Mr. Johnson received a Letter of Refinement ion December 8, 2004 for the reduction of platform area of his authorized structures. The Permit has since been modified on November 5, 2005 to add a freestanding wall along the basin and was renewed for maintenance excavation on February 21, 2007. The Permit was again modified on March 19, 2007 for the installation of floating boatlifts within the existing slips. CAMA Major Permit #64-03 will expire on December 31, 2011. The original permit authorized basin excavation, shoreline stabilization, a boat ramp, docking facility, and a future residence. C Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the changes to the footprint and impervious area associated with the upland development as described by your letter and drawing received on September 15, 2009. The changes to the upland development have been approved under a plan revision by The Division of Water Quality; letter dated September 25, 2009. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits. Enclosed you will find check #738, made payable to DENR, in the amount of $100 which was submitted with your request. I am returning this check, there is no processing fee associated with this Letter of Refinement. If you have any questions concerning the above or if I can be of any other assistance, please advise. Request for Minor modification to existing CAMA permit 64-03 and a plan revision for Stormwater Project No. SW8 030128 Dear Holly, Please allow this letter to serve as a request for a minor modification to permit 64- 03 and a plan revision for Stormwater Project No. SW8 030128. Both in the name of Richard and Carole Johnson. At the time of receiving the original Stormwater & CAMA permits, one of the additional conditions for the CAMA permit is that we would need to seek a modification for any upland building. At this time we would like to seek a modification to our original permit for the construction of a single-family home, a pool and the supporting driveway. Enclosed you will find four copies of the site plan. The total proposed impervious surface is approximately 20,030 square feet or 10.9% on the lot whose address is 7601 Masonboro Sound Road. The size of the lot is 4.2 acres or 182,952 square feet. The reason for a Stormwater plan revision is that the total impervious surface allowed for in our original permit was based on the combined acreage of both 7601 & 7609 Masonboro Sound Road. Recently we combined portions of the two properties making 7601 a larger lot so we could build a house that would not straddle two lots. In the process we kept .98 acres in 7609 Masonboro Sound Road for a future guest cottage. This change leaves 7601 Masonboro Sound Road at 4.2 acres instead of the original 5.2 that was planned. Because of this change we are requesting a plan revision from the Division of Water Quality to reflect the new size of the lot we would like to build on. Additionally we would like to request that the revision also address the impervious area that can be built upon on the remaining .98 acres that make up the second lot (7609 Masonboro Sound Rd.). We are planning on building a guest cottage in the near future on that lot and would like to maintain the proportion of the impervious surface that was attributed for the .98 acres in the original permit that now makes up 7609 Masonboro Sound Road. Sullins Governor Director September 25, 2009 Richard & Carole Johnson 7542 Masonboro Sound Road Wilmington, NC 28409 Subject: Approved Plan Revision Richard & Carole Johnson Homesite and Boat Ramp Stormwater Project No. SW8 030128 New Hanover County Dear Mr. and Mrs. Johnson: Dee Freeman Secretary On September 16, 2009, the Wilmington Regional Office received a plan revision for Stormwater Management Permit Number SW8 030128. The revisions include a reduction in the project area from 5.29 acres to 5.14 acres, which reduces the total maximum allowed BUA for the project to 55,974 square feet. Currently, the main house and driveway take up 20,030 square feet for the 4.2 acre tract 2B, leaving 35,944 square feet leftover for future development on the property, including the 0.94 acre Tract 3C. It has been determined that a formal permit modification is not required for the proposed changes. We are forwarding you an approved copy of the revised plans for your files. Please replace the old approved plan sheet with the new one attached Please note that while there is 35,944 square feet of leftover built -upon area available, it may not be possible to utilize all of this on the remaining 0.94 acre Tract 3C without creating a pocket of high density. The creation of a pocket of high density will require treatment for the runoff from that BUA. In that event, the existing general permit will need to be modified to an individual permit prior to any construction. To avoid a pocket of high density on Tract 3C, please restrict the proposed BUA on that tract to 10,236 square feet or less. Please be aware that all terms and conditions of the permit issued on May 12, 2003, remain in full force and effect. Please also understand that the approval of this revision to the approved plans for the subject State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be approved through this Office prior to construction. The issuance of this plan revision does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS This permit covers the construction of a maximum of 20,030 square feet of built -upon area for the single family residence. Built -upon area in excess of 55,974 square feet will require a permit modification. For the boat ramp, the built -upon area has been minimized as much as possible. 2. The approved Erosion Control plan will be followed. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 4. No new stormwater piping shall be allowed except that amount shown on the approved plan as existing; that minimum amount necessary to direct runoff beneath an impervious surface such as a road; and that minimum amount needed under driveways to provide access to lots. A 30' vegetated buffer area must be maintained between all impervious areas and surface waters. Page 2 of 4
