Authorizing development in New Hanover County at adi. Masonboro Sound. at 7601 Masonboro
Sound Road , as requested in the permittee's application dated letter dated 8/19/03,
including the attached workplan drawings (2), both dated 8/14/03.
This permit, issued on November 5, 2003 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) This minor modification authorizes the addition of a freestanding wall to stabilize the southern end of
the boat basin, as expressly and specifically set forth in the letter dated 8/19/03 and depicted on the
attached workplan drawings dated 8/14/03.
2) The height of the authorized freestanding wall shall not exceed six inches above mean high water level.
3) The alignment of the authorized freestanding wall must be inspected and approved by a representative
of the Division of Coastal Management within a maximum of 30 days prior to the start of construction.
Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions,
will require the alignment to be re -inspected and re -approved by DCM within a maximum of 30 days
prior to the new expected start of construction.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2006
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

The permittee is requesting modification of the above referenced permit. The proposed change consists of the
addition of a wall to stabilize the the southern end of the boat basin. The proposed basin wall would be free-
standing and low profile, rising only 6 inches above the MHW elevation. It would be 47 feet in length,
extending perpendicular from back wall (west side) of the boat basin.
I have no objection to the modification request.
Please copy the USACOE with all permit renewals, modifications, and transfers.

Dear Ed,
As discussed on -site, Richard Johnson would like to construct a free-standing bulkhead
along the southern edge of his permitted boat basin. The purpose of the bulkhead is to
help stabilize this bank and prevent sediment accumulation within the basin. The
bulkhead will still allow for a planted coastal wetland area above it as shown on the
original application drawings. I have enclosed drawings depicting the requested
bulkhead, a copy of the original permit and the $100 fee check. Please contact me with

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request for modification of your Department of the Army (DA) permit issued on
June 19, 2003, which authorized the construction of a new single-family residence, maintenance
dredging of the existing boat basin and access channel, expansion of the existing basin, and
construction of a bulkhead, pier, boathouse, (3) boatlifts, a boat ramp and several floating docks
at 7601 Masonboro Sound Road, adjacent to Masonboro Sound, Wilmington, New Hanover
County, North Carolina. The requested modification consists of the addition of a freestanding
wall to stabilize the southern end of the boat basin (see enclosure).
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 198000291. The permit is hereby modified. It is understood that all other conditions
of your permit remain applicable and that the expiration date is December 31, 2006.
