Sound Road, as requested in the permittee's letter dated 12/28/2006, including the
attached work plan drawing (1) dated 12/28/06.
This permit, issued on March 19, 2007 is subject to compliance with the application (where consistent with
the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this minor modification authorizes use of the 5' X 10' and 6`X 12'
`EZ docks' all as expressly and specifically set forth in the attached work plan drawing. No other
additional structures, whether floating or stationary, shall become a permanent part.of this docking
facility without permitmodification. No non -water dependent uses of structures shall be conducted on,
in or over public trust waters without permit modification.
2) This modification shall.be attached to the original Permit No. 64-03, which was issued on 05/27/03, as
well as all subsequent modifications, refinements and renewals, and copies of all documents shall be
readily available on site when Division personnel inspect the project for compliance.
3) All conditions and stipulations of the active permit remain in force under this minor modification unless
specifically altered herein.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2011
In issuing this permit. the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff -
colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff -colored form), as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 1 13-229. Your petition for a hearing must be tiled in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the [-trial decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
You complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

Mr. Steve Morrison, acting agent for Richard Johnson, is requesting a modification of State Permit No. 64-0f.
State Permit No. 64-03 was issued to Richard Johnson on May 27, 2003 for maintenance dredging, basin expansion,
shoreline stabilization, docking facility, boat ramp and upland development. Mr. Johnson received a Letter of Refinement
on December 8, 2004 for the reduction of platform area of his authorized structures by a total of 264 sq. ft. The Permit will
expire on December 31, 2006.
Mr. Morrison is requesting that the permit be modified to allow installation of two (2) floating boatlift platforms (EZ
Docks) within his existing slips. One platform would be 6' in length by 4' in width and the other would be 8' in length by
5' in width. The total square footage would be 64 sq. ft. The agent states that the reduction of 264 sq. ft. from the Letter of
Refinement would allow for the installation of the floating platforms (EZ Docks) into the existing slips and would not create
additional slips.
The agent has submitted a check (ck. # 26798) in the amount of $100.00 for the modification request.

Dear Robb,
On behalf of Mr. Richard Johnson, I am requesting a Letter of Refinement for his CAMA
Permit 64-03 to allow two small floating platforms (EZ Docks) within his existing slips
for personal watercraft to be secured upon. One platform measures 4'x6' and the other
measures 5'x8' which totals 64 square feet. On December 8, 2004, Mr. Johnson received
a Letter of Refinement reducing the platform area of his authorized structures by a total
of 264'. This related to a smaller total deck area and smaller floating dock. I have
attached copies of the related drawings and the issued Letter of Refinement. Since the
two small floating platforms have much less total square footage than the earlier
reduction, this will not exceed the square footage allowed by Mr. Johnson's shoreline
length. Please contact me with any questions that you may have regarding this

Maintenance Dredging & Basin Expansion
1) In order to protect juvenile shrimp and finfish populations, no excavation will be permitted between
April 1 and September 30 of any year without the prior approval of the Division of -Coastal
Management, in consultation with the Division of Marine Pisheries.
2) Excavation will not exceed -3 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
3) No vegetated wetlands will be excavated outside of the alignment of the area indicated on the workplan
drawings for expansion of the existing basin.

of the permitted pier. I have enclosed drawings of both the original permitted design and
the modified design for your examination. The design change will result in the
dimensional reduction of both the total platform area and the gazebo. The structure will
remain 9' away from the 15' riparian setback. I have also enclosed a copy of the original

Dear Mr. Johnson:
This is with reference to the request by your consultant, Mr. Steve Morrison, to modify State Permit #64-03
which was issued to Richard Johnson on May 27, 2003, and will expire on December 31, 2006. The action proposed in
your submittal is to modify the design of the waterward extent of the permitted pier. The change would result in the
dimensional reduction of the platform area from 26' x 26' to 20' x 26'and the gazebo from 16' x 16' to 10' x 12'. The
design modification would also reduce the permitted floating dock dimension from a 40' x 6' to a 22' x 6', which
would be configured to avoid the permitted access channel and allow for better usefulness of the structure. Upon
reviewing the submittal and contacting our Major Permits Processing Coordinator, I have determined that the proposed
action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the
permit.
I hereby submit this Letter of Refinement authorizing the modification of State Permit #64-03 as described in
your letter dated November 23, 2004, including work plan drawings dated received on November 30, 2004. By copy
of this letter we are also notifying the U. S. Army Corps of Engineers of our action.
If you have any questions concerning the above or if I can be of any other assistance, please advise.

After reviewing the project for Richard Johnson for the Minor Modification request to
install EZ docks in his existing basin, I contacted Robb Mairs. Prior to the conversation
with Robb Mairs, it was brought to my attention that Mr. Johnson had a major
modification request presently in processing for work outside of the scope of this project.
I addressed my concerns regarding having 2 permits in concurrent review with Doug
Huggett and he stated that as long as the permits are not related, it was permissible to
review them separately. As stated above, this is when I contacted Robb Mairs.and he
stated that indeed these two modifications were in no way related, therefore allowing us
to move forward on this minor permit modification.

Greg Finch called DCM conceming'the renewal/maintenance-5 permit that was issued on
2/21/07, explaining that a minor modification was also requested in letter dated 12/28/06
but was not included in permit dated 2/21/07. I called Rob Mairs concerning the fact the
request was made on 2/17/06 but was not issued because more information was needed
for the ez docks. Rob, explained that ez docks were now accurately drawn on the work
plan dated 12/28/06. The minor modification was issued on 3/12/07.
