Inc. authorizing development in a Coastal Shoreline Area of Environmental Concern (AEC) at 1180 & 1182 North Anderson Blvd Topsail Beach NC on Lot # 3 of the combination of Lots # 42 &43 of the Elisabeth Parsley Subdivision as requested in the permittee's application dated December 18 2003 and received December 19, 2003 This permit, issued on August 13. 2004, is subject to compliance with the application and site drawings, where consistent with the permit, all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment and civil action, and may cause the permit to be null and void. This permit authorizes the construction of a single family dwelling, driveway, septic system, and stormwater infiltration system at 1180 & 1182 North Anderson Blvd. on Lot # 3 of the combination of Lots # 42 & 43 of the Elisabeth Parsley Subdivision in Topsail Beach, NC. Any other development will require additional permits or a modification to this permit. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawing sealed by Charles Francis Riggs, P.L.S. on August 13, 2004. The stormwater infiltration system must be constructed according to the design specifications sealed by Keith P. Bulla, P.E. on July 21, 2004 while the location of the stormwater infiltration system shall be in accordance with the drawing sealed by Charles Francis Riggs, P.L.S. on August 13, 2004. (2) All construction must conform to the N.C. Building Code requirements and all local, State, and Federal regulations. All development must be consistent with all applicable Federal, State, and Local standards. Contact the Town of Topsail Beach for applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. Conditions continued on second page This permit action may be appealed by the penmiftee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, requires further written permit approval. All work must cease when this permit expires on December 31, 2007 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. The permittee is required to provide a certification signed and sealed by a Professional Engineer stating that the stormwater infiltration system has been installed according to the design specifications and conditions of this permit; this certification is required for satisfactory completion of a final inspection. (5) The stormwater infiltration system shall be maintained such that it functions as designed throughout the life of the project. (6) Grading, filling, and excavation shall not occur within 30 feet of normal high water. (7) Prior to any development, silt fence shall be properly installed between all planned land disturbance and the adjacent marsh and open water areas; the silt fence shall be properly maintained throughout the construction period. Silt fence shall be installed such that it is properly toed in. (8) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Sedimentation and erosion control measures shall be properly maintained throughout the construction period. (9) All disturbed areas not otherwise stabilized shall be vegetatively planted and mulched within 30 days of any phase of grading. (11) This permit does not authorize development within coastal wetlands, wetlands, and open water areas. (12) The structural integrity of the stormwater infiltration system shall not be compromised. Any support pilings or other means of supporting the shown stair case shall not be installed within the stormwater infiltration system. (13) A copy of this permit shall be posted or available on site. Contact this office at 910 395-3900 for a final inspection upon completion of work. The issuance of a Certificate of Occupancy is dependent upon a satisfactory CAMA final inspection. (14) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third -party. 0'
