Based on the guidance from DMF (see below), the request to drive piles within the in -water work moratorium has been
denied. Work cannot proceed within the conditioned moratorium and must take place outside of Feb 15-Jun 30 of any
year.

DMF has reviewed this request to begin in -water work (pile driving) for New Bern River Station marina project. An in -
water work moratorium from Feb 15-Jun 30 was a condition of the permit to reduce negative effects on critical
anadromous fish activities, including spawning migrations and nursery functions. Extensions to work into the
moratorium are at times allowed if the project is almost done, or very minimal work. Because this project has not begun
and is only requesting to conduct a portion of the project (64 of 256 pilings), DMF requests that in -water work begin
after June 30.

Please see below. I'll just use this as the official request for moratorium relief since LMG CC'd Anne on the response to
the questions I was asking in prep. Looks like New Bern River Station (#102-16) is requesting to vibrate in 62 pilings (see
below) within the AFSA moratorium and have asked for relief till April V (See attachment).
Kindly provide your comments on the request asap.

The entire structure will eventually require 256 pilings. The applicant is requesting authorization to install 62 pilings
(vibrated in).
Anne, I believe this and the materials submitted with the request answer all of the relevant questions in the Relief
Request since most of those refer to dredging.

Brad,
On behalf of New Bern River Station TTMAM, LLC, I would like to request an extension for in water work
to occur beyond the February 15 moratorium.
The applicant has made all reasonable efforts to secure a contractor in a timely manner that would allow
for work to be completed prior to February 15, however, in addition to needing a permit extension due
to extenuating circumstances, the/a contactor was not available to begin work until mid -March. The
proposed work to be completed is construction of the landward most portion of the docking facility and
the access pier. The applicant is only requesting enough time to complete a portion of the docking facility
and estimates that the piling work can be completed in 14 days.
As a reminder to the project history that led to the current circumstances, I've attached the permit
extension request. Considering the limited scope, work limited to the landward most portion of the
docking facility and minimal encroachment into the window, I cordially request this in water work
extension through from March 20, 2020 to April 3.
