Sc 05 / 19 Local Government Nov 1 200i Permit Number Tc)i\/isiOJW\.AT MINC*9tVEt"WMENT PERMIT as authorized by the State of North Carolina, Department of Environment, Health, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statues, "Coastal Area Management' Issued to Lloyd Douglas Hunter & Milton R. Hunter, authorizing development in Ocean Hazard AEC at 1220 South Shore Dr. as requested in the permittee's application, dated 09/27/04. This permit, issued on 10/22/04, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. I- The structure shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards, Chapter 44-45, 2000 Residential Building Code, and the local Flood Damage Prevention ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance is inconsistent with any of the following AEC standards, the more restrictive provision shall control. 2- The structure must set back 60 feet from the first line of stable natural vegetation. 3- The structure must be located entirely off of the frontal done, and if a primary dune is present, behind the crest of the primary dune. 4- The structure most be elevated on pilings with a diameter of at least 8 inches and the lowest horizontal structural member must meet the 100-year flood level elevation of determined for this lot. 5- All pilings shall have a tip penetration of 16 feet below existing grade or 5 feet below mean sea level whichever is less. For those structures so located on the primary dune or nearer to the ocean, the pilings must extend to five feet below mean sea level. 6- Dune disturbances will be allowed only to the extent necessary for development and if the dune's protective value is not weakened or reduced disturbed areas will be immediately stabilized. 7- This permit may be renewed for one year if requested before the expiration date. 8- The pernittee is required to contact the Local Permit Officer shortly before he plans to begin construction to arrange a setback measurement which will be effective for sixty days barring a major shoreline change. Construction must begin within 60 days of the determination or the measurement is void and must be redone. 9- Sand used to strengthen dunes must be brought in from an outside source and most be of the same nature as the sand in the area in which it is to be placed. No sand is to be removed from the lot. to- Sand held in storage in any dune, other than frontal or primary dunes may be moved laterally in order to strengthen existing primary or frontal dunes if the work would enhance the protection to the proposed development activity and the sand is immediately stabilized. 11- All development must be consistent with all -applicable, Federal, State, and Local standards. 12- Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in the shoreline configuration. The structure shall be relocated ordismantled within two years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC Rules. 13- All construction will be landward of the vegetation line. 14- Pursuant to 15A NCAC, Subehapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third -party. This permit action may be appealed by the peroiltee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31, 2007 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. At that time, mostly trailers, cottages, and one or two motels were all that existed on occupied lots. In order to protect their investment at the time, my parents placed some restrictive deeds on our property specifically, that could also affect both adjoining properties to ours (i.e., multi -family residences, non-rentals,1,400 sq ft minimum, etc.). These restrictions were intended to prevent cheaper, less desirable homes or businesses from being built on adjoining lots - that were prevalent on Topsail Island in the 1970's. Over the past three decades, such deed restrictions have become unnecessary and probably unenforceable. Since your property at 1222 South Shore Drive adjoins mine, and since you both live in, as well as rent your property as a bed & breakfast, you should be aware that such covenants do exist pertaining to my home, as well as to each lot on either side of 1220 South Shore Drive, including your own. As you know, we have never tried to restrict, or to enforce such restrictions, due to changing times, rising land values and the increased prosperity on Topsail Island in general. When you built your house over a decade ago, we were happy to have you as a neighbor, and have appreciated your friendship, as well as the way you have cared for your home, and added value to the street and neighborhood.
