This permit, issued on Fehrnary 21, 2nn7 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) This renewal shall be attached to the original of Permit No. 64=63, which was issued on 5/27/03, and
modified on 11/5/03 and copies of all documents, including any letters of refinement, shall be readily
available on site when Division personnel inspect the project for compliance.
2) All conditions and stipulations of the active permit remain in force under this renewal.
Maintenance Clause
3) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance work authorized by this permit and that notification include:
A. The number of the original permit
B. A statement that no dimensional changes are proposed
C. A copy of the'original permit plan(s) with cross -hatching indicating the area to be maintained
and the area to be used for dredge spoil, and the estimated amount of material to be removed.
D. The date'of plan revision and the permittee's signature shown anew on the original plan
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the permit expires on
December 31, 2011
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff_
colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff -colored form), as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval._ Please read your permit carefully prior to starting work and review all project plags, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

This is with reference to the request by your consultant, Mr. Steve Morrison, to modify tate Permit #64-03
which was issued to Richard Johnson on May 27, 2003, and will expire on December 31, 2006. The action proposed in
your submittal is to modify the design of the waterward extent of the permitted pier. The change would result in the
dimensional reduction of the platform area from 26' x 26' to 20' x 26'and the gazebo from 16' x 16' to 10' x 12'. The
design modification would also reduce the permitted floating dock dimension from a 40' x 6' to a 22' x 6', which
would be configured to avoid the permitted access channel and allow for better usefulness of the structure. Upon
reviewing the submittal and contacting our Major Permits Processing Coordinator, I have determined that the proposed
action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the
permit.
I hereby submit this Letter of Refinement authorizing the modification of State Permit #64-03 as described in
your letter dated November 23, 2004, including work plan drawings dated received on November 30, 2004. By copy
of this letter we are also notifying the U. S. Army Corps of Engineers of our action.

Mr. Greg Finch, acting agent for Richard Johnson, is requesting renewal of State Permit No. 64-03 with addition of
a 5-year maintenance clause. State Permit No. 64-03 was issued to Richard Johnson on May 27, 2003 for maintenance
dredging, basin expansion, shoreline stabilization, docking facility, boat ramp and upland development. Mr. Johnson
received a Letter of Refinement on December 8, 2004 for the reduction of platform area of his authorized structures by a
total of 264 sq. ft. The Permit expired on December 31, 2006. The agent has also followed up with additional information
with the Minor Modification request dated 12/20/05 (attached). The 12/20/05 letter states the dimensions of the `EZ
Docks' floating platforms are 4'x 6' and 5'x 8'. However, more detailed information indicates the platforms are actually
5' x 10' and 6' x 12' (totaling 122 sq. ft.). This area is still below the 264 sq. ft. reduction in platform area per 12/8/04
Letter of Refinement.
This Office has no objection to the renewal of Permit No. 64-03. The applicant has included a check (ck no. 29091) in
the amount of $100.00 for the renewal.

On behalf of Mr. Richard Johnson, I would like to request the renewal of CAMA Major Permit 64-03 with the
addition of a 5-year maintenance clause. This letter also serves to follow-up on the Minor Modification
requested in a letter dated 12/20/05 (attached).
Dredge spoils will be placed outside of the Corp's right-of-way on the spoil island located across the waterway
from the subject property. In a letter dated 2/23/05 Henry B. Peschau III granted permission to place spoils at
this location. This letter, and details, were submitted with the 9/02/05 Major Modification request.
Enclosed is the requested drawing depicting the dimensions of the `EZ Docks' for the Minor Modification
request. The 12/20/05 letter states the dimensions of the `EZ Docks' floating platforms are 4'x 6' and 5'x 8'.
However, more detailed information indicates the platforms are actually 5'x 10' and 6'x 12' (totaling 122 s.f.).
This area is still below the 264 s.f. reduction in platform area per 12/8/04 Letter of Refinement. Also enclosed
is a fee check for the permit renewal (fee for modification forwarded in original 2/2/06 request) and a map

Dear Robb,
On behalf of Mr. Richard Johnson, I am requesting a Letter of Refinement for his CAMA
Permit 64-03 to allow two small floating platforms (EZ Docks) within his existing slips
for personal watercraft to be secured upon. One platform measures 4'x6' and the other
measures 5'x8' which totals 64 square feet. On December 8, 2004, Mr. Johnson received
a Letter of Refinement reducing the platform area of his authorized structures by a total
of 264'. This related to a smaller total deck area and smaller floating dock. I have
attached copies of the related drawings and the issued Letter of Refinement. Since the
two small floating platforms have much less total square footage than the earlier
reduction, this will not exceed the square footage allowed by Mr. Johnson's shoreline
length. Please contact me with any questions that you may have regarding this

Maintenance Dredgine & Basin Expansion
1) In order to protect juvenile shrimp and finfrsh populations, no excavation will be permitted between
April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with the Division of Marine Fisheries.
2) Excavation will not exceed -3 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
3) No vegetated wetlands will be excavated outside of the alignment of the area indicated on the workplan
drawings for expansion of the existing basin.

This permit action may be appealed by the permittee or

material from Johnson Boat Basin into U.S. Army Corps of Engineers Disposal Area Number
254.
As you were made aware in this specific request, a portion of the disposal area is located outside
of the Atlantic Intracoastal Waterway Right -of -Way. If you are placing your dredged material
outside of the Right -of -Way and in accordance with all agency regulations and not impacting the
upland disposal area within the Right -of -Way, then you are not required to seek consent from the
US Army Corps of Engineers.

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to modify and renew Department of the Army (DA) permit issued on
May 27.2003, which authorized the construction of a new single-family residence, maintenance
dredging of the existing boat basin and access channel, expansion of the existing basin, and
construction of a bulkhead, pier, boathouse, (3) boafil, a boat ramp and several floating docks
at 7601 Masonboro Sound Road, adjacent to Masonboro Sound, Wilmington, New Hanover
County, North Carolina. The permit was modified on November 5, 2003 to included the addition
of a freestanding wall to stabilize the southern end of he boat basin , and further modified on
December 8, 2004 to modify the design of the waterward extent of the permitted pier. The
current requested modification consists of the installation of two floating boatlift platforms (EZ
Docks) within existing slips. One platform would be 6' long by 4' wide, the other would be 8'
long by 5' wide, totalling 64 square feet.
The proposal continues to be consistent with the provisions and objectives of general permit No.
198000291. The permit is hereby modified and renewed. It is understood that all other
conditions of your permit remain applicable and that the expiration date is December 31, 2010.

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request for modification of your Department of the Army (DA) permit issued on
December 21, 2006, which authorized the construction of a new single-family residence,
maintenance dredging of the existing boat basin and access channel, expansion of the existing
basin, and construction of a bulkhead, pier, boathouse, (3) boatlifts, a boat ramp and several
floating docks at 7601 Masonboro Sound Road, adjacent to Masonboro Sound, Wilmington,
New Hanover County, North Carolina. The requested modification is to modify the design of
the waterward extent of the permitted pier. The change would result in the dimensional
reduction of the platform area from 26' x 26' and the gazebo from 16' x 16' to 10' x 12'. The
design modification would also reduce the permitted floating dock dimension from a 40' x 6' to
a 22' x 6', which would be configured to avoid the permitted access channel and allow for better
usefulness of the structure.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 198000291. The permit is hereby modified. It is understood that all other conditions
of your permit remain applicable and that the expiration date is December 31, 2007.
