On November 29, 2016, the Division of Coastal Management received a request to withdraw the permit application referenced above. As such, this file will be retired and considered closed in status. VAN DER VAART Secretary BRAXTON DAVIS RECEIV«C OCT 17 r.''; DCM- MHD Richard Wallace, has submitted a request, on behalf of Steven and Dale Matthews, to modify CAMA Major Permit No 69-16, which was originally issued on June 17, 2016. The subject permit authorized a single family residence, a 4-slip docking facility that extends into Myrtle Grove Sound, replacement of an existing boat ramp and installation of a bulkhead at 223 (221) Florida Avenue, in Carolina Beach, New Hanover County. The permit is scheduled to expire on December 31, 2019. Please note that the applicant has requested to correct the address on this permit from 223 Florida Avenue to 221 Florida Avenue. Through this permit modification request, the permittee is seeking authorization to install four (4)13 ft. by 13 ft. boatlifts within existing slips at the terminal end of the existing docking facility. According to the site drawing submitted as part of this request the boatlift for slip 4 would be located within the 15' riparian corridor setback, however the applicant owns the adjacent property to the north. In addition, the applicant would like to abandon the existing 15 ft. wide boat ramp and install an approximately 20 ft. long bulkhead along the normal high water line (NHW) to connect to the previously authorized bulkhead on each side of the ramp. The permittee is also proposing a reconfiguration of the existing decking on the rear of the residence which would result in 33 sq. ft. of additional decking within the 30 ft. Coastal Shoreline Buffer. An access measuring 6 ft. wide, including stairs, would provide access from the residence to the docking facility is also being proposed. The applicant has submitted check #9115 in the amount of $100.00 to cover the request. At this time, this office has no objection(s) to this modification request. By copy of this memo, DCM is requesting that the USACE and DWR, provide any comment that your agency may have on the proposed project to Heather Coats of DCM's Wilmington Regional Office within 14 days of receipt of this memo. Permit #69-16 authorizes the construction of a bulkhead, boat ramp, docking facility, and single family residence at 221 Florida Avenue adjacent to Myrtle Grove Sound in Carolina Beach, New Hanover County. The permittee is proposing boatlifts, measuring approximately 13 feet wide by 13 feet in length, within the foot print of the existing slips. As proposed, the boatlifts would not extend beyond the pier head line established by the Town of Carolina Beach. The permittee is also proposing a reconfiguration of the authorized open decking on the rear of the residence. This includes changes to the footprint of the open decking around the swimming pool and access to the authorized docking facility. As proposed, approximately 33 square feet of open elevated decking would be located within the Coastal Shoreline buffer. Additionally, a 6 feet wide access, including stairs would be constructed from the house to the authorized pier. As proposed, the open decking and access are consistent with 15A NCAC 07H.0209(d)(10)(D) and (F) and 15A NCAC 07K .0208 (b). Additionally, the permittee is requesting to install 15 linear feet of bulkhead at the boat ramp along the Normal High Water boundary. The permittee wishes to permanently abandon the existing boat ramp and is no longer to proposing to replace the boat ramp and associated stabilization walls and access pier. This will result in a significant decrease to the authorized impacts to the coastal wetlands by reducing the temporary and permanent impacts associated with construction of the boat ramp including, not filling the coastal wetlands with concrete, not shading the wetlands under the access pier and not constructing stabilization walls. This will allow the wetlands to reestablish and provide a buffer waterward of the proposed bulkhead. This request is in keeping with the spirit purpose and intent of the authorized development and no additional impacts to the resource are proposed. Additionally, the address on the permit should be changed to 221 Florida Avenue. Please see the attached revised permit drawing, signed signatures of no objection from the adjacent riparian property owners, an authorized agent form and a check in the amount of $100 for processing the request.
