Issued to NC Wildlife Resources Commission,1720 Mail Services Center, Raleigh, NC 27699 Authorizing development in Carteret County east end of Taylor's Creek, in Beaufort, as requested in the permittee's application dated 8/25/16, including the attached workplan drawings (2) both dated 8/10/16. This permit, issued on October 19, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may he suhiect to fines. imprisonment or civil action; or may cause the permit to be null and void. No Wake Zone 1) . Unless specifically altered herein, this permit authorizes the installation of two (2) "No Wake Zone" buoys all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional development and/or construction activities may require a modification of this permit. Contact a Division of Coastal Management Representative at (252) 808-2808 for this determination. 2) The channel markers shall conform with any and all appropriate regulations governing such structures, including, but not limited to, marking and lighting requirements of the United States Coast Guard. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature ofPermittee NCWRC Permit No. IW-16r Page 2 of 2 ADDITIONAL CONDITIONS General 3) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. 4) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to initiation of this project. 7) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The U.S. Army Corps of Engineers assigned the proposed project under Action Id. No. SAW- 2016-01726. Give complete description: $)aslao►v Date Taylor Creek No Wake Zone Project Name NCWRC/Sara Sherman Applicant Name ApplioSigQa�{nature RECEIVED AUG 3 1 2016 DCM- MHD CITY 252.808.2808 :: 1-888-4RCOAST :: www.nccoastaimanagement.net revised: 12/27/06 if LAMA Permit Narrative for Taylor Creek No Wake Zone Buoys August 2016 NCWRC proposes to install 2 new No Wake Zone floating buoys at the eastern end of Taylor Creek in Beaufort, Carteret County, NC The purpose of this project is regulate boat traffic and improve public safety by 2 new No Wake Zone markers at the eastern end of Taylor Creek. This No Wake Zone is regulated by NCWRC and is described in NCAC Chapter 15A-10F .0330-a (2). That text is included with the application. This project will install 2 new No Wake Zone markers at the eastern end of Taylor Creek, one on each side of the creek. Both markers will be floating buoys. The buoys will have a floating height of 3', a base of 28" diameter, and a 'can' diameter of 1'. The buoys will be anchored with a concrete block weighing 150 pounds. The buoys will be carried to the site by motorboat. NCWRC staff will place the buoys in the water after using GPS equipment to confirm the correct location. The coordinates of the proposed northern buoy are 34142' 26.86" N, 760 37' 3.60" W. This location is 20' away from the Federal Navigation Channel and in between 2 existing fixed docks. The coordinates of the proposed southern buoy are 34° 42' 24.75" N, 76137' 4.75" W. This location is outside of both the Federal Navigation Channel and setback. At the request of US Army Corps of Engineers — Navigation, a PCN has concurrently been submitted. No upland development is proposed. No new impervious surfaces will be created. No above -water land will be disturbed. PROJECT SUMMARY: The applicant proposes to add two "No Wake" buoys within the vicinity of most eastern end of Taylors Creek. 9. Narrative Description The NCWRC Taylors Creek no wake buoy project is located along the cast end of Taylors Creek in Beaufort, NC. Taylors creek is a total of 3 miles in length and has a 100' wide USACOE channel with a 51' channel setback along the project area (east end of Taylors Creek). Presently there are Field Investigation Report: NCWRC "No Wake" Buoys, Taylors Creek Page 02 existing single- family residences with bulkheads and piers to the north and an undeveloped parcel to the south known as Carrot Island. The Town of Beaufort Land Use Plan classifies this property as Low Density Residential, with all AEC's classified Conservation. This section of Taylors Creek is not designated as Primary Nursery Area, is closed to the taking of shellfish and carries a water classification of SC. Riparian corridors were not determined. The buoy placement would be located within an existing NCWRC regulated "No Wake" zone and with the existing USACOE channel designation area. The neighbors within the buoy vicinity were notified and no objections were received. No SAV's or shellfish beds were observed within the proposal project area. 10. Proiect Description: The "No Wake" buoys", per the applicant, would be placed in accordance to coordinates provided by the NC Wildlife and would follow all required NC Wildlife guidelines. This area is designated as a regulated area per 15A NCAC 1 OF.0330, Carteret County, to provide a no wake zone in the waters of Taylors Creek. The buoys would be white and marked with an orange symbol with black lettering containing "No Wake" and "Slow". They would be 38 inches in diameter at the base, 19 inches in diameter at the top, 36 inches long, retain a 20' arc of swing, 3' in height above water level and would be held in place with a 1' square concrete block that weighs 150 pounds and anchor cabling (3x the existing -5' water depth). The buoys would be approximately 20' from the USACOE channel along the north side and 60' from existing dock areas. The buoy along the southern side would be completely outside of the USACOE channel area and setback area and approximately 180' from nhw along Carrot Island.
