BISER Secretary BRAXTON DAVIS Director September7, 2022 NORTH CAROLINA Environmental Quality Town of Emerald Isle Joel Lane Public Street Access C/O Michelle Eitner, Town of Emerald Isle Between the addresses of 5005 and 5003 Ocean Drive Emerald Isle, NC 28594 RE: EXEMPTED PROJECT - STRUCTURAL BEACH ACCESSWAY (15A NCAC 7K .0207) PROJECT ADDRESS — Joel Lane Public Beach Accessway, Emerald Isle OCEAN HAZARD AREA OF ENVIRONMENTAL CONCERN Dear Town of Emerald Isle: I have reviewed the information submitted to this office in your inquiry concerning the necessary fling of an application for a minor development permit under the Coastal Area Management Act. After making a site inspection on September 06, 2022,1 have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated "received DCM-MHD City September 07, 2022", and meets the conditions specified below. If you plans should change and your project will no longer meet these conditions, please contact me before proceeding. STRUCTURAL ACCESSWAY EXEMPTED 1. The accessway must not exceed six feet in width and shall provide only pedestrian access to the ocean beach. 2. The accessway must be constructed so as to make negligible alterations to the frontal dunes. This means that the accessway must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any alteration to the dunes. In no case shall the frontal dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. 3. Construction of the accessway shall be consistent with all other applicable local ordinances and N. C. Building Code standards. 4. No portion of the structural accessway authorized by this exemption shall extend greater than 6' oceanward from the oceanward toe of the dune. 5. All construction shall be consistent with the existing footprint of the accessway with no additions or expansions to the existing footprint. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date of the letter. I hope you're not too worse for wear over it! The Town has removed the beach access structure at the "Joel Lane Public Beach Access" (oceanfront access between 5003 and 5005 Ocean Drive) and intends to replace it in the same footprint with a new stairway structure (contractor's building plan attached). To my knowledge, a survey or site plan was not prepared for this project prior to demolition. We'd like to request an exemption letter to install the replacement beach access structure under 07H .0308(c). Please let me know if any additional information is needed. In the past at AB, I would coordinate the permitting process through Heather (field rep at the time) and just send her project information via email like this to request an exemption letter. How would you prefer these requests occur in the future? As an additional component to our request for exemption letter, please find the attached informal site plan showing the footprint of the stairway to be replaced. I used the pictometry function on GIS and found it to be very helpful to show the change in elevation that the stairway accommodates for, in addition to the topographical contour lines. Learn why this is important Be Advised: This email originated from outside of the Town of Emerald Isle, NC Michelle, Spoke to Curt Weychert today and Ryan Davenport about CAMA permits for the walkway on Joel Lane. Wanted to touch base with you and determine the plan for Joel Lane since I haven't been able to get a clear answer and was quite shocked this AM when I went for a walk and returned unable to walk down the Joel Lane walkway (such as it was) with a crew ripping it all out. When I returned to my home and computer I saw an email from Matt stating Joel Lane walkway was being replaced for $19,200. Didn't get any more information though there were numerous emails from the area residents and homeowners about what was being done.
