Authorizing development in Carteret County east end of Taylor's Creek, in Beaufort,
as requested in the permittee's application dated 8/25/16, including the
attached workplan drawings (2) both dated 8/10/16.
This permit, issued on October 19, 2016 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
he suhiect to fines. imprisonment or civil action; or may cause the permit to be null and void.
No Wake Zone
1) . Unless specifically altered herein, this permit authorizes the installation of two (2) "No Wake Zone"
buoys all as expressly and specifically set forth in the attached permit application and workplan
drawings. Any additional development and/or construction activities may require a modification of
this permit. Contact a Division of Coastal Management Representative at (252) 808-2808 for this
determination.
2) The channel markers shall conform with any and all appropriate regulations governing such
structures, including, but not limited to, marking and lighting requirements of the United States Coast
Guard.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 3.1, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
General
3) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
4) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage or injury to the authorized structure or work
which may be caused from existing or future operations undertaken by the United States in the public
interest.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
initiation of this project.
7) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project under Action Id. No. SAW-
2016-01726.
NOTE: An application processing fee of $400 was received by DCM for this project.

Taylor Creek is heavily traveled by motorboats. The purpose of this project is to clearly mark the border of the eastern end of
he No Wake Zone with 2 new floating buoys. This will improve public navigation andsafety in the area.

of equipment and where it is to be stored.
The 2 floating buoys will be assembled off -site. NCWRC staff will install the buoys. They will travel to the site in a motorboat
and ensure proper location of the buoys by GPS.

LAMA Permit Narrative for Taylor Creek No Wake Zone Buoys
August 2016
NCWRC proposes to install 2 new No Wake Zone floating buoys at the eastern end of Taylor Creek in
Beaufort, Carteret County, NC
The purpose of this project is regulate boat traffic and improve public safety by 2 new No Wake Zone
markers at the eastern end of Taylor Creek. This No Wake Zone is regulated by NCWRC and is described
in NCAC Chapter 15A-10F .0330-a (2). That text is included with the application.
This project will install 2 new No Wake Zone markers at the eastern end of Taylor Creek, one on each
side of the creek. Both markers will be floating buoys. The buoys will have a floating height of 3', a base
of 28" diameter, and a 'can' diameter of 1'. The buoys will be anchored with a concrete block weighing
150 pounds. The buoys will be carried to the site by motorboat. NCWRC staff will place the buoys in the

The coordinates of the proposed northern buoy are 34142' 26.86" N, 760 37' 3.60" W. This location is
20' away from the Federal Navigation Channel and in between 2 existing fixed docks.
The coordinates of the proposed southern buoy are 34° 42' 24.75" N, 76137' 4.75" W. This location is
outside of both the Federal Navigation Channel and setback.
At the request of US Army Corps of Engineers — Navigation, a PCN has concurrently been submitted.
No upland development is proposed. No new impervious surfaces will be created. No above -water land
will be disturbed.

8. PROJECT SUMMARY:
The applicant proposes to add two "No Wake" buoys within the vicinity of most eastern
end of Taylors Creek.
9. Narrative Description
The NCWRC Taylors Creek no wake buoy project is located along the cast end of Taylors
Creek in Beaufort, NC.
Taylors creek is a total of 3 miles in length and has a 100' wide USACOE channel with a
51' channel setback along the project area (east end of Taylors Creek). Presently there are

existing single- family residences with bulkheads and piers to the north and an
undeveloped parcel to the south known as Carrot Island.
The Town of Beaufort Land Use Plan classifies this property as Low Density Residential,
with all AEC's classified Conservation. This section of Taylors Creek is not designated as
Primary Nursery Area, is closed to the taking of shellfish and carries a water classification
of SC. Riparian corridors were not determined. The buoy placement would be located
within an existing NCWRC regulated "No Wake" zone and with the existing USACOE
channel designation area. The neighbors within the buoy vicinity were notified and no
objections were received. No SAV's or shellfish beds were observed within the proposal
project area.
10. Proiect Description:
The "No Wake" buoys", per the applicant, would be placed in accordance to coordinates
provided by the NC Wildlife and would follow all required NC Wildlife guidelines. This
area is designated as a regulated area per 15A NCAC 1 OF.0330, Carteret County, to
provide a no wake zone in the waters of Taylors Creek. The buoys would be white and
marked with an orange symbol with black lettering containing "No Wake" and "Slow".
They would be 38 inches in diameter at the base, 19 inches in diameter at the top, 36
inches long, retain a 20' arc of swing, 3' in height above water level and would be held in
place with a 1' square concrete block that weighs 150 pounds and anchor cabling (3x the
existing -5' water depth). The buoys would be approximately 20' from the USACOE
channel along the north side and 60' from existing dock areas. The buoy along the
southern side would be completely outside of the USACOE channel area and setback area
and approximately 180' from nhw along Carrot Island. The buoys would be located at the
following coordinates provided by NC Wildlife;
• North Buoy - 34.770802N, 76.61767W
• South Buoy- 34.70688N, 76.61799W
The NCWRC received a general permit verification from the USACOE on 9/9/16. The
action ID for this is SAW-2016-01726.
11. Anticipated Imnacts:
The proposed buoy placement would incorporate a total of 628ft2 of open
Waters and would cause temporary turbidity during placement. There would be no
hindrance to navigation due to the fact they would be located approximately 20' from
the USACOE channel edge to the north and completely outside of the designated USACOE
channel area to the south.

The following is my assessment and consequent recommendations of the above
referenced proposal: This proposal involves the placement of two "no Wake' buoys
along the east end of Taylors Creek. The development conforms to the guidelines set
forth under 15A NCAC 07H .0208. The waters of Taylors Creek area are closed to
shellfish harvest and is not designated as a Primary Nursery Area. Assuming that state
and federal agencies concur with the proposal, the District recommends the project be
authorized as proposed, contingent upon the following conditions:
• There are no slips authorized.
• The no wake buoys shall be placed in accordance to NC wildlife coordinates and
guidelines.
• No work shall hinder navigation in any way.
• All development shall be constructed as shown on plats accepted as complete by DCM on
8/31/16.

Consistency Determination: The request is consistent with/not in conflict with the Town of Beaufort
Land Use Plan certified by the CRC on January 26, 2007.
Overview: The applicant is requesting to install two (2) "No Wake" buoys at the most eastern end of
Taylors Creek in the Town of Beaufort, Carteret County, North Carolina. The buoy on the northern side
of the creek will be placed approximately 20' from the USACOE channel along the north side and 60'
from existing dock areas. The buoy on the southern side of the creek will be completely outside of the
USACOE channel area and setback area and approximately 180' from nhw along Carrot Island. The buoys
will be located at the following coordinates:
• North Buoy-37.770802N, 76.61767W
• South Buoy-37.70688N, 76.61799W.
The water at the project site in the Taylors Creek is SC (Aquatic Life, Secondary Recreation, Salt
Water), is not PNA (Primary Nursery Area), and is closed to the taking of shellfish. The proposed project
area contains no shellfish beds or Submerged Aquatic Vegetation (SAV). A review of archaeological
resources was not provided.
Anticipated impacts resulting from this project are expected to include: the incorporation of 628ft2 of
Open Water and temporary turbidity during installation. There will be no hindrance to navigation.
Basis for Determination:
The project site is located in the Town of Beaufort and is subject to the 2006 Town of Beaufort Core
Land Use Plan. The Future Land Use Map (FLUM) designates the property adjacent to the proposed
buoys as Low Density Residential and the AECs (Areas of Environmental Concern).

I have no objections to the extension of the No Wake Zone at the end of Taylors Creek
and would welcome the further extension of the Zone around Lennoxville Point. There is
a very unsafe condition with the high rate of vessels traveling at high speed especially on
weekends.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your project at the east end of Taylors Creek along the existing "No Wake"
zone in Beaufort, Carteret County. The application was received as complete on 8/31/16, and appears to be
adequate for processing at this time. The projected deadline for making a decision is 11/14/16. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 8/31/16, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request
and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed

Waterway and ending at U.S. Highway 70;

seawall on the south side of Evans, Shepard and Shackleford Streets and bounded on the east by the
State Ports Authority and on the west by the eastern right-of-way margin of South 13th Street

(5) the waters of Gallant's Channel from the US 70 crossing over the Grayden Paul bridge to Taylor's

(b) Speed Limit. It is unlawful to operate a motorboat or vessel at a speed greater than no -wake
speed while on the waters of the regulated areas designated in Paragraph (a) of this Rule.
(c) Placement and Maintenance of Markers. The Board of Commissioners of Carteret County,
with respect to the regulated areas designated in Subparagraphs (1), (3), (5), (6), (7), (8), (W, (1-2)
(11) and-(13) (12) of Paragraph (a) of this Rule, and the Board of Commissioners of the Town of
Beaufort, with respect to the regulated area designated in Subparagraph (2) of Paragraph (a) of this
Rule, and the Board of Commissioners of Morehead City, with respect to Subparagraph (4), (9),
and (14) 13 of Paragraph (a) of this Rule, and the North Carolina State Ports Authority, with
respect to the regulated area designated in Subparagraph " (10) of Paragraph (a) of this Rule
