Dockina Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 in issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The permittee is not relieved of this requirement if he abandons the Permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, pennanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 4 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 7) No portion of the authorized docking facility shall extend past the Carolina Beach pier head line. 8) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 9) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 10) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. U.S. Army Corps of Engineers Condition 12) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements within. PROJECT DESCRIPTION The project site is located at 1013 Canal Drive, adjacent to the Carolina Beach Yacht Basin/Myrtle Grove Sound, in the Town of Carolina Beach, New Hanover County. To get to the site from the Wilmington Regional Office travel south onto College Road and then continue on Carolina Beach Road (US Highway 421) for approximately 15 miles. Travel approximately 2.5 miles after crossing Snow's Cut Bridge, turn left onto Carl Winner Drive and continue until you reach a stop light at Canal Drive. Turn left onto Canal Drive and continue north approximately 0.8 miles. The subject property is a vacant lot and will be located on your left adjacent to a vacant lot to the north and a residential property to the south. The applicant's lot is approximately 0.20 acres and averages approximately 4 feet above normal high water (NHW). High ground vegetation that exists on the property consists of native grasses. The applicant's measured shoreline is 50 ft. in length and it is stabilized by a bulkhead which ties into the adjacent bulkhead to the south (See Sheet 1 of 2). There is an approximately 15 ft. wide pocket of coastal wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora), which transitions to an additional 15 ft. of coastal wetland/Section 404 species, consisting primarily of Black Needlerush (Juncus roemerianus) and Salt Meadow Grass (Spartina patens), adjacent to the existing bulkhead. The Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to construct a private four (4) slip docking facility with an access pier covered gazebo, floating dock and finger piers. The applicant states that a pier, measuring approximately 43 ft. in length by 6 ft. in width, would extend from the existing bulkhead towards the Carolina Beach Yacht Basin/Myrtle Grove Sound terminating in a roof covered octagon shaped gazebo, measuring approximately 19 ft. in length by 19 ft. in width. A ramp would extend water ward of the gazebo onto a floating dock running perpendicular to the shoreline measuring approximately 20 ft. in length by 6 ft. in width. Two finger piers would be installed parallel to the shoreline extending waterward along the outer edges of the floating dock, each measuring approximately 25 ft. in length by 4 ft. in width. This configuration creates a U-shape configuration for the docking facility. The application states that the proposed new docking configuration would provide docking space for up to four (4) vessels within existing water depths ranging from approximately -5.0 ft. to -6.0 ft. at normal low water (NLW) (See Sheets 1 and 2 of 2). fl�l�l;t1[�it1��IL4lJ,C�9 The proposed structures would incorporate approximately 939 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed structure would extend approximately 105 ft. into a water body, which measures approximately 836 ft. across. The structures would be located in water depths of -5.0 ft. to -6.0 ft. (MLW) and would conform to both the 1/4 width rule and the Carolina Beach pier head line according to the application. The proposed structures would not encroach into either adjacent 15' Riparian Corridor Setback Area requirement or the USACE 80 ft. setback requirement. Minor increases in turbidity should be expected during construction.
