'This permit, issued on December 16: 2016 is subject to compliance with the application (where consistent
wfh'the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
bes'ubject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Fishing Pier Facility
This permit authorizes only the pier and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this fishing pier facility without permit modification. No
non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

ADDITIONAL CONDITIONS
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
Shoreline Stabilization
In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no
excavation_or filling shall be permitted between February.15 and June 30 of any year without the prior
approval of the Division of Coastal Management, in consultation with appropriate resource agencies.
The alignment of the permitted rip rap shall be verified by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction.
The rip rap material shall consist of clean rock or masonry materials such as, but not limited to, granite,
marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the site by wave or
current action.
Upland Development
Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the access road, parking
area, concrete sidewalk, and other associated infrastructure, all as expressly and specifically set forth in
the attached permit application and workplan drawings.
Sedimentation and Erosion Control
Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property.
In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
Aground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes.
General
The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
No excavation or filling of any vegetated wetlands is authorized by this permit.

ADDITIONAL CONDITIONS
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written consent of the Division of Coastal Management.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
TE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
TE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic
General Permit 198000291 and assigned the project Action ID No. SAW-2016-02201.
TE: The N.C. Division of Water Resources authorized the project by way of General Water Quality
Certification 3900 and assigned the DWR Project No. 2016-1052.
TE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
An application processing fee of $400 was received by DCM for this project.

The proposed project will develop the site into a free public fishing access area to include parking, ADA parking, accessible
concrete path, fixed wooden fishing pier, and shoreline stabilization

of equipment and where it is to be stored.
Portions of the existing infrastructure will be demolished to allow construction of the parking and sidewalk, the grading will be
completed with a back hoe, excavator, and dumptruck. The piles for the wooden opier and walkway will be installed with a
vibratory hammer mounted on an excavator supported on land or barge. Equipment will be stored on site.

Demolish a portion of the existing infrastructure, grading for access road, parking lot, sidewalk, drainage, and shoreline
stabilization. Install and grade CABC stone for the access road and parking area. Establish vegetative cover on soil areas.
Place Class II stone for shoreline stabilization. Pour concrete for ADA parking and sidewalk. Drive pilings for pier and
walkway. Construct wooden fishing pier and walkway.

b. An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale. Please give the present status of the
proposed project. Is any portion already complete? If previously authorized work, clearly indicate on maps, plats, drawings to distinguish

The North Carolina Wildlife Resources Commission has submitted a Major CAMA application on
behalf of the Town of Murfreesboro to rip rap 180ft of shoreline, construct a 102ft by 6ft pier with an 8ft
by 60ft platform, fill a collapsed ravine, and construct a parking lot. Staff has reviewed the proposed
project with regard to rules found in Subchapter 7H concerning development in Coastal Shorelines. It is
staffs recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 and
15A NCAC07H.0209. The pier and platform will extend less than a %4 width of the waterbody and will
not exceed 2,000 sq ft. The upland development will create 26% of impervious surface within the
Coastal Shoreline AEC. During construction of the project no wetlands will be impacted.
If the permit is issued, staff would suggest that the standard permit conditions be included.

Overview: The 2.41 acre subject property has approximately 281 linear feet of shoreline along
the Meherrin River. The river ranges from 150 feet to 350 feet wide at this location with water
depths at -10 feet to -15 feet below Normal Water Level (NWL) a distance of 38 feet from shore.
A washed.out ravine is located along a portion of the shoreline. The site is elevated an average
of 12.5 feet above NWL. The site is primarily vegetated with brush and grass with some trees
along the river and to the south and east. The property is primarily within the AE Floodzone,
with some areas outside of the floodzone. Existing site improvements consist of a 100 foot by
300 foot (.69 acre) concrete building pad, concrete retaining walls, accessory concrete pads, a
culvert and an access road. Existing shoreline improvements consist of remnant concrete
bulkheads.
Installation of 180 linear feet of riprap and a 6 foot wide by 102 foot long pier extending to an 8
foot wide by 90 foot long fishing platform on the Meherrin River and construction of a 26 foot
wide by 94 foot long access road, a nineteen (19) space parking area and a 6 foot wide
sidewalk are proposed. Riprap will be installed 2.5 feet deep over filter fabric. The toe of the
riprap will extend 5 feet waterward of NWL. The pier and platform will be pile supported and will
include a railing system. The access road will be realigned and resurfaced with stone. Two (2)
of the parking spaces will be concrete for handicapped accessibility. The 6 foot wide sidewalk
will provide an accessible route from the parking area to the walkway and fishing platform. Spoil
associated with highground and river bottom excavation will be used to fill the ravine. The
existing culvert will be replaced and some portions of concrete retaining walls will be removed.

The site is being developed for public water access with financial assistance from the NC
Wildlife Resources Commission and through DCM's Public Beach and Coastal Waterfront
Access Grant Program.
The waters of the Meherrin River are classified as B-NSW and as Joint Anadromous Fish
Spawning Area at this location and are closed to shellfishing. A review of Submerged Aquatic
Vegetation (SAV) was not provided. The site is downstream from the Murfreesboro Historic
District and historical site HF-85 is nearby.
Anticipated Impacts resulting from this project are expected to include: the filling of 900 sq. ft. of
Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), and .85 acre of
uplands, and; the shading of 1,332 sq. ft. of Public Trust Area/Estuarine Waters AEC.
A portion of upland fill will be located in the Coastal Shoreline AEC.
Basis for Determination:
The Hertford County Land Classification Map identifies the site area as "Developed". As
indicated on Page 69, these areas generally have access to full community services and fall
within municipal corporate limits, Extraterritorial Jurisdictions, or along major transportation
corridors.
As indicated on Page 70 for "Areas of Environmental Concern", "(a)ny development impacting
the Chowan River Shoreline and Estuarine system AEC shall follow all applicable state and
federal regulations, policies, and rules that pertain to any development requiring a CAMA
permit."

The Division of Water Resources (DWR) has received a copy of your CAMA Major application modification
request. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the
CAMA Major Permit and General Permit(s)198000291 issued by the US Army Corps of Engineers (USAGE).
This Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it.
In accordance with the attached General Certification #3900 (GC3900), the impacts described in your
application do not require written authorization to utilize GC 3900. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at htto://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received
in the OAH during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding
official state holidays).
The petition may be faxed to the OAH at (919) 431-3100, provided the original and one copy of the petition
along with any applicable OAH filing fee is received by the OAH within five (5) business days following the
faxed transmission.

On October 27, 2016, the Washington Regional Office of the Division of Energy, Mineral, and Land
Resources received a copy of your CAMA Major application for the subject project located at Hart Street
in the Town of Murfreesboro, NC. Staff review of the plans and supporting documents has determined
that the project proposes activities that are excluded from State Stormwater permitting requirements as
set forth in Section 2.(d)(3) of Session Law 2008-211, effective October 1, 2008, and the stormwater
rules under Title 15A NCAC 2H .1000, as amended.
Therefore, the Division of Energy, Mineral, and Land Resources is hereby providing confirmation that the
subject project is excluded from State Stormwater permitting requirements under the following
conditions: 1) The project must be constructed as shown on the plans submitted to this Office; 2) The
project, proposes no net increase in impervious area; and 3) The proposed stormwater control, provides
equal or better protection of surface waters then the existing stormwater control.
Under Section .1003(b) of the stormwater rules, the entire common plan of development must be
permitted. Therefore, any future development or changes to the proposed development, including but
not limited to, the locations of the built -upon area and construction of additional built -upon area, may
require approval or a Stormwater Management permit application and permit issuance from the
Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on the site
prior to receipt of the required approval or permit will constitute a violation of Title 15A NCAC 2H.1000
and Session Law 2008-211, and may result in the initiation of appropriate enforcement action.

and approvals, which may be required by Federal, State, or local government agencies, rule or law. If

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The Town of Murfreesboro
proposes to construct a fishing pier with handicap accessible ramps and rip -rap the shoreline at a previously
developed site on the Meherrin River in Hertford County. From the parking lot there will be a 6' wide
concrete ADA accessible sidewalk leading to a 6' x 102' pier ending with an 8' x 90' fishing platform. The
shoreline will be stabilized with 180'ft of rip -rap with a toe extending 5' waterward of NWL. Some level of
high ground and river bottom excavation will be required for proper grading of the handicap ramp and
placement of the rip -rap.
The Meherrin River at the location of the project in the Town of Murfreesboro is classified as an Anadromous
Fish Spawning Area (AFSA) by the Marine Fisheries Commission. The AFSA classification Identifies the
waterbody as critical spawning habitat for anadromous fish such as river herring, shad, and striped bass. In
order to reduce the potential for disturbance to migrating and spawning fish from activities such as pile
driving, rip -rap placement, and river bottom excavation a moratorium on in -water work from February 15 —
June 30 should be observed.

PROJECTSETTING
The North Carolina Wildlife Resource Commission has submitted a Major CAMA permit request on
behalf of the Town of Murfreesboro for the construction of a fishing pier on the Meherin River at
the end of Hart Street off US158 business in Murfreesboro, Hertford County.
The 2.41acre site currently has remnant concrete pads from previous development. The site is
downstream from the Murfreesboro Historical District and historical site BF-85 is located nearby.
The site has some remnants of old bulkheads. The adjacent upstream property is a cemetery and not
bulkheaded and the downstream property is wooded and not bulkheaded.
The Meherrin River is classified as B; NSW by the Environmental Management Commission and as
a Joint Anadromous Fish Spawning Area by the NC Marine Fisheries Commission and Wildlife
Resources Commission. The Mehenin River is closed to shellfishing at the project location. Water
depths at the end of the pier range from-10'NWL to-15'NWL and the Meherrin River is 150ft to
350ft (to the shoreline of the turning basin) wide at the project site.
PROJECT DESCRIPTION
The applicant proposes to redevelop the project site by constructing a 6ft wide concrete ADA
accessible sidewalk from the parking area to the proposed 6ft by 102ft pier ending with an 8ft by 90ft
fishing platform. The eastern edge of the pier is located 15ft from the eastern riparian line. The
shoreline will be stabilized with 180ft of rip rap, with a toe extending 5ft water ward of NWL.
During the installation there will be some excavation of high ground and river bottom. This impact is
from normal construction practices and is not for navigation. The spoil will be used to fill a collapsed
ravine on the project site after replacing the culvert on the property. The applicant is also proposing
19 parking spaces (2 ADA accessible), two of which will be concrete and the other 17 will be CABC
stone. Approximately 26% of the coastal shoreline AEC will be impervious (including existing pads)
while 46% of the entire site will be impervious.
ANTICIPATED IMPACTS
The project will result in localized turbidity due to the construction of the pier, fishing platform and
installation of the rip rap. The construction of the pier and platform will shade 1,332 sq ft of river
bottom, and the installation of the rip rap will convert 900sq ft of soft bottom to rip rap.

formed a partnership to develop the site known as King's Landing, acquired in 2013 by
the Town, into a free public fishing access area. Improvements to the site will include an
access road, parking area, concrete sidewalk, a fishing pier, and shoreline stabilization.
The existing access road will be re -aligned to more efficiently access the parking
area. A construction entrance will be installed as shown on the plans. The access road is
approximately 26' wide by 94' long and will be surfaced with 6" of CABC stone.
The parking area consists of 19 total parking spaces; two of which are van
accessible ADA spaces. The surface will be 6" of CABC; except the accessible spaces
and lift area which will be 4" of 3,000 psi concrete with fiber mesh.
A 6' wide concrete sidewalk will provide ADA compliant access from the parking
area to the proposed fishing pier. The sidewalk will parallel the existing main building
pad on the western and northern perimeter. This route will require appendages to the
main building pad to be demolished. This route facilitates meeting the required ADA
accessibility guidelines. As a result of this accessible route 19 cubic yards of excavation
for the sidewalk is required on the northern perimeter of the building. Additionally, a
small portion of the sidewalk (triangular shaped, 0.57' X 5.86') will be within the 30'
CAMA buffer. This intrusion into the buffer is unavoidable while maintaining
compliance with the ADA access route guidelines.
The fishing pier will be an 8' X 90' wooden structure accessed by a 6' X 102'
wooden walkway. The pier and walkway will be pile supported and include a 42" railing
system. To accommodate users with disabilities the walkway includes a switchback to
ensure an accessible walking surface slope. Additionally, one-fourth of the fishing pier
railing system will accommodate individuals with disabilities.
One hundred and eighty feet of shoreline will be stabilized with Class II rip rap
2.5 feet deep over filter fabric. The bottom of the shoreline stabilization will be toed into
the existing grade. The excavated material will be used to fill an onsite ravine.
The grading and excavating will be accomplished with typical construction
equipment including but not limited to: backhoe, excavator, and dump truck. The piles
for the pier will be installed from shore with a vibrator hammer installed on a long reach
excavator or by vibratory hammer installed on an excavator mounted on a barge.

PROJECT SETTING
The North Carolina Wildlife Resource Commission has submitted a Major CAMA pemut request on
behalf of the Town of Murfreesboro for the construction of a fishing pier on the Meherrin River at
the end of Hart Street off US 158 business in Murfreesboro, Hertford County.
The 2.41acre site currently has remnant concrete pads from previous development. The site is
downstream from the Murfreesboro Historical District and historical site BF-85 is located nearby.
The site has some remnants of old bulkheads. The adjacent upstream property is a cemetery and not
bulkheaded and the downstream property is wooded and not bulkheaded.
The Meherrin River is classified as B; NSW by the Environmental Management Commission and as
a Joint Anadromous Fish Spawning Area by the NC Marine Fisheries Commission and Wildlife
Resources Commission. The Meherrin River is closed to shellfishing at the project location. Water
depths at the end of the pier range from-10'NWL to-15'NWL and the Meherrin River is 150ft to
350ft (to the shoreline of the turning basin) wide at the project site.
PROJECT DESCRIPTION
The applicant proposes to redevelop the project site by constructing a 6ft wide concrete ADA
accessible sidewalk from the parking area to the proposed 6ft by 102ft pier ending with an 8ft by 90ft
fishing platform. The eastern edge of the pier is located 15ft from the eastern riparian line. The
shoreline will be stabilized with 180R of rip rap, with a toe extending 5ft water ward of NWL.
During the installation there will be some excavation of high ground and river bottom. This impact is
from normal construction practices and is not for navigation. The spoil will be used to fill a collapsed
ravine on the project site after replacing the culvert on the property. The applicant is also proposing
19 parking spaces (2 ADA accessible), two of which will be concrete and the other 17 will be CABC
stone. Approximately 26% of the coastal shoreline AEC will be impervious (including existing pads)
while 46% of the entire site will be impervious.
ANTICIPATED IMPACTS
The project will result in localized turbidity due to the construction of the pier, fishing platform and
installation of the rip rap. The construction of the pier and platform will shade 1,332 sq ft of river
bottom, and the installation of the rip rap will convert 900sq ft of soft bottom to rip rap.

King's Landing - Improvements
Project Narrative
August 11, 2016
The Town of Murfreesboro and the North Carolina Wildlife Resources have
formed a partnership to develop the site known as King's Landing, acquired in 2013 by
the Town, into a free public fishing access area. Improvements to the site will include an
access road, parking area, concrete sidewalk, a fishing pier, and shoreline stabilization.
The existing access road will be re -aligned to more efficiently access the parking
area. A construction entrance will be installed as shown on the plans. The access road is
approximately 26' wide by 94' long and will be surfaced with 6" of CABC stone.
The parking area consists of 19 total parking spaces; two of which are van
accessible ADA spaces. The surface will be 6" of CABC; except the accessible spaces
and lift area which will be 4" of 3,000 psi concrete with fiber mesh.
A 6' wide concrete sidewalk will provide ADA compliant access from the parking
area to the proposed fishing pier. The sidewalk will parallel the existing main building
pad on the western and northern perimeter. This route will require appendages to the
main building pad to be demolished. This route facilitates meeting the required ADA
accessibility guidelines. As a result of this accessible route 19 cubic yards of excavation
for the sidewalk is required on the northern perimeter of the building. Additionally, a
small portion of the sidewalk (triangular shaped, 0.57' X 5.86') will be within the 30'
CAMA buffer. This intrusion into the buffer is unavoidable while maintaining
compliance with the ADA access route guidelines.
The fishing pier will be an 8' X 90' wooden structure accessed by a 6' X 102'
wooden walkway. The pier and walkway will be pile supported and include a 42" railing
system. To accommodate users with disabilities the walkway includes a switchback to
ensure an accessible walking surface slope. Additionally, one-fourth of the fishing pier
railing system will accommodate individuals with disabilities.
One hundred and eighty feet of shoreline will be stabilized with Class II rip rap
2.5 feet deep over filter fabric. The bottom of the shoreline stabilization will be toed into
the existing grade. The excavated material will be used to fill an onsite ravine.
The grading and excavating will be accomplished with typical construction
equipment including but not limited to: backhoe, excavator, and dump truck. The piles
for the pier will be installed from shore with a vibrator hammer installed on a long reach
excavator or by vibratory hammer installed on an excavator mounted on a barge.

The proposed project will develop the site into a free public fishing access area to include parking, ADA parking, accessible
concrete path, fixed wooden fishing pier, and shoreline stabilization

GRANTORS; and THE TOWN OF MURFREESBORO, a North Carolina Municipal Corporation, whose
address is Post Office Box 5, Murfreesboro, NC 27855, hereinafter GRANTEE;
WITNESSETH:
That GRANTORS, for adequate valuable consideration, paid by GRANTEE, the receipt and
sufficiency of which is hereby acknowledged, have bargained and sold and by these presents do bargain,
sell, grant and convey unto GRANTEE and its successors and assigns, in fee simple, that certain tract or
parcel of land, located in the Town of Murfreesboro, Murfreesboro Township, Hertford County, North
Carolina, described as follows:
That certain tract or parcel of land situate in the Town of Murfreesboro, Hertford
County, North Carolina, and lying on the East side of Hart Street, containing 2.41 acres by

to a concrete monument and North 79 degrees 30 minutes West 184.22 feet to the point
and place of beginning.

Grantors and Grantee were not occupying the property as their primary residence.
To the extent the fair market value of the property exceeds the sales price the WA%O
Grantors make a gift of the same to The Town of Murfreesboro.
TO HAVE AND TO HOLD the aforesaid tract or parcel of land, together with all privileges and
appurtenances thereunto belonging, to GRANTEE and its successors and assigns, in fee simple.
And GRANTORS covenant with GRANTEE, that GRANTORS are seized of the premises in fee
simple, have the right to convey the same in fee simple, that title to said property ii free and clear of all
liens and encumbrances, and that GRANTORS will warrant and defend the title against the lawful claims
of all persons whomsoever, except for the exceptions and restrictions hereinafter stated. Title to the
property hereinabove described is subject to the following exceptions and restrictions:
1. Ad valorem taxes and assessments, if any, for the current year.
2. Legally enforceable restrictions, easements, rights of way and conditions of record or
apparent on -site.
3. Restrictive Covenants in deed recorded'in Book 642, Page 719, Hertford County Register
of Deeds Office.
