This permit, issued on July 28, 2016 is subject to compliance with the application (where consistent :with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may oe supijeci io rmes, imprisonment or civil action; or may cause the permit to be null and void. Marina Facility 1) This permit authorizes the construction of the expanded dock, piers, and tie pilings, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage; whether treated or untreated, shall be discharged at any time from any boats using the marina facility. Any sewage discharge at the marina facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) ` This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 - In issuing this permit, the State of North Carolina agrees that Your project is consistent with the North Carolina Coastal Management Program. The manna facility shall display a sign showing the location of the nearest pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. 7) 'No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. ' 1.1) This permit does not authorize the interference with any existing or proposed Federal project, and the pernttee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. "NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic i General Permit 198000291 and assigned SAW 2016-01200. .NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water ,- Quality Certification 3900 and assigned the project DWR Project No. 2010-0792 v2. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. 'NOTE: An application processing fee of $250 was received by DCM for this project. 6 - k Received 05 Mid -Atlantic Christian University 2016 Dock Expansion DG'iVi'E(i Project Narrative Maritime Ministries Inc. has given a construction grant to Mid -Atlantic Christian University (MACU) to build a 200' x 10' dock expansion to the existing 95' dock on MACU's property. A 2010 NC CAMA grant provided the core funds to build the existing 95' x 10' dock with eight small boat slips. The 2016 dock expansion plan calls for the removal of one tie -piling from the existing dock structure and the addition of two slips on either side of a 20' x 4' finger pier with 4 tie -pilings. The remaining 150+' will be divided into three 50' side tie slips. This will increase the total number of slip space to 12, and create additional side -tie dockage for transient cruisers. Maritime Ministries will dock three of its vessels on the new expanded dock. The remaining 100' plus of dock space (north) will be available to transient cruisers for 48 hours of free side -tie space. The existing seven slips (south) will continue to be available to smaller transient and local boats, as is the current practice. Maritime Ministries is a 28 year -old Virginia based non-profit, with offices in Richmond, VA and its hub of operations based on MACU's waterfront campus. MACU is a 67 year -old SACSCOC accredited Christian University. The MACU campus is situated on both sides Poindexter Street in Elizabeth City. The west 700 block houses administration offices and classrooms; the east campus consists of nearly a quarter mile of waterfront property on both the Pasquotank River and Knobb's Creek waters. Set on this park -like east campus are two dormitory buildings, and a large multi -purpose building, housing the Watson -Griffin Library, Davenport Chapel and Chesson Gym. Inside the Chesson Gym are showers available to transient cruisers free of charge. There is also free Wi-Fi, access to the campus library as well as the university cafeteria, which serves all -you -can -eat meals for under $10 to interested cruisers and the public alike. The existing and expanded dock has water but no electric or pump -out facilities. Fuel, water, electric and pump -out facilities are available to the North at Lamb's Marina and to the Southeast at Pelican's Marina. One tie piling will be removed from the existing docking facility to expand the width of an existing slip and reduce the total number of existing slips from 8 to 7. Poindexter Street, adjacent to the Pasquotank River, in Elizabeth City, North Carolina. MACU was established in 1948, originally as Roanoke Bible College, on an 8.9-acre tract located only a few blocks northwest of the Elizabeth City downtown area. The campus has 876' of bulkheaded shoreline on the Pasquotank River with an existing 8'-10' x 95' shore side dock with four finger piers and eight tie pilings for 8 vessels (authorized by CAMA Major Permit #148-10). The total area of shading by the existing docking facility is 960sf. Also located on the waterside tract is a gym, classroom building, library and gazebo with associated parking. MACU is bounded on southeast side of the campus by Burgess Street and an adjacent commercial food service distribution company with a docking facility for transient boaters, and on the Northwest side by a Condominium complex with a docking facility for 10 vessels. Elevation of the property is approximately 3' above normal water level (NWL) and water depths along the property ranging from -10' along the bulkhead to a depth of -25' at a distance of 30' offshore. The Pasquotank River —575' wide along the proposed dock expansion. There is a federally maintained channel adjacent to the applicant's property. Vegetation on the applicant's property is limited to a variety of ornamental shrubs, trees, domestic grasses, and weeds. There are no wetlands or submerged aquatic vegetation on or adjacent to MACU. There are no known geologic formations or archaeological sites associated with the applicant's property. The existing docking facility was funded by a CAMA Grant in 2010, and the expansion being requested will be funded by Maritime Ministries, Inc. out of Richmond, Virginia. Three spaces will be reserved for use by Maritime Ministries, while the remaining slips will be for transient users visiting the campus and Elizabeth City. Shower and bathroom facilities will be made available to transient users in the Gym located adjacent to the docks, as well as Wi-Fi, access to a library, and meals (for a nominal fee). Water will be supplied to the slips, but no electricity. Anticipated Impacts 1) Project will result in 2,080sf of additional open water shading from finger pier and dock/platform. 2) The proposed development will temporarily disrupt animal populations within adjacent waters and the project area. 3) Installation of pilings for the proposed piers may result in temporally suspending sediments in the water. 4) During the project construction it is anticipated that noise levels may periodically increase above surrounding background (ambient) levels from heavy equipment. 5) Treated wood leaches over time in surrounding waters and sediment. The amount of leaching is dependent on the type of organic material present in the water bottom substrate, oxygen levels and water movement; however, it is estimated that 90% of the leaching will occur within the first 90 days. Overview: The 8.9 acre subject property has approximately 876 linear feet of shoreline along the Pasquotank River. Water depths adjacent to the property range from -10 feet along the bulkhead to -25 feet at a distance of 30 feet offshore. The Atlantic Intracoastal Waterway (AIWW), a federally maintained channel, is located in the river adjacent to the property. The site is vegetated with domestic grasses, ornamental shrubs, trees and weeds and is elevated approximately 3 feet above Normal Water Level (NWL). The property is located within a floodzone. Existing site improvements consist of two (2) dormitory buildings, a large multi -purpose building, a gazebo and associated sidewalks and parking. Existing shoreline improvements consist of 876 linear feet of aluminum sheet pile bulkhead and an 8 foot to 10 foot wide by 95 foot long shore side dock with four (4) finger piers and eight (8) tie pilings to accommodate eight (8) boat slips. The docking facility was approved under CAMA Major Permit #148-10. Installation of a 10 foot wide by 200 foot long shore side dock with a 4 foot wide by 20 foot long finger pier and four (4) tie pilings and removal of a tie piling are proposed. The improvements will extend north from the existing dock. The finger pier and tie pilings will not extend beyond the existing piling alignment. The expanded docking facility will accommodate twelve (12) boat slips. Water will be supplied to the slips, but no electricity or pump -out facilities will be provided. Maritime Ministries Inc., a non-profit, is providing a construction grant to MACU for this project. The remaining three (3) slips are intended for Maritime Ministries vessels. The waters of the Pasquotank River in this area are classified as SC and are closed to shellfish harvesting. The Pasquotank River is approximately 575 feet wide at the project location. There is no Submerged Aquatic Vegetation (SAV) adjacent to the property. There are no known geological formations or archaeological resources associated with the property. Anticipated Impacts resulting from this project are expected to include: the shading of 2,080 sq. ft. of Public Trust Area of Environmental Concern (AEC). Basis for Determination: The project area is located entirely within the Pasquotank River. As indicated on Page 165 of the Elizabeth City Future Land Use Plan Map (FLUPM), "Conservation/Open Space' areas include parks, coastal wetlands, estuarine waters, estuarine shoreline, public trust waters, and non -coastal '404' wetlands. The following LUP policy statements may be applicable to this request: Public Access: Policy 1, Page 133. "Ensure a variety of opportunities for access to public trust waters to all segments of the community, including persons with disabilities." Policy 4, Page 133. Additionally, the permittee shall report spills.including: any oil spills of 25 gallons or more and any spill regardless of amount that causes sheen on surface waters. 8. Number of Slips/Dock Space Use of dock space other than the approved 12 slips is prohibited. Handrails or other devices, including signage, should be used to discourage use of any dock pace other than the 12 designated dockage slips as shown in the approved plan. ReOoenerClause Mid -Atlantic Christian University and their authorized agents shall conduct their activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of State law and federal law. Mid -Atlantic Christian.University shall require their contractors (and/or agents) to comply with all of the terms of this Certification, and shall provide each of their contractors (and/or agents) a copy of this Certification. A copy of this Certification shall be included in the construction contract and available on the job site at all times. If DWR determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are necessary to assure compliance, DWR may reevaluate and modify this certification toinclude conditions appropriate to assure compliance with such standards and requirements in accordance with 15A NCAC 2H.0507(d). Before modifying the certification, DWR shall notify the Mid - Atlantic Christian University and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503 and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to DWR in writing, shall be provided to the United States Army Corps of Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. 10. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located adjacent Poindexter Street and the Pasquotank River in Elizabeth City, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended, 16 U.S. C. 661 et seq.). The applicant proposes to expand an existing docking struchre with the construction of a 10' by 200' shore side dock with three new 50' long slips paralleling the dock, a 4' by 20' finger pier with four tie pilings for two new slips perpendicular to the dock and bulkhead. Total slips for the facility will raise from 8 to 12. The Pasquotank River at this location is classified SC by the Environmental Management Commission and is designated an anadromous fish spawning area (AFSA) by the NC Division of Marine Fisheries and NCWRC. The NCWRC has reviewed the permit application and does not object to permit issuance. However, to protect anadromous species we recommend a,,February 15 — June 30 Moratorium be included as a permit condition to minimize impacts such as elevated turbidit-% and noise levels during construction. Since the facility will be expanded to 12 slips, we also request that a marina plan is formulated. The AFSA designation mean the waters critical habitats for anadromous fish such as shad, striped bass, and river herring. Blueback herring and Alewife being the two of particular importance in this water body. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Cultural Resource Protection 8) The project site is located in an area having a high probability of containing cultural resources, such as shipwreck remains. If such materials are encountered, the permittee shall immediately stop work and notify the District Engineer, Wilmington Branch, U.S. Army Corps of Engineers at (910) 251-4555, and the N.C. Division of Coastal Management at (252) 264-3901. General 9) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily. 10) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management.
