Department of Transportation 315 Front Street BeaufortNi- 28516 Authorizing development in Carteret County Town Creek, West Beaufort Road, Beaufort , as requested in the permittee's letter dated 9/6/18 and the DOT compliance email dated 11/5/18, including the attached workplan drawing (1). dated 8/30/18. This permit, issued on December 21, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ae sunlect to rmes, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes marina reconfiguration and accessory sheds, all as expressly and specifically set forth in the attached letter and workplan drawing. Any additional development activities may require a modification of this permit. Marina Reconfiguration 2)- No portion of the marina shall exceed a maximum" of 1501eet-waterward-from the waterward"edge c the existing bulkhead, as depicted in the previously authorized workplan Page 3 of 5, dated 9/10/15. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Department of Transportation Permit No. 83-16 Page 2 of 2 - -ADDITIONAL CONDITIONS 3) Any portion of the permitted marina built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 4) This Minor Modification does not authorize any new formalized boat slips. Upland Development 5) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the authorization of the two accessory sheds, all as expressly and specifically set forth in the attached permit application and workplan drawings. The accessory sheds shall be located landward of all Coastal Wetlands. USACE Condition 6) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. The project is located on the south side of SR1170 (West Beaufort Road) approximately 1,500' west of SR 1174 (Turner St.) and is within and adjacent to Town Creek in Beaufort, Carteret County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. The proposal was found to be consistent with the provisions and objectives of the CAMA-Corps Programmatic General Permit 291 process for construction activities that receive authorization from the State of North Carolina. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this• project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials.(including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. hrcreases such that the turbidity in the water body is 50 NTUs or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTUs or less in trout waters, are not considered significant. 11. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the discovery of the violation. PROFILE OF MAIN PIER R FLOATS SCALE 1" = 20 feet VIEWS LOOKING NORTHWEST �. v -NCDOT / NC MARITIME MUSEUM BOAT MARINA NARRATIVE The proposed docks, ramp, etc, for a North Carolina Maritime Museum Boat Marina are to be located on Town Creek south of the future Gallants Channel Bridge currently under construction In Beaufort. Docks, ramp, etc. were previously located in the some area. The NC Maritime Museum property on Gallants Channel has been used for various special events as well as providing the home to an active Rowing Program, a Junior Sailing Program (JSP), and a Natural Science Program all served by a Boat Marina located east of the main property. Construction of the Gallants Channel Bridge has taken the Boat Marina Site along with previously existing gazebo, ramp and docks for necessary right- of-way where the bridge makes landfall along the new route for Highway 70. Our plan is to return the Junior Sailing Program and other Boating activities to their original location on Town Creek after the new bridge.is completed. Past permits for this area Include permit # 55-08 issued to the Friends of the Museum on May 18, 1998 for pier, dock, ramp & bulkhead, permit #39-01 issued to the Friends of the Museum on April 5, 2001 for Moorings, and permit #74-09 Issued to the Friends of the Museum on June 4, 2009 for floating docks & davits as well as a recent permit issued to NCDOT (Project R-3307) for construction of the new bridge. This permit application is for the following: 1. A Mooring Field consisting of five (5) moorings connected by chain to 750# Danforth Anchors. These will be used for boats of 20 to 40 feet In length. All moorings will have at least a 52 ft. clear swing radius. Locations will be south of new floats as shown on drawing 1 of 5 attached hereto. These locations are similar to that previously permitted as shown on the old aerial photo used in drawing 1 of 5 and noted "old docks removed". 2. Approximately 200 LF of Marker Barrier constructed with floats (13" diameter x 16" long colored International Orange) connected by yellow polypropylene line spaced five feet apart. This barrier will be anchored with 40# Danforth anchors on each end and a 100# mushroom anchor at the center. This safety barrier will be located approximately 15 ft. south of the new bridge piers - see drawing 1 of 5 attached hereto. The purpose is to keep young sailors, 8-15 year -olds, away from the concrete pile caps that are setting down -wind of the prevailing southerly breezes during the summer. The barrier will be set each year on June 131 and removed on August 201h of each Junior Selling season. 3. The previously permitted boat ramp will be replaced as drown on the attached drawings. This ramp will consist of a bridge approximately 70 LF in length connecting to a concrete ramp approximately 30 LF in length. The bridge section will be a minimum of 3 feet above the mud line. 4. Docks to be installed south of the new bridge at the previously permitted marina site will allow for sailing and rowing programs to once again use the quiet waters of Town Creek located south of the new bridge. 1. The proposed main pier leads off the Boat Ramp Bridge for approximately 64 feet long by 6 That wide with connecting ramp to reach the floating dock system. The float system, configured as a °T",will be used for various boating center activities as well as storage of both 15 ft day -sailors and 8 ft Optimist Pram sailboats on the floats. The end "T" section -west offers storage of up to 8 small sailboats leas than 15 ft. In length as well as a walkway along the outboard (south) side. The "T" section -east provides for storage of 20 Optimist Prams (stacked on end) and room to moor them during the daily training programs. The second dock and ramp connects to a small float providing a launch area for 21 ft sliding seat (SS) rowing hulls and a small float for the Natural Science (NS) Program workboat. 5. The existing upland development (Including the entrance drive, parking area, and waterfront bulkhead wall) will be utilized with the new docks. 6. The original gazebo will be replaced with a similar covered shelter 120'x30'] set a minimum of 30 ft bads from Mean High Water Line, The gazebo shelter will be elevated on piles so as not to block the flow of storm water from the adjacent drainage &wale. NARRATIVE DESCRIPTION: Project Setting The project site is located on the south side of SR 1170 at 250 West Beaufort Road within the Town of Beaufort, Carteret County and is within and adjacent to Town Creek. The site is composed of two adjoining lots totaling 3.14 acres, with 432' along the waterfront, and . elevations ranging from 0' to 5' above the normal high water elevations of Town Creek. The site was formerly owned by the N.C. Maritime Museum and provided a base and marina facilities for the Friends of the N.C. Maritime Museum's Junior Sailing program and other boating programs. The Junior Sailing program teaches sailing to S -15 year old children through the use of the program's fleet of 8' to 15' open day -sailers. The previous facility included a main marina building, an open shelter, an enclosed garage, a main pier with additional floating docks attached to it, a second pier with an attached finger pier, a concrete boat ramp, and multiple mooring buoys. The NCDOT acquired the property through their Right -of -Way acquisition process and currently is in the process of building a new high rise bridge which crosses over Gallants Channel and lands on the property. In order to construct the bents for the bridge and provide a construction staging area, the NCDOT removed the marina facilities, with the intent to reconstruct new marina facilities once the bridge project was complete. A majority of the property has been utilized to construct the bents for the bridge and to provide an area to stage equipment and materials for the project. There is currently a gravel drive that leads from SR1170, under the footprint of the bridge, to a large graveled staging area along the waterfront. The southeastern corner of the property is currently vegetated with shrubs and small trees. A swath of Coastal Wetlands, approximately 30' wide, lies between the open water and the high ground except where the boat ramp from the former facility used to be. Immediately south of the old boat ramp location, a wooden bulkhead, 2' tall and 140' in length, runs along a portion of the waterfront. The property to the east of the project is the site of Town Creek Marina, with multiple docking structures and a bulkhead along the waterfront. The property to the west of the project is still owned by the North Carolina Maritime Museum. The Museum property to the west also has multiple docking structures and is stabilized with riprap along portions of the shoreline.. The new bridge structure will bisect the project site and the property to the west. The Town of Beaufort's Land Use Plan categorizes the area of the project site as Mixed Use, with all AEC's classified as Conservation. Town Creek is classified as SC waters in the area of the proposed construction by the Environmental Management Commission and is part of the White Oak River Basin. The N.C. Division of Marine Fisheries (DMF) has classified Town Creek as Coastal Waters but has not classified it as a Primary Nursery Area. The waters have been closed to shellfish harvesting by the Shellfish Sanitation Section of the DMF. Town Creek is over 1,500' wide in the project area, with water depths to -6' below NLW in the area of the docks, and as deep as -17' below NLW towards the center of the waterway. The bottom consists of fine to course sand. No submerged aquatic vegetation was observed during the site visits to the project. FIELD INVESTIGATION REPORT: NC MARITIME MUSEUM MARINA PAGE #3 Previous permits for the marina facility include CAMA Major Permits #55-98 for the pier, dock, ramp, bulkhead and mooring buoys, #39-01 for the alternative shoreline stabilization project, #74-09 for floating docks and davits, and #48-06 for platforms, floating docks and gangway. NCDOT acquired CAMA Major Permit #37-12 in May, 2012 for construction of the new bridge at the site. Project Proposal The applicants propose to reconstruct the marina facility at the project site after completion of the new bridge. This would be accomplished by constructing a 14' wide x 100' long elevated boat ramp over the bulkhead, and 3' above the Coastal Wetlands, out into the waters of Town Creek. The slatted, wooden ramp would begin 15' landward of the bulkhead, extend for 70' toward the creek, and end with the last 30' constructed of concrete and dipping into the water. . The main pier would begin approximately half way down the south side of the elevated boat ramp. It would be 6' wide x 59' long, with two sets of davits for gigs on it, and lead via a 6' wide x 20' long gangway to a floating platform configured in the shape of a "T". The center float would be 13' 4" wide x 60' long. The floating platform on the northern side of the "T" would be 60' wide and 20'4" long, and the floating platform on the southern side of the "T" would be 60' wide and 16'8" long. The northern float would provide for temporary storage of up to 8 day -sailers less than 15' in length. The float on the southern side of the center float would provide for temporary storage of 20 Optimist Prams, each 8' in length and stacked together on their stems. The floats would also provide a place to tie the day -sailers to during the daily training programs. A second pier would be located on the north side of the elevated boat ramp. It would consist of a 6' wide x 80' long fixed pier in the shape of a "T"'. Two 6' wide x 20' long gangways would lead to a 15' wide x 20' long floating platform and a 10' wide x 20' long floating platform. The floating platforms would be used to launch 21' sliding seat rowing hulls and to provide dockage for a skiff for the Friends' Natural Science Program. The floating dock sections would be placed in water depths between -2' to -6' below the normal low water level and would extend out into the creek a maximum distance of 150' from the existing bulkhead. The dock and pilings would be greater than 15' from the adjacent riparian areas of the neighboring properties and would not extend out beyond the existing pier alignment along the shoreline. The applicants have proposed to place 200 linear feet of marker barrier constructed with polypropylene line and floats (13" diameter x 18" long colored International Orange) spaced on five foot centers between the docks and the concrete bridge bents. The marker barrier is intended to keep 8 —15 year old youth sailors safely away from the concrete bridge bents that would be down -wind of the facility during the summer months. The barrier would be anchored with a 100 pound mushroom anchor in the center and a 40 pound Danforth anchor on each end. The barrier would be set in place on June 1" and removed on August 20's of each Junior Sailing season. Additionally, a mooring field with 5 moorings would be constructed 225' to 370' out from shore and landward of their previously occupied positions. The moorings would each be comprised of a 750 pound Danforth anchor, 52' of rode, and connect to a white mooring ball. The mooring field is designed to moor vessels from 20' to 40' in length. Construction of the in -water portion of the project would be conducted using typical marine pile driving equipment from a barge. The open shelter would be 20' wide x 30' long and would be constructed 30' landward of the bulkhead. The shelter would have a wood floor raised on piles to just above the ground so as not to interfere with water from a nearby drainage swale associated with the new bridge. The applicant has proposed to use porta-potties in association with the facilities. Anticipated Impacts The project would result in 1,070 sq. ft. of high ground disturbance for the open shelter, elevated boat ramp, and piers on an existing impervious surface. The proposed elevated boat ramp and piers would also shade 1,050 sq. ft. of Coastal Wetlands, however, the applicants have avoided the filling or excavation of any wetlands with the design of the boat ramp. The piers and floating platform would also shade and usurp 4,664 sq. ft. of Estuarine Waters, while the mooring field would usurp an additional 121,580 sq. ft. of Estuarine Waters. The mooring field and docks would be greater than 15' away from the riparian areas of the neighboring lots and the moorings would be located less fhan 1/3 the way across the waterbody. The marker barrier would be placed out of the navigational channel and area of traditional navigation, however, it would result in a slight impact to navigation in that any fishermen wanting to fish around the three bents protected by the marker barrier would have to navigate around the marker barrier. The marker barrier would be at least 15' from the bridge bents and would allow boats access around all areas of the bents. The docks would not extend beyond the existing piers along the shoreline or create any navigational hazards. Dredging would not be required for the project and bottom disturbance during boat slip usage is not expected due to the existing water depths in the -2' to -6' range below NLW. Although the marina facility would create temporary storage for up to 28 open day -sailers on the floats during the summer training sessions, as well as moorings for 8 skiffs used in association with the training programs, the small and open nature of the boats to be utilized are not expected to cause additional impacts beyond the traditional and ongoing boating activities in the area. There are no anticipated impacts to any submerged aquatic vegetation from the facilities and no additional closures' of shellfish waters are expected with the project. A localized and temporary increase in turbidity can be expected during the in -water portions of the construction of the docks. The project would benefit the youth in the community with the educational opportunities afforded by the facility. The project is located on the south side of SR1170 (West Beaufort Road) approximately 1,500' west of SR 1174 (Turner St.) and is within and adjacent to Town Creek in Beaufort, Carteret County, North Carolina. A request from Mr. Brent Creelman representing the North Carolina Maritime Museum to modify the CAMA permit #-83-16 issued to N.C. Maritime Museum and NC Department of Transportation was received in this office. The applicant is proposing to reconfigure what was previously found consistent under the US Army Corps of Engineers RGP-291 process (SAW- 2016-00740). All previously permitted docks would remain the same except for the removal of the most western pier and the construction of a 6'x 100' pier along the east side of the boat ramp. A 6'x 10' shorter finger would extend from the proposed 6"x100' pier west towards the boat ramp. They are also proposing 2 new sheds (8'x8' and 9'xl2') 15' to 25' landward of normal high water. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. The proposal was found to be consistent with the provisions and objectives of the CAMA-Corps Programmatic General Permit 291 process for construction activities that receive authorization from the State of North Carolina. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the water body is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. He sent me to you....... We received a CAMA permit back in 2016 to build docks and a ramp on the DOT land at the base of the bridge. Recently we received an executed Encroachment Agreement. We would like to modify the CAMA permit and need DOT's approval for the change. We had the main pier joining the ramp pier. This change request involves running the pier to the shoreline. We would like to do that pier first, so that prompts the modification request. Both are pictured on the attached. Also doing away with one pier and adding little storage sheds.
