This permit, issued on May 6, 2016 - , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may lines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered by Condition No. 2 of this permit, this Minor Modification authorizes the addition of 65' of bulkhead, all as expressly and specifically set forth in the attached letter and workplan drawing. Any additional development activities may require a modification of this permit. 2) The authorized bulkhead shall be constructed immediately waterward of the existing deteriorated bulkhead, with the exception that in areas where riprap and debris exist, the permitted bulkhead alignment shall not extend more than 5 feet from the existing deteriorated bulkhead. 3) This Minor Modification shall be attached to the original Permit No. 8-16, which was issued on 1/25/16, and copies of both documents must be readily available on site when Division personnel inspect the project for compliance. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires tbrther Division approval. VAN DER VAART S�„w"' I Coasra(Managemenr ENVIRONMENTAL QUALITY MEMORANDUM: TO: Courtney Spears, DCM Assistant Major Permit Coordinator FROM: SUBJECT: DATE: Shane Staples, DCM Fisheries Resource Specialist Jonathan Luke Midgett Minor Mod to Permit #8-16 4/19/16 BRAXTON DAVIS A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the subject permit application for proposed actions that impact fish and fish habitats. The Permit #8-16 allowed for the replacement of a fish house, docks, piers, and sections of new bulkhead. In that project 1840 square feet of shallow bottom was filled to construct the new bulkhead. This office did not object to this fill but did state concerns over the lack of effort to reduce and minimize the fill associated with the bulkheads construction. This modification proposes to construct new bulkhead along another section of property not included in the previously permitted project. This section of bulkhead 65' in length is proposed to be built Sft ahead of the current alignment and tie Into the bulkhead permitted under #8-16. In conjunction with the previously permitted action this brings the total shallow bottom fill associated with this project to 2,165 square feet. This appears to be excessive fill of shallow bottom habitat and uses the new bulkhead alignment under #8-16 to connect bulkheads and gain ground. As stated in my comments on 12-15-15 for the previously permitted project I believe this section of bulkhead should be held to the 2' forward of the existing bulkhead as is normal guidance for bulkhead replacement.
