Authorizing development in Dare County ad! to boat ramp within Wanchese Harbor, near Lot
12A 708 Harbor Rd., in Wanchese as requested in the permittee's application dated 8/31/21,
including attached %vorkolan drawing (2), Sheets 1-2 of 2 both dtd 8/30/21.
This permit, issued on November 16, 2021 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Excavation
1) A turbidity curtain shall be left between the area to be excavated and the existing waterbody, the silt
screen shall be left in place after completion of excavation until the project areas has returned to
ambient conditions.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -5.5 below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires oil
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITTIONAL CONDITIONS
The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels lubricants hydraulic fluids or other toxic materials. In the event of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
National Response Center at .(800) 424-8802 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
Dredge Material Disposal
No dredge material shall be placed within 30 feet of the normal water line.
7) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.
8) The dredge material disposal area shall be inspected and approved by a representative of the Division of
Coastal Management prior to the commencement of any dredging activities.
Maintenance Clause
9) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for dredge material disposal, and the estimated amount of material to be removed.
The location, design and holding capacity of the dredge material disposal site shall be approved
by a representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
USACE Conditions
10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

ADDITIONAL CONDITIONS
13) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
14) This Major Modification shall be attached to Permit No. 100-16, which was issued to the permittee on
11/22/16, as well as all subsequent modifications, refinements, and renewals, and copies of all
documents shall be readily available on site when a Division representative inspects the project for
compliance.
15) All conditions and stipulations of the active permit remain in force, under this Major Modification,
unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2016-00821.
NOTE: The Division of Water Resources assigned the proposed project D WR Project No. 2016-0352 Q.
NOTE: An application processing fee of $250 was received by DCM for this project.

SUBJECT: Recommendations for NC Wanchese Marine Industrial Park (Major
modification to #100-16 issued to NC Seafood Industrial Park Authority)
The NC Wanchese Marine Industrial Park proposes to conduct minor dredging
waterward of the existing boat ramps located off 708 Harbor Road, Wanchese, Dare
County in the waterbody of Broad Creek. The excavation area is 90'x100'x-.75', with
the amount of excavation totaling 187 cubic yards (cy). The 50'x40' disposal area for
the dredge spoil is proposed to be outside of the 75' AEC on the existing parking lot
adjacent the ramps.
The development proposal involves the Estuarine Waters (EW) and Public Trust Areas
(PTA) AECs, with the high ground disturbance sited outside of the CAMA AECs.
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain
to this proposal, and my findings areas follows:

(d) Use Standards. Suitable land/water uses shall be those consistent with the
management objectives in this Rule. Highest priority of use shall be allocated to the
conservation of estuarine waters and their vital components. Second priority of
estuarine waters use shall be given to those types of development activities that require
water access and use which cannot function elsewhere such as simple access
channels; structures to prevent erosion; navigation channels; boat docks, marinas,
piers, wharfs, and mooring pilings. In every instance, the particular location, use, and
design characteristics shall be in accord with the general use standards for coastal
wetlands, estuarine waters, and public trust areas described in Rule .0208 of this
Section.

15A NCAC 07H .0207 PUBLIC TRUST AREAS
(c) Management Objective. To protect public rights for navigation and recreation and to
conserve and manage the public trust areas so as to safeguard and perpetuate their
biological, economic and aesthetic value.
(d) Use Standards. Acceptable uses shall be those consistent with the management
objectives n Paragraph (c) of this Rule. In the absence of overriding public benefit, any
use which jeopardizes the capability of the waters to be used by the public for
navigation or other public trust rights which the public may be found to have in these
areas shall not be allowed. The development of navigational channels or drainage
ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or
marinas are examples of uses that may be acceptable within public trust areas,
provided that such uses shall not be detrimental to the public trust rights and the
biological and physical functions of the estuary. Projects which would directly or
indirectly block or impair existing navigation channels, increase shoreline erosion,
deposit spoils below normal high water, cause adverse water circulation patterns,
violate.water.quality standards, -or cause degradation.of shellfish waters are considered
incompatible with the management policies of public trust areas. In every instance, the
particular location, use, and design characteristics shall be in accord with the general
use standards for coastal wetlands, estuarine waters, and public trust areas.

(a) General Use Standards
(1) Uses which are not water dependent shall not be permitted in coastal
wetlands, estuarine waters, and public trust areas. Restaurants, residences,
apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are
examples of uses that are not water dependent. Uses that are water dependent
include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging,
bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational
aids, mooring pilings, navigational channels, access channels and drainage ditches;
(2) Before being granted a permit, the CRC or local permitting authority shall
find that the applicant has complied with the following standards:
(A) The location, design, and need for development, as well as the construction
activities involved shall be consistent with the management objective of the Estuarine
and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and
designed to avoid significant adverse impacts upon the productivity and biologic
integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined
by the Marine Fisheries Commission, and spawning and nursery areas;
(B) Development shall comply with state and federal water and air quality
(C) Development shall not cause irreversible damage to documented archaeological
or historic resources as identified by the N.C. Department of Cultural resources;

(E) Development shall not create stagnant water bodies;

estuarine and ocean resources; and
(G) Development shall not jeopardize the use of the waters for navigation or for other
public trust rights in public trust areas including estuarine waters.
Consistent: The project will. improve and maintain an existing access to the
waters of Broad Creek for the safe launching and retrieval of large boats at the
marina. This proposal will not impede the use of publictrust waters.

as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation
as defined by the.MFC, or areas of coastal wetlands except as otherwise allowed within
this Subchapter. Navigation channels, canals and boat basins shall also comply with

fringes of regularly and irregularly flooded coastal wetlands if the loss of wetlands will
have no significant adverse impacts on fishery resources, water quality or adjacent
wetlands, and if there is no reasonable alternative that would avoid the wetland losses;
(B) All dredged material shall be confined landward of regularly and irregularly flooded
coastal wetlands and stabilized to prevent entry of sediments into the adjacent water
bodies or coastal wetlands; (F) Any canal or boat basin shall be excavated no deeper
than the depth of the connecting waters; (1) Maintenance excavation in canals, channels
and boat basins within primary nursery areas and areas of submerged aquatic
vegetation as defined by the MFC shall be avoided.
Consistent: The development proposed for the minor dredging adjacent the
existing boat ramp(s) is a water -dependent use, and will not impact wetlands, SAV
species, shellfish beds, or primary nursery areas. The dredge spoil area is located
outside of the Coastal Shorelines 75' AEC. The project meets the Use Standards
and is consistent with these rules. - .
Based on my review of the applicable subsections of the North Carolina
Administrative Code, the permit application, and plans submitted by Quible &
Associates for the NC Wanchese Marine Industrial Park, 1 recommend a. Major
Modification Permit be issued to the applicants based on their current proposal,
subject to the standard permit conditions.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the permit application for proposed actions that may impact fish and/or fish habitats.
The proposed work is located at 708 Harbor Road, Wanchese, within Dare County. The
applicant is proposing to modify an existing permit (MP #100-16) to conduct minor dredging
waterward of the existing boat ramps at this location. There has been minor shoaling in the
project area, preventing safe access for vessels. The applicant is proposing to excavate 9,000
square feet, totaling approximately 187 cubic yards (CY) of material. The maximum amount of
material would be 250 CY. The material will be disposed at a site within the project location
approximately 115' to 120' landward of the normal water line (NWL). Once the material is dry,
the applicant plans to move the material to another upland area.
Taking into consideration the limited scope of the proposed work and the lack of any designated
habitat types in the project area, DMF will not request any timing restrictions on the work.
However, DMF will request that sedimentation and turbidity control measures, such as the use of
a turbidity curtain, be included in the conditions of the permit. The turbidity curtain should be
left in place for 72 hours following completion of the excavation, as this will allow sediment to
resettle after the disturbance. Inclusion of these measures will minimize the potential for excess
turbidity and sedimentation outside of the project area.

Consistency Determination: The request is consistent with/not in conflict with the Dare
County 2009 Land Use Plan certified by the CRC on February
24, 2011.
Overview: The NC Wanchese Marine Industrial Park is located on 54 acres adjacent to the
Wanchese Harbor Basin, a manmade basin which adjoins Mill Landing Creek, and west of Broad
Creek off the Roanoke Sound. The project area includes leasehold Lot 12A, a .83 acre tract with
approximately 200 linear feet of shoreline along Broad Creek. Elevations on Lot 12A are
approximately 6 feet above Normal Water Level (NWL). Vegetation on the lot consists of grasses
and Phragmites. Water depths adjacent to the lot range from -4.6 feet to -5 feet with an average
depth of -4.75 feet. The connecting depth is -5.5 feet.
The site is paved with little vegetation. Existing shoreline improvements consist of two (2) boat
ramps with finger piers. Minor shoaling has occurred in front of the boat ramps.
CAMA Major Permit #100-16 issued in November 2016 authorized construction of a 28-slip
marina facility with a wave attenuator/breakwater and access pier. A portion of the facility extends
in front of the lot. None of these improvements have been constructed to date. The permit expires
on 12/31/2021.
Dredging of a 90 foot by 100 foot area to an average depth of -.75 feet to maintain a -5.5 foot
depth is proposed. Dredging would occur waterward of the, boat ramps. Dredging will be
conducted using a long -reach excavator and barge(s). A 50 foot by 40 foot disposal area will be
located on the paved area 115 to 120 feet landward of NWL. Silt fencing or straw bales are
proposed to contain the spoil. Once dry, the material will be moved to another upland area owned

by the park. A 110 foot long catamaran with the potential to weigh 330,000 pounds when fully
loaded is currently under construction at the Park. The dredging will ensure safe launching and
retrieval of the catamaran and other boats that require a minimum -5 foot of depth to launch.
The waters of Broad Creek are classified as Coastal Waters, and SA waters and High Quality
Waters (HQW) and are closed to shellfish taking. A review of historic, cultural and/or
archaeological resources was not provided. There was no presence of Submerged Aquatic
Vegetation (SAV) found within the project area.
Anticipated Impacts resulting from this project are expected to include: the dredging of .2 acre of
Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and the filling of 2,000
sq. ft. of High Ground outside of an AEC.
Basis for Determination:
The Dare County Land Classification Map identifies the subject property as "Community Village".
As indicated on Page 217, the "Conservation" designation applies to all CAMA Areas of
Environmental Concern (AECs).
As indicated on Page 211 for the "Community Village" sub -classification... "Water -related land
uses and facilities such as boat building, fishing, fish processing and crabbing are characteristic
of this sub -class..."
As indicated on Page 217 for the "Conservation" designation, "...development should be limited
to residential development and traditional accessory uses permitted in the CAMA AECs such as

Proiect Settin
The NC Wanchese Marine Industrial Park is located off Mill Landing Road (SR #345), on
Harbor Road in Wanchese, Dare County. The project is sited at Leasehold 12A, 708
Harbor Road, adjacent to Broad Creek. The total shoreline for Leasehold 12 and 12A is
approximately 385 linear feet (If). The tract for the boat ramp area is under one acre at
35,994 sf. The property has an elevation of 6' above normal water level (NWL). Vegetation
in the project area consists of indigenous grasses and Phragmites. There is no wetland
vegetation within the project area. The existing man-made features on Leasehold 12A
consists of 2 boat ramps with finger piers and concrete parking. Leasehold 12 is developed
with a commercial building, concrete parking, 2 piers, finger piers, slips, 2 boat lifts, and a
remnant breakwater. There was notable erosion along the shoreline between the pier on
12 and the small boat ramp on 12A.
The existing land uses immediately adjacent to the project site consist of boat building
operations, boat storage areas, and marina. The adjacent riparian property to the northeast
is an undeveloped lot that is noted as marsh acreage. The adjacent riparian property to the
southwest is developed with a bulkhead, shoreside dock and tie pilings along the dock.
The adjacent waterbody is Broad Creek, which connects to the Roanoke Sound; these
waters are classified as Coastal Waters and are in the Pasquotank River Basin. The
Division of Environmental Management's water classification for these waters are SA and
High Quality Waters (HWQ). The vicinity of the project is a permanent shellfish closure
area per Shellfish Sanitation. The water depths range from -4.6' to -5', with an average
existing depth of -4.75' and a connecting depth of -5.5'. There was no presence of SAVs
found within the project site.
Bailey Marina, c/o the NC Seafood Industrial Park Authority (NCSIPA), was issued Major
Permit (MP) #140-03 on 09/30/2003 for Lot 12 for development that included a 28-slip
marina with a wave attenuator/breakwater. The associated DWQ Project No. was 030396,
which was issued on 07/08/2003. The associated USACE Action ID No. was 20031053.
On 10/2512012, this MP was modified to authorize the construction of a 40-wide boat ramp
with associated bulkheading. MP 140-03 received another minor modification on
08/15/2013 for the reconfiguration of the docking facility and breakwater, and expired on
12/31/2016.
CAMA MP #100-16 was issued to the NCSIPA on 11/22/2016 for a 28-slip marina facility
with a breakwater. Project numbers DWR 16-0352 and USACE SAW Action ID 2016-
00821 were assigned. The approved pier starts on Leasehold #10, and extends southwest
in front of Leasehold areas numbered 11, 12, 12A and 13. MP 100-16 was renewed on
12/20/2019, with an expiration date of 12/31 /2021. It is noted that none of the
pier/slips/breakwater have been constructed to date. RECEIVED

Development Proposal
The applicant's proposal is to modify MP #100-16 to conduct minor dredging waterward of
the existing boat ramps, using a long -reach excavator and barge(s). There has been minor
shoaling in the project area, and boats that draw -5' of water would not be able to safely
access this area. A specific vessel, a 110' catamaran with the potential to weigh 330,000
pounds fully loaded, is currently under construction at the Park, and is set to launch in
March of 2022. The purpose of this dredging request is to ensure safe launching and
retrieval of large boats, such as this catamaran that will require a minimum of -5' to launch,
as well as others under construction.
The excavation area is 90 If x 100 If, with an average dredge depth of -.75 to maintain a -
5.5 depth based on NWL. Based upon water depths taken using an echosounder with
Quible & Associates' survey -grade GPS system, the total amount of excavation will consist
of 187 cubic yards (cy) of sand dominated material. (It is noted that the maximum amount
of excavation based on measurements would be 250 cy.) The disposal area for the dredge
spoils is proposed at the onsite parking lot adjacent the boat ramps. It is noted that the
50'x40' disposal area is between 115' to 120' landward of NWL, and is outside of CAMA's
75' AEC. Silt fencing or straw bales are proposed to contain the spoil. Once the sand
material is dry, the applicant plans to move the material to another upland area owned by
the Park.
Anticipated Impacts
Estuarine Waters — Public Trust Areas AEC - A total of 9,000 sf of Shallow Bottom habitat
will be impacted during the proposed excavation.
High Ground (outside of the CAMA AECs) — A total of 2,000 sf of high ground will be
impacted at the proposed disposal area.

Project Narrative
The Site is an approximately 35,994 sq. ft. leasehold parcel of land located along Harbor Road
and owned by the N.C. Wanchese Marine Industrial Park (a subsidiary of the NC Marine
Industrial Park Authority) in Wanchese, Dare County, North Carolina. The parcel of land within
the Park (Lot 12A) is located adjacent to the Roanoke Sound (Broad Creek). The Site is
dominantly covered with compacted gravel parking, driveway and boat ramp access. There are
two existing boat ramps on this parcel. The smaller one was constructed sometime around
2005. The larger ramp is a larger commercial/industrial ramp which was constructed in late
2012- early 2013. The larger ramp was permitted (modification to CAMA Major 140-03) to
launch large vessels built and/or worked on in the Industrial Park. This ramp was important to
the NC Department of Commerce who had identified boat building tenants to the Park, which is
a source of skilled job creation to the area. This Site, along with Lot 12, was the subject of
CAMA Major Permit 140-03 that included piers/docks (built around 2005). That permit, while it
was active, was able to be modified for the large industrial ramp. In 2016, CAMA Major Permit
100-16 was issued in this area on Broad Creek as the earlier permits were expiring. CAMA
Major 100-16 included a breakwater and pier system with dockage. A copy of 100-16 and
renewal along with the permit plan is included as part of this Modification request. It was
determined by NCDCM that the preferred way to handle this currently proposed work is to
modify 100-16. None of the breakwater and pier system work covered in 100-16 has been
constructed, but the Industrial Park Authority does have future plans for this. The work that is
now requested to be permitted would not impact anything that has already been permitted.
Since construction of the larger ramp in 2012-2013, there has been some minor shoaling in the
proposed dredge area presented on the accompanying CAMA Plan. On average, there has
been about 0.75 ft of material that has filled in within the proposed dredge area. The connecting
water depths are at least -5.5 ft deep based on NWL. The goal of this permit is to be able to
maintain the -5.5 ft depths within the proposed dredge area. At this time, this would only require
excavation of 187 cu yds of sand dominated material. Water depths shown on the CAMA plan
were collected using an echosounder with our survey -grade GPS system. The excavation work
will be performed with a long reach excavator using a clamshell bucket. Material from the
excavator bucket will be transferred onto a material (hopper) barge with sides. Use of a
clamshell bucket minimizes the amount of bottom disturbance and the amount of water
transferred to the barge is minimal. Some runoff will occur from the hopper barge via slots or
weep holes. The barge will be moved inside of the ramp where a second excavator will transfer
the material to the stockpile area (shown on plan). Dried material will then be moved to an
upland area within the Park.
The Park currently contains several boat building operations and the Park has been catering to
the new potential tenants, including boat builders and charter fleets. This minor dredging and
the ability to maintenance dredge in the future will ensure safe launching and retrieval of boats.
The reason that this permit is being pursued now is for a specific vessel, however, other large
boats that draw 5.0' of water are also under construction in the Park and others will be
constructed in the future. As part of this submission, I have included an article about the boat
under construction, which is set to launch in March 2022. On August 26, 2021, Quible
representatives toured the vessel under construction with the boat builder, Bob Peele (Director
of the Wanchese Marine Industrial Park) and Yvonne Carver (NCDCM field representative).
We have reviewed the bottom of the creek for the presence of SAV. No rooted SAV has been
encountered this summer within the project area, and, for our previous ramp permitting work, no

The NC Division of Coastal Management hereby acknowledges receipt of your application
submitted for State approval to excavate waterward of the existing boat ramp(s) located adjacent
to Leasehold 12A, 708 Harbor Road, Wanchese in Dare County.
It was received complete September 7, 2021 and appears to be adequate for processing at this time.
The projected deadline for making a decision is November 21, 2021. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 7,2021, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed

Marina Facility
1) The construction and/or operation of the authorized marina facility shall not directly result in any
closure of any waters that are open to the taking of shellfish. Any such closure directly attributable to
the marina facility shall require that the permittee undertake remedial actions to remedy the situation.
Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative
treasures to reduce or eliminate the cause(s) of the closure.
2) In order to protect juvenile shrimp and finftsh populations, no in -water work shall be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.

ADDITIONAL CONDITIONS
3) This permit authorizes the construction a walkway, a fixed pier, finger piers, and a breakwater, and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, shall become a permanent part of this marina facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina facility. Any sewage discharge at the marina facility shall be considered a violation of this permit
for which the permittee is responsible. This prohibition shall be applied and enforced throughout the
entire existence of the permitted structure.
5) Any portion of the permitted access pier and marina facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
6) This permit authorizes a maximum of twenty-eight (28) formalized boat slips.
7) The marina facility shall display a sign showing the location of the Seafood Industrial Park's pumpout
facility, including other appropriate waste disposal information, at the entrance and exit from the main
pier(s).
8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structures in order to make it more visible during hours of darkness or
inclement weather.
9) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation.
Breakwater
10) The breakwater shall be constructed with an equal gap between each sheathing board totaling at least
one inch of open area for every linear foot of breakwater. The breakwater shall have at least one, five
foot opening at every 100 feet. The breakwater sections may be staggered and overlap as long as the five
foot separation between sections is maintained. Overlapping sections shall not overlap more than 10
feet.
11) The permitted breakwater shall be constructed of treated wood, plastic lumber, metal sheet piles or other
suitable materials approved by Department personnel.

ADDITIONAL CONDITIONS
13) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
16) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
17) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project and assigned SAW 2016-
00821.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3900 and assigned the project DWR Project No. 16-0352.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The pennittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
