawing detailing the modification items and the $100 modification fee. The adjacent
riparian landowners have been notified and the green confirmation cards will be submitted once received.

This permit action may be appealed by the permittee or

This permit, issued on October 19, 2016 , is subject to compliance with the application (where consistent

Marina Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this marina facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina facility. Any sewage discharge at the marina facility shall be considered a violation of this
permit for which the permittee is responsible.'This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

ADDITIONAL CONDITIONS
3) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no in
water work shall be permitted between February 15 and June 30 of any year without the prior approval
of the Division of Coastal Management, in consultation with appropriate resource agencies.
4) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum'of three feet over the wetland substrate as
measured from the bottom of the decking.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit authorizes a maximum of fifty-three (53) formalized boat slips.
7) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal
facility shall be installed in an easily accessible location and maintained in operable condition for the life
of the marina.
8) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on -site with a
representative of the Division to ensure that the required pumpout facility is in place and operable.
9) The marina shall display a sign showing the location of the on -site pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from the main pier(s).
10) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
11) The roof of the covered platform shall not be designed for second story use.
12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Wave Attenuators
13) The wave attenuators shall have staggered sections in accordance with the design indicated on the
attached workplan drawings.
14) The permitted wave attenuators shall be constructed of treated wood, plastic lumber, metal or vinyl sheet
piles or other suitable materials approved by Department personnel.

ADDITIONAL CONDITIONS
Easement
15) An Easement from the Department of Administration's State Property Office may be required under
N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of
construction of any structures over state-owned submerged lands to determine if such an easement will
be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal
Management, prior to the construction of any new boat slips or other docking facilities authorized under
this permit.
Cultural Resource Protection
16) The project site is located in an area having a probability of containing cultural resources, such as
shipwreck remains. The permittee shall exercise all precautions to avoid damage to any potential historic
structures or shipwrecks. If such materials are encountered, the permittee shall immediately stop work
and notify the NC Underwater Archaeology Unit at 910-458-9042.
General
}
c 17) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
19) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
20) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
21) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination.
z NOTE: The permittee is advised that any development or land disturbing activity that is considered non -
water dependent is not authorized within 50 feet of the normal water level unless specifically
t. exempted by Environmental Management Commission (EMC) Neuse River buffer regulations in
g place at the time of such development.
