This permit, issued on ,Irene 13, 2006 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set -forth below. Any violation of these terms may
De subject to lines, imprisonment or civil action; or may cause me permit to oe nun anu votu.
1) Unless specifically altered herein, this minor modification authorizes the 140' 10" x 6' floating dock, the
125' 6" x 6' floating dock including the associated gangway ramp; as well as the (5) 30' x 3' 6" finger
piers, that de expressly and specifically set forth in the attached workplan drawings dated 3/20/06. No
other structures, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification.
2) All material resulting from the removal of the existing pier shall be placed on an approved upland
disposal site.
3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
(See attached sheet for Additional Conditions) .
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work of project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
April 30, 2008
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
.waters at or adjacent to the authorized work.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
8) This permit authorizes, a maximum of eight new (8) boat slips.
General
9) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative,, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove,, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
10) This minor modification/renewal shall be attached to the original of Permit No. 131-83, which was
transferred to the permittee on 6/7/05, as well as all subsequent modifications, renewals, and
refinements, and copies of all documents shall be readily available on site when Division personnel
inspect the project for compliance.
11) All conditions and stipulations of the active permit remain in force under this minor
modification/renewal unless altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

Dear Sir or Madam:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff -
colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff -colored form), as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved: If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

This request is for a minor modification to our existing permit 131-83. I am requesting
permission to allow Sound Marine to build a 140' 10" floating dock along our bulkhead.
We will need to drive 4 additional pilings to support the floating dock as indicated on the
attached Sound Marine plan.
We would like to begin construction on this as soon as possible, as it will provide
necessary staging for our new dry rack facility.

Ms. Raine Williams, General Manager of Masonboro Boatworks LLC, is requesting renewal of State Permit
# 131-83 for retaining the maintenance -dredging clause. State Permit # 131-83 1 Ph renewal was on 5/31/01 and was
recently modified on 2/27/06 for additional upland development. State Permit # 131-83 is due to expire on April 30,
2006. Ms Williams states that no other changes are requested at this time. In January 2006, staff from DCM
Wilmington Regional Office conducted a site visit to Masonboro Boatworks, LLC existing marina to determine
compliance with their Minor Modification to CAMA Major Permit # 131-83, issued on I I/14/84, condition #10,
which states: prior to occupancy to any new slips a pumpout facility must be installed. It was determined that a
pumpout was not installed during this site visit and phone conversation.
This Office recommends that this facility be brought into compliance with a functioning pumpout facility
prior to the renewal of Permit # 131-83. The applicant has included a check (ck no. 3066) in the amount of $100.00
for the renewal.

Raine Williams, General Manager with Masonboro Boatworks, LLC, has submitted a request to modify State
Permit No. 131-83. Permit No 131-83 was originally issued on September 13, 1983 to Ed Lowe for Masonboro Boat Yard
& Marina, Inc., authorizing the development of a marina facility with associated dry -stack facility, clubhouse and parking.
State Permit No. 131-83 was transferred from Ed Lowe for Masonboro Boat Yard & Marina, Inc. to Masonboro
Boatworks, LLC on June 7, 2005. State Permit No. 131-83 was recently modified to allow for upland development, which
included new dry -stack storage buildings and parking on February 27, 2006 and expired on April 30, 2006. Masonboro
Boatworks, LLC requested renewal of State Permit No. 131-83 on April 4, 2006 and is currently under review.
At this time the General Manager is requesting a modification to State Permit No. 131-83 to authorize an additional
floating dock, measuring 140' 10" in length by 6' in width to be installed to accommodate the recently authorized dry -stack
facility located on the western end of the property. The floating dock would be constructed along the existing bulkhead
located on the northwestern side of the property, which the applicant states would be utilized as a staging area for boats
launched from the new dry -stack facility only. The General Manager is also requesting the reconfiguration of the current
docking structures located at the most western end of the property, which would also be adjacent to the recently authorized
dry -stack location. The new floating dock for the dry -stack staging area would turn 90 degrees to the south into a new
floating dock, measuring 125'6" in length by 6' in width, which would run parallel along the shoreline. Four floating
finger piers 30' in length by 3'6" in width would be installed along this floating dock approximately 27' apart with four
mooring pilings, one between each finger pier, to accommodate the authorized eight slips for this section of the marina.
These finger piers would be run perpendicular to the shoreline. These proposed docks would also be accessed by a
gangway ramp located adjacent to the dry -stack location. The agent states that no other changes or modifications are being
requested to the existing marina dock system.
The agent has submitted a check (check No. 3166) in the amount of $100 for the modification request. This office
has no objections to the proposed modifications.

Masonboro Boatworks, LLC is requesting permission to install 8 additional wet slips on
the south west side of the marina. These 8 wet slips were approved in May of 1983 under
our General Permit 131-83. (Please see attached copy of permit.) Currently there are
several wooden floating docks in the area, which will be removed and 8 new slips will be
installed according to the Sound Marine drawings that follow.
The docks will run North / South at approximately 34 degrees 09.451 minutes North and
077 degrees 51.449 minutes West to 34 degrees 09.444 minutes North and 077 degrees
51.470 West. Coordinates are listed on the attached Sound Marine drawing.
In order to install 8 additional wet slips we will need to mechanically remove 730 cubic
yards of silt. This silt will be deposited on the property owned by Kirk Pigford at the end
of Trails End Road. Silt fencing will be erected and no marsh grass will be disturbed at
the disposal site. Please refer to the attached spreadsheet showing current depths and the
amount of silt that will need to be removed. This area was permitted to a dredge depth of
8 feet under our General Permit 131-83.
As you and I discussed, our belief is that a "letter of refinement' will allow us to begin
working on this project. Please let me know if you need any additional information and

This is with reference to the request submitted by you to modify State Permit No. 131-83. Permit No
131-83 was originally issued on September 13, 1983 to Ed Lowe for Masonboro Boat Yard & Marina,
Inc., authorizing the development of a marina facility with associated dry -stack facility, clubhouse and
parking. State Permit No. 131-83 was transferred from Ed Lowe for Masonboro Boat Yard &
Marina, Inc. to Masonboro Boatworks, LLC on June 7, 2005 and expires on April 30, 2006.
The action proposed in your submittal consists of allowing annual maintenance to the entrance channel
of the Masonboro Boat Yard & Marina by mechanical means. The initial maintenance would be a
one-time event with approximately 392 cubic yards of excavated material utilized on an upland area of
the Masonboro Boat Yard & Marina. The existing permitted spoil island adjacent to the Masonboro
Boat Yard & Marina and the AIWW would remain as the primary site for future maintenance.
Upon review of the proposed plat submittal, I, in conjunction with Doug Huggett with the Division of
Coastal Management Permitting Section, have determined that the proposed action is consistent with
existing State rules and regulations and is in keeping with the original purpose and intent of the
permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit #131-
83, as described in your transmittal letter and plans dated 4/26/06, which was received in our office
on 4/27/06.

Thanks for taking time to review the many projects that we are working on at Masonboro Boat Yard.
As you and I discussed, we would like to mechanically remove silt from our entrance channel annually. The
materials will be removed by mechanical means and deposited on site this year and in future years deposited
on our designated "spoils site' opposite the marina. I have attached a spreadsheet indicating the current
depths and the depths that we are permitted to dredge to, plus the calculated number of cubic yards that we will
have removed. For 2006 only, the materials will be deposited on an upland site on our property and if
necessary on the property at the end of Trails End Road. The site will not disturb any marsh grass and will
have silt fencing erected to contain the materials. In accordance with DENR regulation, we will keep the
materials at least 30 feet from the high water line.
We believe that annual removal of the silt at the entrance channel will facilitate in keeping the inner harbor more
silt free, therefore the need to dredge the entire marina will not be necessary as often.

1) Unless specifically altered herein, this minor modification authorizes the 140' 10" x 6' floating dock, the
125' 6" x 6' floating dock including the associated gangway ramp, as well as the (5) 30' x 3' 6" finger
piers that are expressly and specifically set forth in the attached workpian drawings dated 3/20/06. No
other structures, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification.
2) All material resulting from the removal of the existing pier shall be placed on an approved upland
. disposal site.
3) No sewage; whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible . on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
April 30, 2008
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure orwork, or injury
which may be caused from existing or future operations undertaken by the United States in the public.

7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
8) This permit authorizes. a maximum of eight new (8) boat slips.

9) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative,, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
10) This minor modification/renewal shall be attached to the original of Permit No. 131-83, which was
transferred to the permittee on 6/7/05, as well as all subsequent modifications, renewals, and
refinements, and copies of all documents shall be readily available on site when Division personnel
inspect the project for compliance.
11) All conditions and stipulations of the active permit remain in force under this minor
modification/renewal unless altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that maybe required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

Dear Madam or Sir:
Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to modify your Department of the Army (DA) permit issued on October
3, 1983, which authorized maintenance of marina facilities on Whiskey Creek and the Atlantic
Intracoastal Waterway, near Wilmington, New Hanover County, North Carolina. The requested
modification consists of the construction of a 45-slip dry stack facility at the project site (see
enclosed CAMA modification).
The proposal continues to be consistent with the provisions and objectives of general permit
No. 198000291. The permit is hereby transferred. It is understood that all other conditions of
your permit remain applicable and will expire April 30, 2006.
