This permit, issued on January 28, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the parking lots, sidewalks, and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and work drawings. Any additional land disturbing activities or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 264-3901. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee T NC Wildlife Resources Commission Permit No. 10-16 Page 2 of 4 ADDITIONAL CONDITIONS Boat Ramp & Riprap Fill 2) Unless specifically altered herein, this permit authorizes one, two-lane boat ramp, as indicated on the attached workplan drawings. 3) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 4) Excavation and ground disturbing activities, including riprap fill to remediate bottom irregularities for access, associated with the placement of the boat ramp, above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. Access Channel Excavation 5) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between February 15 and June 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 6) Excavation shall not exceed -3 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 7) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). Spoil Disposal 8) All excavated materials shall be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Maintenance Clause 10) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. NC Wildlife Resources Commission Permit No.10-16 Page 3 of 4 ADDITIONAL CONDITIONS Sedimentation & Erosion Control NOTE: An Erosion and Sedimentation Control Plan shall be required for this project. If this plan has not already been submitted, it must be filed at least thirty (30) days prior'to the beginning of any land disturbing activity. Submit this plan to the Department of Environmental Quality, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Docking Facility 13) This permit authorizes only the reconstructed docks and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconstructed docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 14) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 15) The permittee shall maintain the authorized work in good condition and in conformance with the terms and "conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 16) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 17) This permit authorizes no formalized boat slips. 18) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 19) No open water areas shall be excavated or filled, even temporarily, outside of the area as indicated on the attached workplan drawings. NC Wildlife Resources Commission Permit No. 10-16 Page 4 of 4 ADDITIONAL CONDITIONS 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 22) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Tier, H Programmatic General Permit 198000291 (Action ID No. SAW201502626), which was issued on 1/22/16. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 15-1301. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. Y�u�^::awwa.�.vw+�e+ri'�iF+iwtr4wrw�ix4�'` _:n The Perquimans Boating Access Area project it located at the end of Boat Ramp Rd. off of New Hope Rd. in Hertford, NC. The current property is a gravel parking area with a two lane concrete boat ramp and wood floating dock. The site also includes an access channel with stone jetties. This property was purchased by NCWRC in 1971 and received a CAMA permit for construction of the boat ramp facility and jetties in 1973. Several CAMA general permits have been granted since for dredging of the access channel and upgrades to the boat ramp and floating dock. This project involves the renovation of the current WRC boating access area. This site renovation will include a new double lane launch ramp, floating dock, a new ADA accessible parking space with sidewalk, and dredging. Construction will also include the resurfacing of the gravel parking lot for both trailed and non-trailered vehicles. Impervious Surface: The total property owned by the Wildlife Resources Commission is 134,600 sf (3.09 acres). The pre -development impervious surface on the property is 33,737 sf (25.06 %). The post -development impervious surface on the property is 32,917 sf (24.45 %). This net loss of impervious surface is the result of removing of gravel beneath the drip line of the existing Oak in the parking area. The net loss is 820 sf . Due to the expanded width of the boat ramp, there is a 454 sf increase in impervious surface within the 75` AEC buffer. Dredging: Dredging is required for this project. There was a recent CAMA General permit executed for the dredging of the center portion of the channel, permit number A64888. This permit expired May 12, 2015. This permit did not include an area along the western RECEIVED DEC 14 2015 DCM- MHD CITY jetty due to the presence of Shallow Water Habitat and Non -Coastal Wetland. The area delineated as Shallow Water Habitat is 2,688 sf and contains two species of Submerged Aquatic Vegetation (SAV); Vallisneria americana & Najas guadalupensis. DCM has also delineated an area of 730 sf as Non -Coastal Wetlands that includes Typha latifolia. Over the past few years, this area has silted in enough towards the center of the channel that it has made navigation within the channel nonfunctional fora two lane boat ramp. This area to be dredged is 3,857 sf with an average removal depth of 2.42'. This dredging will be done bucket to barge and will remove approximately 345 cubic yards of material. There is currently a dredge spoil area of 3,952 sf (52'x 76') holding approximately 640cy of material from the above mentioned dredge, permit number A64888. This dredge spoil area will increase in size to approximately 6,480 sf (72'x 90') to hold the additional dredge material. Some of the existing material will be hauled off site during construction. The quantity of haul -off is undetermined at this time. Existing Stormwater Conditions: The existing site has no stormwater controls. The current runoff is both infiltrated in vegetated areas or sheet flows off the site. The current drainage patterns will not be changed by this renovation. Ramps/Docks: The proposed project includes the construction of a 38' wide x 110' long, concrete launch ramp. The ramp lanes are 15' wide with an 8' wide center abutment. An 8' floating dock will be installed between the ramps. Beneath the floating dock, the ramps are widened to 16' wide so that the floating dock can rest on the concrete at times of low water. The remainder of the ramp area beneath the floating dock, below NWL is rip -rap fill. The ramps will be cast on site and then pushed in place with a bulldozer. The upper portion of the ramp (above NWL) and the abutment will be cast in place. There is a small existing scour hole from boat motors at the end of the ramp. This area is approximately 113 sf with an average depth of 8". Rip Rap (2.8 cy) will be placed in hole to create a uniform base at the bottom of new ramp. The existing "End of Ramp" signs will be removed. The current drop off at the end of ramp due. to scour will no longer exist after new ramp construction. Jetties: There are currently two stone jetties that extend approximately 290' from the normal water line at the existing boat ramp. A section of the western jetty is in disrepair, with 4 some stone having sunk or fallen into the water. This area of disrepair has contributed to the soil intrusion into the channel, resulting in the shallow water habitat area. As discussed with DCM on -site, approximately 40'xl6' of jetty will be repaired by placing stone on top of the low area to bring that section of jetty back up to the original design height of 2.5' above NWL. No excavation will take place; the fallen and/or sunken stone will remain in place for support. PROJECT SUMMARY: The NC WRC proposes to replace an existing concrete dual ramp with two new ramps and a new floating courtesy dock, and improve the existing parking lot. The parking lot will be expanded and include ADA approved parking with a concrete walkway to the water. The new ramps will be expanded from 30' to 38' wide and the courtesy dock will be expanded to a length of 60' from 40'. A shoal will be excavated along channel to provide better access to the boat ramp on the west side. Project Settinq New Hope Boat Ramp is located on a 3.09 acre site owned by the State of North Carolina and located at the end of Boat Ramp Road (SR1319) in New Hope, on the Perquimans River, in Perquimans County. The property is bounded on the three sides by farmland and managed timber, and on the south by the Perquimans River. The initial application to create a public boat ramp at this location was submitted to US Army Corps of Engineers (USAGE) by the NC WRC in 1973. Four subsequent permits have been issued to maintain this site, three for maintenance dredging, one to maintain the jetties and one to replace the dock. In 2015 General Permit 64888A was issued to maintenance dredge the access channel following several of complaints. A maximum of 1,000cys was removed to maintain access to the ramp pending submittal of a CAMA Major Permit to undertake dredging involving the removal wetland and submerged aquatic vegetation. During the most recent maintenance excavation both ramps were crushed by the heavy equipment offloading dredge spoil. This site is located along the northeast side of the Perquimans River and provides the only public water access to the Perquimans River below the "S" curve in the Town of Hertford. The New Hope ramp is heavily used by local commercial and recreational fisherman and crabbers. Parking at the site is gravel and is not delineated. Other improvements include a Kiosk, two 12' wide boat ramps that extend -25' waterward of normal water level (NWL) and a 6' x 40' center floating dock. Waters of the Perquimans River within the area in question are classified as SB, primary recreation, and are classified as "Joint" by the NC Division of Marine Fisheries and the NC Wildlife Resources Commission. Located -70' from NWL on the west side ramp is a large shoal that has formed from wave action along a low section of the riprap jetty, allowing sediment to accumulate and build a shoal between the jetties within the pre-existing channel. Google aerial photography from 2008 to 2013 clearly shows the shoal formation. For the past few years (up until this summer).there was a significant stand of cattails on the shoal. Over the last two year a significant area of cattails died, and transitioned to submerged aquatic vegetation. Submerged aquatic vegetation found within the access channel includes common water nymph (Najas guadalupensis) and wild celery (Vallisneria americana). Other vegetation found on the property includes, but is not limited to, loblolly pine (Pinus teada), bald cypress (Taxodium distichum), sweetgum (Liquidambar styraciflua), overcup oak (Quercus lyrata), cattail (Typha latifolia), greenbrier (Smilax rotundifolia), pennywort (Centella asiatica), and Virginia creeper (Parthenocissus quinquefolia). `The average elevation of the property is 6' above NWL, with the highest area along the center of the property. Flood Zone designation of the property is AE extending -65' landward from NWL at the existing concrete ramp and along the east and west property lines. i NC Wildlife Resources Commission 64� Boat Ramp Road Field Investigation Report Page 3 Development Proposal The NC Wildlife Resources Commission would like to make improvements to the New Hope boat ramp, dock, channel access and parking. Proposed improvements will include the following: Dredainp: Maintenance dredge 3,857sf with an average depth of 2.42', for a total of 345 cubic yards of spoil. According to the applicant excavation will result in the removal of approximately 2,688sf of submerged aquatic vegetation (SAVs) including wild celery and common water nymph, and wetland vegetation containing 730sf of cattails. It should be noted that the area listed as shallow water habitat on the applicant's plans was assessed by the applicant as containing SAV's. Dredge spoil will be removed mechanically and barged to the ramp for placement in a high ground spoil site. Shallow Water Bottom Excavation: 3,857sf Boat Ramp: Construction of a 38' wide double reinforced concrete ramp and dock system 107' long with a 20' upland apron, a 50' upland ramp and a 37' waterward ramp. Situated in the center of the ramp will be an 8' x 60' floating dock. The ramps will be 16' wide, with 1' extending under the floating dock. The section of ramp to be placed below NWL will be cast in place above NWL and pushed down over a layer of rock. Concrete ramps below NWL: (2) 16' x 37' - a rock base will extend between the ramps and will be under the proposed dock. Total footprint will be 38' x 37'. Shallow Water Bottom Fill = 1,406sf (656sf increase in Shallow Water Bottom Fill) Concrete ramp/apron above NWL: 38' x 73' High ground fill = 2,774sf (454sf increase in lot cover within the 75' AEC) Place riprap at the base of the north ramp to stabilize a scour hole the waterward edge of the new ramp. The existing 52' x 76' will be expanded to 72' x 90' to allow for the placement of new material. Some of the existing spoil on the site will be removed prior to the placement of new material. A double row of silt fencing will be paced along the west side of the spoil site approximately 20' from the property line. After the dredge spoil has dried it will be removed from the site. There is more than sufficient area to place the material at height of:5 2'. High Ground Fill = 6,480sf Parking Lot: Improve an existing parking lot by placing new gravel and grading as needed. Parking for 17 boat trailers, 5 untailored vehicles and 1 handicap accessible trailer space (with a concrete walkway to the ramps) will be delineated by wheel stops and signage. VAN DER VAART Secretary TO: Courtney Spears, Assistant Major Permits Coordinator THROUGH: Frank Jennings, District Manager FROM: Lynn Mathis, Field Specialist DATE: Decembert 2016 SUBJECT: NCWRC CAMA Major Permit Application — Boat Ramp Road (New Hope) BRAXTON DAVIS Director NC Wildlife Resources Commission (NCWRC) proposes to make the following improvements to the existing public ramp located at the end of Boat Ramp Road in New Hope, Perquimans County, on the Perquimans River: 1) Maintenance dredge 3,857sf with an average depth of 2.42', for a total of 345 cubic yards of spoil. According to the applicant excavation will result in the removal of approximately 2,688sf of submerged aquatic vegetation (SAVs) including wild celery and common water nymph, and wetland vegetation containing 730sf of cattails. 2) Construct a 38' wide double reinforced concrete ramp and dock system with a 107' long ramp and a 8' x 60' wide center floating dock. The ramps will be 16' wide, with 1' extending under the floating dock. The 107' ramp will consist of a 20' upland apron, a 50' upland ramp and a 37' waterward ramp. The section of ramp to be placed below NWL will be cast in place above NWL and pushed down over a layer of rock. 3) Improve an existing parking lot by placing new gravel and grading as needed. Parking for 17 boat trailers, 5 untailored vehicles and 1 handicap accessible trailer space with a concrete walkway to the ramps. Parking spaces will be delineated by wheel stops and signage. Most improvements will fall within the footprint of the existing parking lot. Slight changes to the alignment will actually result in a net loss of 820sf impervious cover outside of the 75' AEC and a 454sf increase of impervious surface within the 75' AEC. 4) Place dprap at the base of the north ramp to stabilize a scour hole the waterward edge of the new ramp. 5) Repair a rock jetty. SECTION .0200 — THE ESTUARINE AND OCEAN SYSTEMS 15A NCAC 07H .0203 MANAGEMENT OBJECTIVE OF THE ESTUARINE AND OCEAN SYSTEM It is the objective of the Coastal Resources Commission to conserve and manage estuarine waters, coastal wetlands, public trust areas, and estuarine and public trust shorelines, as an interrelated group of AECs, so as to safeguard and perpetuate their biological, social, economic, and aesthetic values and to ensure that development occurring within these AECs is compatible with natural characteristics so as to minimize the likelihood of significant loss of private property and public resources. Furthermore, it is the objective of the Coastal Resources Commission to protect present common-law and statutory public rights of access to the lands and waters of the coastal area. To conserve and manage the important features of estuarine waters so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing estuarine waters so as to maximize their benefits to man and the estuarine and ocean system. Consistent: Project will maintain an existing access to the water for recreational, commercial and state management personnel use. (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Consistent: The project meets the use standards and is consistent with the intent of this rule. 15A NCAC 071-1.0208 USE STANDARDS (a) General Use Standards (1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches; Consistent: Water dependent use. (2) Before being granted a permit, the CRC or local permitting authority shall find that the applicant has complied with the following standards: (A) The location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas; Consistent: Invasive SAV species, wetlands, or shellfish beds. (B) Development shall comply with state and federal water and air quality; Consistent: Not an issue. (C) Development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources; Consistent: No impact. (D) Development shall not increase siltation; Consistent: As designed siltation should not be an issue. (G) Development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: Ramp will improve access to the Perquimans River. (3) When the proposed development is in conflict with the general or specific use standards set forth in this Rule, the CRC may approve the development if the applicant can demonstrate that the activity associated with the proposed project will have public benefits as identified in the findings and goals of the Coastal Area Management Act, that the public benefits outweigh the long range adverse effects of the project, that there is no reasonable alternate site available for the project, and that all reasonable means and measures to mitigate adverse impacts of the project have been incorporated into the project design and shall be implemented at the applicant's expense. Measures taken to mitigate or minimize adverse impacts shall include actions that: Consistent: No conflict. 15 NCAC 07H .0208 Use Standards (b)Special Use Standards (1) Navigation channels, canals, and boat basins shall be aligned or located so as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as defined by the MFC, or areas of coastal wetlands except as otherwise allowed within this Subchapter. Navigation channels, canals and boat basins shall also comply with the following standards: Consistent (A) Navigation channels and canals may be allowed through fringes of regularly and irregularly flooded coastal wetlands if the loss of wetlands will have no significant adverse impacts on fishery resources, water quality or adjacent wetlands, and if there is no reasonable alternative that would avoid the wetland losses; Consistent: NIA (B) All dredged material shall be confined landward of regularly and irregularly flooded coastal wetlands and stabilized to prevent entry of sediments into the adjacent water bodies or coastal wetlands; Consistent: Spoil will be mechanically removed and located in the northwest corner of the property outside of the 75' AEC. (C) Dredged material from maintenance of channels and canals through irregularly flooded wetlands shall be placed on non -wetland areas, remnant spoil piles, or disposed of by a method having no significant, long-term wetland impacts. Under no circumstances shall dredged material be placed on regularly flooded wetlands. New dredged material disposal areas shall not be located in the buffer area as outlined in 15A NCAC 07H .0209(d)(10); Consistent: Spoil will be mechanically removed and located in the northwest corner of the property outside of the 75' AEC. (D) Widths of excavated canals and channels shall be the minimum required to meet the applicant's needs but not impair water circulation; Consistent: Widening the opening will improve water circulation. Depths of boat basins shall decrease from the waterward end inland; Consistent: NIA (F) Any canal or boat basin shall be excavated no deeper than the depth of the connecting waters; Consistent: Depth of the ramp and channel will match the existing navigable channel. (G) Construction of finger canal systems are not allowed. Canals shall be either straight or meandering with no right angle comers; Consistent: NIA (H) Canals shall be designed so as not to create an erosion hazard to adjoining property. Design may include shoreline stabilization, vegetative stabilization, or setbacks based on soil characteristics; and Consistent: NIA (1) Maintenance excavation in canals, channels and boat basins within primary nursery areas and areas of submerged aquatic vegetation as defined by the MFC shall be avoided. However, when essential to maintain a traditional and established use, maintenance excavation may be approved if the applicant meets all of the following criteria: Consistent: The area to be excavated has been a traditional travel way for accessing the only public ramp on the Perquimans River below the Town of Hertford. Over the last 4 years a shoal has formed in the channel and SAVs have established on the shoal. Avoidance is not possible and maintain safe use of the existing public access. (6) Piers and Docking Facilities. (A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur; Consistent: Proposed pier is 8' to provide safe loading and unloading of vessels. T (B) The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas; Consistent: The area of the dock extending over water will be <400sf along 350' of shoreline. (C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking; Consistent: NIA (D) A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. They may be roofed but shall not be designed to allow second story use; Consistent: NIA (G) Pier and docking facility length shall be limited. Consistent: NIA (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100 foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. Consistent: The maximum length proposed is 40'. (1) Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. Consistent: >15' (J) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. Consistent: The piers do not involve any shell fishing franchise. SECTION .0600 - DEVELOPMENT STANDARDS APPLICABLE TO ALL AECS 15A NCAC 07H .0601 NO VIOLATION OF ANY RULE No development shall be allowed in any AEC which would result in a contravention or violation of any rules, regulations, or laws of the State of North Carolina or of local government in which the development takes place. Consistent: As proposed the project is consistent with the intent of this rule. 15A NCAC 07H .0602 POLLUTION OF WATERS No development shall be allowed in any AEC which would have a substantial likelihood of causing pollution of the waters of the state in which shellfishing is an existing use to the extent that such waters would be officially closed to the taking of shellfish. This rule shall also apply to development adjacent to or within closed shellfish waters when a use attainability study of those waters documents the presence of a significant shellfish resource in an area that could be expected to be opened for shellfishing given reasonable efforts to control the existing sources of pollution. DATE: December 15, 2015 Consistency Determination: The request is consistent with/not in conflict with the 1998 Perquimans County Land Use Plan certified by the CRC on October 24, 2002. Overview: The 3.09 acre subject property has approximately 500 linear feet of shoreline along the Perquimans River. Submerged Aquatic Vegetation (SAV) is located adjacent to the subject property. The average elevation of the property is 6 feet above Normal Water Level (NWL). The property contains AE Floodzone areas as well as areas outside of the Floodzone. A public boating access facility is located on the property. Existing site improvements include an undelineated gravel parking area, a 52 foot by 76 foot spoil retention site, and a kiosk. The spoil site is located approximately 170 feet landward of NWL. Existing shoreline improvements include two (2) 12 foot wide concrete boat ramps, a 6 foot wide by 40 foot long center floating dock and two (2) riprap jetties that extend approximately 290 feet waterward of the ramps. A section of the western jetty is in disrepair, with some stone having sunk or fallen into the water. The boat ramp facilities and jetties were permitted in 1973. Several CAMA general permits have been granted since for dredging of the access channel and upgrades to the boat ramp facility. In 2015, General Permit 64888A was issued to allow limited maintenance dredging of the access channel, outside of Submerged Aquatic Vegetation (SAV) areas, since dredging of SAV would require a CAMA Major Permit. In 2015, both of the ramps were crushed by heavy equipment offloading dredge spoil. The existing boat ramp facility will be removed. Approximately 345 cubic yards of dredge spoil will be stored at the expanded retention area and after it has dried it will be removed from the site. The waters of the Perquimans River are classified as SB and "Joint Waters" in this area and are closed to shellfish harvesting. A review of potential historic, cultural and archaeological resources was not provided. Anticipated Impacts resulting from this project are expected to include: the dredging of 3,857 sq. ft. of Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC); the filling of 1,516 sq. ft. of Public Trust Area/Estuarine Waters AEC, 4,539 sq. ft. of Estuarine Shoreline AEC, and .26 acre of High Ground landward of the AEC, and; the shading of approximately 80 sq. ft. of Public Trust Area/Estuarine Waters AEC. Basis for Determination: The Perquimans County Land Classification Map identifies the site area as "Rural". As noted on Page 49 of the Land Use Plan (LUP), all areas within an AEC also qualify for the designation of "Conservation". The following are LUP policies that may be applicable to this request: Areas of Environmental Concern (AEC) and Appropriate Land Uses in AECs: Policy #1, Page vi. "Perquimans County will continue to support and enforce, through its CAMA Minor Permitting capacity the State policies and permitted uses in Areas of Environmental Concern. Such uses shall be in accord with the general use standards for coastal wetlands, estuarine waters, estuarine shorelines, and public trust areas as stated in Chapter 15A, Subchapter 7H of the North Carolina General Statutes." The project site is located at the end of Boat Ramp Road adjacent the Perquimans River in New Hope, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to renovate an existing boating access area (BAA) by removing the existing ramps, constructing two new ramps with courtesy docks, expanding the parking lot, adding an ADA parking area, creating a concrete walkway, dredging an area of shallow water that has silted in toward the center of the channel, and repairing an existing jetty. The proposed dredged area was not included in a recent dredge event; therefore a submerged aquatic vegetation (SAV) survey was conducted to determine SAV presence. SAV were found to be in the area and were composed of wild celery and common water nymph. Approximately 2,688 ftZ of SAV will be disturbed with the proposal. The final water depth would be 4' NWL and would be done by bucket and barge. The Perquimans River at this location is classified SB by the Environmental Management Commission. The North Carolina Wildlife Resources Commission (NCWRC) proposes to make improvements to the boating access area from the Perquimans River located in New Hope, NC. The existing concrete ramps are failing and the jetties that protect the ramp area have settled. Several permits have been issued for minor maintenance excavation in the ramp area but the entire basin has not been dredge for some time which has allowed some submerged aquatic vegetation (SAV) to take hold with the basin near the ramp as well as some coastal wetland species in area where the old jetties have settled. The NCWRC proposed to construct two new concrete ramps, repair of the jetties, replace the floating dock in the middle of the ramps, and dredge the basin to allow use of the entire ramp. Although SAV and coastal wetlands occur in the proposed dredge footprint the basin has been in use since the early 70's and over the year sediment accumulation and restricted use of parts of the ramp have allowed the SAV and wetland plants to grow. Allowing the excavation of these habitat will allow the ramp to return to its full use. The project is located within waters designated as anadromous fish spawning area (AFSA), meaning it is an area critical to the spawning of anadromous fish such as alewife, herring, and shad. In order to protect these species it is recommend a moratorium from February 15— June 30 be observed for the excavation and fill portions of the project. In order to work during the moratorium it is requested that a turbidity curtain be used around the area and that it remain in place for at least 72 hours after work has finished.
