This permit, issued on March 12, 2021 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may oe suoJect to lines, imprisonment or civil action; or may cause me permit to De nun ano votr. 1) This renewal shall be attached to the Permit No. 98-16, which was issued to the permittee on 9/8/16, as well as all subsequent renewals, refinements and modifications, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 2) All conditions and stipulations of the active permit remain in force under this renewal. NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 16-0663. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No. 2003-00466. NOTE: A permit renewal application processing fee of $100 was received by DCM for this project. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. AMC is requesting only a renewal of the permit, not -a modification. These islands are owned by the NC Wildlife Resources Commission and managed for nesting birds by Audubon North Carolina (AMC) under a cooperative management agreement. The U.S. Army Corps of Engineers (USACE) uses these islands as an economical location for disposal of sandy material dredged from adjacent sections of the'navigational channel that serves the Port of Wilmington. ,AMC originally received this permit In 2016, and we have renewed -it once since, in2019. The current expiration date is December 31, 2021. ANCs purpose In holding the permit Is to manage these Islands for the benefit of nesting birds, Including up to 11% of the state's nesting Brown Pelicans, 30% of nesting Royal Terns, 40% of nesting Sandwich Terns,14% of nesting Gull -billed Terns, and 7% of the state's - nesting American Oystercatchers. All of these species are state Species of Greatest Conservation Need: . Recurring placements of -dredged material protects the islarids from'the long-term effects of erosion and enhances nesting habitat by controlling vegetation and providing elevation above storms and "king" 4ides.Therefore, the purpose and need of this project is to provide the USACE with a cost -'effective, ;disposal area for their work in those areas of the river and•to provide material to sustain bird nesting habitat The USACE has'Iriforme,d us that they are planning:a, potential placement event this fall or winter, and the projected project period extends through March 31„ 1022. The window for bird -nesting Island placement' and, the USACE's project period is between.October and March. Therefore the current December 31, 2021 expiration date cuts off In the middle of the project period. The USACE has explained that their office.of legal counsel has determined thatthey are required to have all'permit documents In hand prior to putting contracts out for bid, and that -the permits Must "be valid forthe entirety of;the project period. Therefore, they need to have an active.permit that covers the entire timeframe of the project, from when it goes to bid to end date. The USACE will put this contract out for bid on May 15, 2021. Therefore, in order to meet the purpose and need of the project, I am requesting an early renewal of permit 98-16 so that ANC will have a new permit in hand before May 15, 2021, and so that the expiration date on the new permit will be after March 31, 2022.
