Conditions
1. All proposed development and associated construction must be done in accordnnec with the pertttitted
workplat drawing as originally submitted on September 10, 2004.
2. All construction must conform the the North Carolina Building Code requirements and all other Local.
State and Federal regulations.
3_ Any change or changes in the plans for development, construction, or land rise activities will require a re-
cvaluation and modification of this permit.
4. The amount of impervious surface arcos'slmll not exceed 3Un/n of the lot area within the 75' Area of
Environmental Concern (AEC); in this rase. 10 %
5, in order to prevent sedimentation. a vegetated buffer zone must be maintatincd between all disturbed arcos
and the adjucent waterbody or marsh. In this rase a 30 foot wide buffer has been accepted.
6. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked bales, or burlap must
be Installed between the land -disturbing activity and the adjacent marsh or water areas. until such time as
the area has been properly stabilized with a vegetated cover.
7. Pursuant to 15 NCAC, Subehaptcr 7j.0406(b), this permit may not be assigned, transferred, sold, or
otherwise disposed of to a third party.
8. A final as built survey will be required.

This permit action may be appealed by the permittoo or other
qualified persons within twenty (20) days of the Issuing date.
From the date of an appeal, any work conducted under this per-
mit mr.st cease until the appeal Is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December

In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

Application #:CP-04-001
Dear Mr. Potter:
After reviewing your application in conjunction with the
development standards required by the Coastal Area Management
Act(CAMA) and our locally adopted Land Use Plan Ordinances, it is
my determination that no permit may be granted for the project you
have proposed.
This decision is based on my finding that your request violates
NCGS 113A-120(8) which requires that all applications be denied
which are inconsistent with CAMA guidelines. You have applied to
build a restroom, which is inconsistant with 15 NCAC 7H.208 which
states that: Uses that are not water dependant shall not be
permitted in coastal wetlands, estuarine waters, and public trust
areas....
Should you wish to appeal my decision to the Coastal Resources
Commission or request a variance from that group, please contact me
so I can provide you with the proper forms and any other
information you may require. Appeal notices must be received by the
Division of Coastal Management in Raleigh within twenty (20) days
of the date of this letter in order to be considered.
