Permit No 131-83 was originally issued on September 13, 1983 to Ed Lowe for Masonboro Boat Yard & Marina, Inc., authorizing the development of a marina facility with associated dry - stack facility, clubhouse and parking. State Permit No. 131-83 was transferred from Ed Lowe for Masonboro Boat Yard & Marina, Inc. to Masonboro Boatworks, LLC on June 7, 2005. State Permit No. 131-83 was modified to allow for upland development, which included new dry -stack storage buildings and parking on February 27, 2006 and was last renewed on June 13, 2006. State Permit No. 131-83 expired on April 30, 2008. Masonboro Boatworks, LLC recently performed maintenance excavation utilizing the spoil island directly across the AIW W, which is owned by the State of North Carolina. In a letter dated January 14, 2008 by James H. Gregson, Masonboro Boatworks were authorized use of the State owned spoil island until State Permit No. 131-83 expired on April 30, 2008. At this time the manna manager is requesting a renewal and modification to State Permit No. 131-83 to relocate the designated spoil location. The new spoil site is located approximately 1.0 mile north of the original spoil location that is privately owned by the Parsley family, which have authorized the use of their island to Masonboro Boatworks, LLC and other marina facilities in the area. This request is to relocate the designated disposal area to approximately one mile north of the original - spoil location; a site is privately owned by the Parsley family . According to the referenced memo, the Parsley family has authorized the use of their island to Masonboro Boat Works, LLC, and other marina facilities in the area. The spoil island is partially located within the U.S. Army Corps of Engineers right-of-way (see attached map). The Corps designated disposal island number for this site is 254. This office does not object to the proposed permit modification request provided the permittee, Masonboro Boatworks, LLC, obtains a written consent agreement from the Corps of Engineers to utilize Disposal Island No. 254 prior to any maintenance dredging or any use of the disposal island and that the disposal activities will not result in any wetland impacts. Do you have any issues with this?
