This, permit, issued on August 30, 2016 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) ' This permit authorizes the construction of 6'x 360' dock, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating . or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action maybe appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the qualified persons within twenty (20) days of the issuing date. PROJECT SUMMARY: The applicants propose to construct a 6' x 360' dock along a man made canal and basin. q a Elaine C. Mayo Canal off Rose Bay Hyde County Project Setting The 2.4 acre project site is located at 6774 HWY 264 on a man made canal off Rose Bay and Pamlico Sound near Scranton in Hyde County, North Carolina. The site is developed with a building and associated gravel parking area. The project site has an elevation of 2.5' to 3' above the normal water level (NWL). The low traffic areas are vegetated with bermuda and fescue grass and there is no woody vegetation at the site. There are no wetlands at the project site. There are two boat basins off the canal, one next to the existing building (Basin A) and one that is larger downstream (Basin. B). Major CAMA/Dredge and Fill permit no. 10-00 issued on 4 February 2000 authorized the enlargement of Basin A and a dock around it's perimeter and a dock, finger piers and slips in Basin B. Basin A was enlarged as authorized but the dock work in either basin was never completely undertaken only small sections of dock adjacent the building. The existing building in the past has supported commercial fishing operations. This building interior has now been modified to serve as a base camp for duck hunters complete with a kitchen, and living room and sleeping quarters. The applicant owns a larger ±320 acre tract on Rose Bay adjacent to the project site. The shoreline in Basin A adjacent the building is stabilized with a deteriorating bulkhead that is continuous to the canal then turns up the canal to a small boat ramp at the head of the canal adjacent HWY 264. At this location, the canal is 30' wide. There is a 6' wide x 20' long dock that straddles the existing bulkhead in the canal adjacent the building. Water depths in the canal and basins are 4' to 6' below normal water level (N WL). The canal is designated as Coastal Waters by the Marine Fisheries Commission and is a Primary Nursery Area (PNA). The canal is designated SA waters by the Environmental Management Commission and is closed to shellfishing. Project Description The applicant proposes to construct a 6' wide x 360' long dock starting at the existing boat ramp continuing down the canal then around the perimeter of Basin A. The purpose of this dock is to provide temporary "side to" moorings for duck hunters and fisherman staying at the site. The dock will be utilized by outboard powered boats ranging from 15' to 24' in length that will moor "side to". The proposed dock will straddle the bulkhead with 2' over the canal and 4' over the canal bank. Anticipated Impacts Although the area around the existing building has historically been used to tie boats, the project will increase boat traffic in the canal seasonally and their associated impacts. The dock will shade 720 ftZ of canal bottom and 1,440 ftz of canal bank. There will be some short term localized turbidity during construction. Commercial fishing boats used the site as a harbor of refuge tying side to small docks or bulkhead in the canal and basin. The building interior has been modified to provide living quarters. The applicant is requesting the dock to provide temporary side to mooring of recreational boats, mainly for duck hunters ranging in size from 15' to 24'. DCM staff in the Washington Regional Office has reviewed the project for consistency with the use standards as found in North Carolina Administrative Code 7H, specifically those found in 7H.0208 and have determined the project to be consistent.
