DCM MHC 11130/15, inc. attached workplan drawings (2) labeled 'Proposed' mid 'Existing Site Conditions' both dated 9118/06.
This permit, issued on May 6, 2016 - , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
lines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered by Condition No. 2 of this permit, this Minor Modification authorizes the
addition of 65' of bulkhead, all as expressly and specifically set forth in the attached letter and
workplan drawing. Any additional development activities may require a modification of this permit.
2) The authorized bulkhead shall be constructed immediately waterward of the existing deteriorated
bulkhead, with the exception that in areas where riprap and debris exist, the permitted bulkhead
alignment shall not extend more than 5 feet from the existing deteriorated bulkhead.
3) This Minor Modification shall be attached to the original Permit No. 8-16, which was issued on
1/25/16, and copies of both documents must be readily available on site when Division personnel
inspect the project for compliance.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires tbrther Division approval.
Ali work must cease when the permit expires on
December 31, 2019

Minor Modification to Major Permit
1. Luke Midgett has requested a Minor Modification to Major Permit #8-16, which was issued
on Jan. 25, 2016. The original major permit authorized the construction of a fish house,
bulkheading, and a pier.
2. The applicant has requested the major permit be modified to add an additional 65 ft of
bulkheading at an average and maximum of 5 ft from NWL to tie into existing permitted
bulkheading.
3. I conducted a site visit on March 23, 2016 to review the Minor Modification request pursuant
to the provisions of reference (a) and have determined that the request meets the requirements
contained in 15A NCAC 07H .0208 USE STANDARDS.
4. The required fee of $100, paid by check ###2was received by the Elizabeth City District
Office on v� ' -
5. It is recommended that the Minor Modification request be granted provided all the Permit
Conditions of the original permit issued on remain in affect.

March 22, 2016 and received by the Division of Water Resources (Division) on April 08, 2016. These
impacts are covered by the attached Water Quality General Certification Number 3900, Neuse River
Riparian Buffer Rules, and the conditions listed below. This certification is associated with the use of
CAMA Major Permit and:General Permit(s)198000291 issued by the US Army Corps of Engineers (USACE).
This Certification' allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it. Please note that you should get any other federa 1, state or local permits before proceeding with
your project, including those required by (but not limited to) Sediment and Erosion Control,. Non -
Discharge, and Water Supply Watershed. regulations.
This approval requires.you to follow the conditions listed in the enclosed certification(s) or general

2. This approval is for the purpose and design described in your application.. The plans and
specifications for this project are incorporated. by reference as part of the Certification. If
you change your project, you must notify the Division and you may be required to submit a
new application package with the appropriate fee: If,the property is sold, the new.owner'
must be given ak copy of this approval letter and General Certification and is responsible for
complying with all conditions. [15A NCAC 02B .0507(d)(2)] .
3. Water Quality Certification
The proposed project must comply with all the conditions of the General Water Quality
Certifications) 3900, [35A NCAC 02B .0507(c)]
Continuing Compliance
4. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination. of waters and wetlands from fuels,
lubricants, hydraulic .fluids or other .potential toxic chemicals. In the event of a.
hydrocarbon or chemical' spill, the permitee/contractor shall immediately contact the.
Division of Water Quality, between the hours of8 am to 5 pm'atthe Washington Regional '
Office .:at 252.946.6481 and after hours and on weekends call (800) 85"368. ,
Management of such spills shall comply with provisions of the North Carolina Oil Pollution
and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c)(3),15A NCAC
02B .0200 (3)(f), and GS 143 Article 21A]
S. Turbidity Standard*
The Permittee shall adhere specially to 15A NCAC 02B .0221 Tidal Salt Water Quality for.
Class. SA Waters (3)(g), pH: shall be normal for waters in the area, which generally shall
range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is
the result of natural conditions; (1) Turbidity: the turbidity in the receiving water shall not
exceed 25 NTU; if turbidity exceeds this level due to natural background conditions; the
existing turbidity level shall not be increased. [15.A NCAC 02B .0221]
Other Conditions
6.. Re Opener Clause
Mr. Jonathan L. Midgett and any authorized agents shall conduct their activities in a
manner consistent' with State water quality standards (including any requirements
resulting from compliance with 'section 303(d) of the Clean Water Act) and any other
appropriate requirements of State law and federal law. Mr. Jonathan L. Midgett shall
require any contractors (and/or agents) to complywith all of the terms of this
Certification, and shall provide each of their contractors (and/or agents) a copy of this
Certification. A copy of this Certification shall be:included in the construction contract
:and a4ailable.on the job site at all times. If DWR determines that such standard's or laws
are not being met (including the failure to sustain a designated or achieved use) or that

State or federal law is being violated, or that further conditions are necessary to assure.
compliance, DWR may reevaluate and modify this certification to include conditions:
appropriate to assure compliance with such standards and requirements in accordance
with 15A.NCAC 2H.0507(d).. Before modifying the certification, DWR shall notify Mr.
Jonathan L. Midgett and the US Army Corps of Engineers, provide public notice in
accordance with 18A NCAC 2H.0503 and provide opportunity for public hearing in
accordance with 15A NCAC 21-1.0504. Any new or revised conditions shall be provided to
DWR in writing, shall be provided to the United States Army Corps of.Ehgineers for
reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall
also become conditions of the 404 Permit for the project.
7.. Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules; anysubsequent modifications, the applicant is required to return
the attached certificatebf completion to the 401 & Buffer Permitting Unit, NC Division of
Water Resources,1617 Mail Service Center, Raleigh, NC 276994650. [15A NCAC 02H
.0507 (c)] .
8. The applicant and/or authorized agent shall provide a completed .Certificate of
Completion form to the Division within thirty (30) days of project completion (available
at http:J/Poftal.dcdenr.org/web/wa/swo/ws/401/certsand6ermits/aooly/forms). [15A
NCAC 02H .0506(b)(5)]
9. This.approval And Its conditions are final and binding unless contested, [G.S.143-215.5]
These Certifications can be contested as provided in Articles 3 and 4.9f.General Statute 1506 by filing a

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The Permit #8-16
allowed for the replacement of a fish house, docks, piers, and sections of new bulkhead. In that project
1840 square feet of shallow bottom was filled to construct the new bulkhead. This office did not object
to this fill but did state concerns over the lack of effort to reduce and minimize the fill associated with
the bulkheads construction.
This modification proposes to construct new bulkhead along another section of property not included in
the previously permitted project. This section of bulkhead 65' in length is proposed to be built Sft ahead
of the current alignment and tie Into the bulkhead permitted under #8-16. In conjunction with the
previously permitted action this brings the total shallow bottom fill associated with this project to 2,165
square feet. This appears to be excessive fill of shallow bottom habitat and uses the new bulkhead
alignment under #8-16 to connect bulkheads and gain ground. As stated in my comments on 12-15-15
for the previously permitted project I believe this section of bulkhead should be held to the 2' forward of
the existing bulkhead as is normal guidance for bulkhead replacement.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
[phone] within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.
