Docking Faeilitw This permit authorizes only the docks,piers; and:other structures and uses located in or over the Water that are expressly andspeciftcally;set forth in the permit application: No other structure, whether floating or stationary, shall become a permarient part of this docking facility without permit modification. Matthews ADDITIONAL CONDITIONS Permit No. 69-16 Page 2 of 4 3) The permittee shall maintain the,authorized work in good condition4and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons'the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or,otherwise„or the,authorize'd facilities. At a minimum, permanent reflectors shall be attached to the structure `in order to make -it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 4 formalizedboat slips. Docking space on the landward side of the floating•dock is not authorized under this -permit. In order to ensure compliance with -this condition, cleats shall not be installed on the landward side of the floating dock. 6) The pier and associated structures shall have aminimum setback distance of 15 -feet between any parts of the structure and the adjacent property owner's,riparian access corridor. NOTE: The permittee is cautioned that this permit does not'authorize tie piles in association with the authorized docking facility. 7) The authorized structures and associated activity shall not exceed the established Carolina Beach pier head line. 8) Any portion of the permitted access pier leading to the docking facility built over Coastal Wetlands shall not exceed six feet in width and shall, be elevated a min mum of three feet over the wetland substrate as measured from the bottom of the decking. 9) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water: Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 10) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 11) No attempt shall be made by the permittee to; prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Bulkhead 12) The bulkhead shall be constructed in the same alignment as depicted.on the attached workplan drawing. 13) The bulkhead shall be constructed prior to any backfilling activities: 14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the' bulkhead wall, riprap, deadmen cables, etc. Steven & Dale Matthews Permit No. 69-16 Page.3 of 4 ADDITIONAL. CONDTI'ION18 16) All fill material shall be clean and free of any'pollutants except in trace quantities. 17) AlI backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 18) No backfill material is to be placedwithin 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 19) All fill material, to be placed below normal water high level shall be confined behind the permitted bulkhead. Boat Ramp & Vinyl Groins for Boat Ramp Stabilization 20) Unless specifically altered herein,'this permit authorizes the replacerhem of the existing boat ramp and construction of the vinyl groins, all, as indicated on the attached workplan drawing. 21) The boat ramp and vinyl groins shall have a minimum setback distance of 15 feet between any parts of the structures and the adjacent property owner's riparian access corridor. 22) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. Upland Development 23) Unless specifically altered herein, this permit also authorizes the land disturbing activities associated with the development of the above referenced.property, including the single-family residence, pool, terrace, driveway, boat ramp access&garage, all as expressly and specifically set forth in the attached permit application and=workplan,drawing. Any, additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of.Coastal Management representative at (910)796-7215 for this determination. 24) Any development or land disturbing activity that is considered non -water dependent is not authorized within 30 feet of the normal high water level unless specifically exempted by Coastal Resource Commission (CRC) regulations in place at the time of such development. Sedimentation and Erosion. Control 25) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 26) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or'berms, etc.). 1 Steven & Dale Matthews ADDITIONAL CONDITIONS Stormwaier Management Permit No. 69-16 Page 4 of 4 27) An approved stormwater management plan from, the Town of Carolina Beach will be required for this project. I .tt PROJECT NARRATIVE MATTHEWS PROJECT - CAROLINA BEACH The Matthews Project site is located at 223 Florida Avenue in Carolina Beach, NC. The proposed project consists of developing a vacant waterfront building lot located immediately adjacent to Myrtle Grove Sound. The Matthews Tract was previously developed with a single-family residential home which was demolished and removed from the site. The tract currently consists of 14,395ft2 of upland area and approximately 104ft of shoreline frontage. Existing man-made features on the site include a remnant bulkhead and concrete boat ramp flanked with a concrete and brick stabilization walls. Coastal wetlands are present along the shoreline both above and below the Normal High Water (NHW) contour with stands of marsh ranging approximately 15-25' in width. Some coastal wetlands have volunteered within the cracks and the footprint of the existing concrete boat ramp. The owners currently mow the wetlands within the boat ramp footprint to allow for limited use of the ramp. The proposed project consists of the construction of a single-family residence with swimming pool, construction of a four -slip docking facility, and construction of a new vinyl bulkhead. The applicant is also proposing replacement of the existing concrete boat ramp within the existing footprint. Additionally, two (2) vinyl sheet pile walls are proposed on the north and south sides of the existing boat ramp for stabilization. An access pier is proposed on the north side of the boat ramp for loading and offloading. The applicant proposes to construct a bulkhead landward of the existing remnant bulkhead to stabilize the shoreline and prevent further erosion. The proposed bulkhead alignment would be aligned along the approximate coastal wetland line and landward of the erosion escarpment. The proposed bulkhead alignment would incorporate a small fringe of coastal wetlands, primarily sea ox eye and salt meadow hay in order to achieve a straight alignment (<50 square feet). An additional area of sparsely vegetated sea ox eye and salt meadow hay, approximately 45 square feet, would be impacted by the proposed bulkhead alignment near the boat ramp. The proposed bulkhead alignment south of the existing boat rump would incorporate approximately 80 square feet of coastal wetlands consisting primarily of sea ox-eye and salt meadow hay located landward of NHW. This alignment is proposed to connect to the adjacent bulkhead on the property to the south. This alignment is also necessary to provide adequate clearance, turning and approach to the existing boat ramp. The applicant is proposing to replace the existing boat ramp within the existing footprint and to construct a vinyl stabilization wall on the south and north sides of the boat ramp to preserve the existing wetlands. The proposed boat ramp replacement will incorporate approximately 200 square feet of coastal wetlands that are currently impacted by mowing and established use of the ramp. The concrete boat ramp will be constructed on high ground and slid into place. A four (4) slip docking facility with a roof covered platform is also proposed. ' A single family residence is proposed on the high ground of the property and would result in land disturbance of approximately 14,000 square feet and 30% impervious surface coverage within the 75' Estuarine Shoreline AEC. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington to Carolina Beach south on College Road (NC Hwy 132) to Carolina Beach Road for approximately 12 miles south. Continue over Snows Cut Bridge on N. Lake Park Blvd. for approximately 1.2 miles south until you reach Carl Winner Drive. Turn left onto Cad Winner Drive until you reach Canal Drive. Turn left on Canal Drive and continue north approximately 1.3 miles until you reach Florida Avenue, which will be located on the left. Continue traveling on Florida Avenue until you reach the project site will be on the left. The applicant currently maintains the approximately 0.33-acre tract, which is currently undeveloped with elevations ranging from 3' to 5' above normal high water (NHW). The project site is also bordered by residential properties to the north and south. A failed timber bulkhead and small concrete boat -ramp exists along the approximately 100 linear feet (LF) of shoreline along the Carolina Beach Yacht Basin. It appears that failure to maintain the timber bulkhead and concrete bulkhead has allowed coastal wetlands to volunteer on the landward side of the timber bulkhead and on rubble associated with the boat -ramp, consisting primarily of Smooth Cordgrass (Spartina altemitlora) with Spike Grass (Distichlis spicata), Sea Oxeye (Bomchia frutescens), Sea Lavender (Limonium, spp.), Saltwort (Salicomia, spp.), and Salt Meadow Grass (Spartina patens). Shrubs including; Marsh - Elder (Iva trutescens), Grounsel-Bush (Baccharus halimifolia), and Wax Myrtle (Myrica cerdera) complete the transition to the highground. Vegetation associated with the high ground portion of project consists primarily of wild grasses (See Sheet 1 of 2 and Project Narrative). The Town of Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The application states that the existing failing timber bulkhead would remain and a new approximately 104 LF vinyl bulkhead would be constructed landward of the upper limits of coastal wetlands, however, the application states that to achieve a straight alignment, the proposed bulkhead along the southern end of the property adjacent to the boat -ramp would result in locating a portion of the new bulkhead (-15 LF) within the coastal wetlands, which have volunteered within this area, aforementioned. The application states that the existing boat -ramp and associated brick stabilization walls would be excavated and removed and then replaced with new boat -ramp, measuring approximately 30' in length by 15' in width and extend to a final project depth of 4 @ normal low water (NLW). This would result in the removal of approximately 5 cubic yards (CY) of concrete and substrate. Two vinyl groins would be constructed on each side of the new boat -ramp for stabilization, each measuring from 20' to 30' in length. The application states a new access pier, measuring approximately 20' in length by 6' in width would extend from the most northern end of the new boat -ramp to assist with launching and loading vessels. Another access pier located on the central portion of the shoreline would extent into Myrtle Grove Sound, measuring approximately 32' in length by 6' in width. The pierwould then terminate onto a covered fixed platform, measuring approximately 20' in length by 20' in width, creating an "L-shaped" configuration towards the south. An access ramp would lead from the access pier onto a floating dock system, measuring approximately 80' in length by 6' in width, which would be in a "U-shaped" configuration facing west within Myrtle Grove Sound. The application states that the docking facility would accommodate up to four (4) vessels within water depths ranging from approximately -4' to -5' @ NLW. The application states that the two-story home would be constructed on pilings and that the wastewater would be treated through the municipal system. According to the application package, approximately 10,000 sq. ft. (35%) of impervious surface would cover the property, of which 30% would be located within the 75' Coastal Shoreline Area of Environmental Concern (AEC). All proposed upland development, outside the driveway leading to the proposed boat -ramp would be located landward of the Coastal Shoreline 30' Buffer (See Sheets 1 and 2 of 2 and Project Narrative). 10. ANTICIPATED IMPACTS The proposed boat -ramp replacement and associated groins would incorporate approximately 100 sq. ft. of Coastal Wetlands that primarily consist of Smooth Cordgrass (Spartina aftemiflora), which appears to have colonized on the remnant rubble within the existing boat -ramp and approximately 370 sq. ft. of shallow bottom area, essentially usurped by the existing boat -ramp. The proposed new bulkhead would incorporate approximately 100 sq. ft. of Coastal Wetlands and Section 404 type wetlands consisting primarily Salt Meadow Grass (Spartina patens) and Sea Oxeye (Bomchia frutescens), and approximately 2,080 sq. ft. of highground for the associated backfill and tie -back anchor system. The proposed access pier and docking facility would impact approximately 204 sq. ft. of Coastal Wetlands due to shading and approximately 1,000 sq. ft. of Estuarine Waters and Public Trust Areas. As proposed in the application, the proposed docking structures would accommodate up to four (4) vessels within water depths ranging from approximately 4' to -5' @ NLW. The structures appear to not exceed the Town of Carolina Beach historical pier head line nor the setback from the USACE AIWW. The proposed structures would not into the adjacent 15' riparian corridor setback requirement to the north and south. The proposed upland development for the single-family residence and associated structures would disturb approximately 10,000 sq. ft. (0.22 acres) of highground, of which approximately 30% would be covered by built upon area within the 75' Coastal Shoreline AEC. It appears the only structure that would encroach into the 30' Coastal Shoreline buffer would be the driveway leading to the proposed boat -ramp. There would be increased turbidity levels during project activity, however, if timed to avoid periods of peak biological activity, no long -tens adverse impacts are anticipated. The applicant proposes to construct a SFR, bulkhead and docking facility, and replace a boat ramp with a new associated access pier. The ramp and bulkhead will fill approximately 375ftz of coastal wetlands and §404 wetlands. The 200ft2of coastal wetlands fill associated with the ramp is habitat that has occupied the ramp overtime and is currently mowed by the applicant to allow for use of the ramp. The surrounding waters are classified as SB# and are closed to shellfish. harvest. Water. depths on,site are approximately -4ff to -5ft at normal low water. The 20ft x 6ft access pier associated with the ramp runs parallel to a vinyl groin andlimits sunlight to only one side of the pier. This design has increased potential to significantly shade wetlands which would* normally receive sunlight from either side of the pier. Pier dimensions' estimate approximately . 120ft2of.coastal wetlands could be impacted. If the access pier was.reduced in.width to 4ft, it would still provide access to the ramp while reducing the coastal wetland impact by a third (40ft2).
