Dry -Stack Facility 1) Unless specifically altered herein, this minor modification authorizes the 45-slip dry -stack facility that is expressly and specifically set forth in the attached workplan drawing dated "sheet 2 of 2" 8/4/05. No other structures, whether floating or stationary, shall become a permanent part of this dry -stack facility without permit modification. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands all permit requirements. Innw� au�� G1r�d-i 'ii otia�� r' a uir1e /15/2005 11:08 9107919777 MASONBORO BOAT YARD PAGE 02 COUNTY OF NEW HANOVER STATE OF NORTH CAROLINA ORDER GRANTING A SPECIAL USE PERMIT For A Marina Parking Expansion to Masonboro Yacht Club in a R-15 Zoning District S-536, 09/05 The County Commissioners for New Hanover County having held a public hearing on October 3, 2005 to consider application number S-536 submitted by Masonboro Boatworks, Inc. for a special use permit to expand marina parking in a R45 Residential District located at 609 Trail Ends Road and having heard all of the evidence and arguments presented at the hearing, make the following FINDINGS OF FACT and draw the following CONCLUSIONS: The County Commissioners FIND AS A FACT that all of the specific requirements set forth in Section 72-27 of the County Zoning Ordinance WILL be satisfied if the property is developed in accordance with the plans submitted to the County Commissioners. 2. It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the first general requirement listed in the Ordinance; namely that the use will not materially endanger the public health or safety if located where proposed and developed according to the plan as submitted and approved. In support of this conclusion, the Commissioners make the following FINDINGS OF FACT: A. The subject property is approximately 15,000 square feet in size and will contain a total of 29 additional parking spaces. B. The property will be served by the Myrtle Grove VFD. C. Access to the parking area will be through Purviance Avenue. D. Marina parking to the boatyard/yacht club has existed for many years. It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the second general requirement listed in the Ordinance; namely that the use meets all required conditions and specifications. In support of this conclusion, the Commissioners make the following FINDINGS OF PACT: A, The subject property is located in a R-15 Residential Zoning District. Additional parking is allowed to an existing facility in a R-15 District by Special Use Permit. B. Landscaping of the parking area will be provided as required by the New Hanover County Zoning Ordinance. C. A grassed parking area is proposed. D. Existing trees will remain- E. No conservation resources exist on site. 4. It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the third general requirement listed in the Ordinance; namely that the use will not substantially injure the value of adjoining or abutting property, or that the use is a public necessity. In support of this conclusion, the Commissioners make the following FINDINGS OF FACT: A. The primary use of the parking expansion is to accommodate overflow traffic from Masonboro Yacht Club that occurs several times per year. B. The proposed parking expansion will reduce traffic on Purviance Avenue, C. The proposed parking expansion will benefit adjoining landowners by improving the site as it presently exists. 15/2005 11:08 9107919777 MASONBORO BOAT YARD PAGE 03 4 NOV 1 5 2005 Morehead City OCM 5, It is the County Commissioners' CONCLUSION that the proposed use DOES satisfy the fourth general requirement listed in the Ordinance: namely that the location and character of the use if developed according to the plan as submitted and approved will be in harmony with the area in which it is to be located and in general conformity with the plan of development for New Hanover county. In support of this conclusion, the Commissioners make the following FINDINGS OF FACT: A. The area is classified as Resource Protection on the County's Land Use Plan. B. The site plan calls for a grassy parking type area which will help minimize impacts to nearby waterway areas.. 6. Therefore, because the County Commissioners conclude that all of the general and specific conditions precedent to the issuance of a SPECIAL USE PERMIT HAVE been satisfied, IT IS ORDERED that the application for the issuance of a SPECIAL USE PERMIT BEGRANTED subject to the following conditions: A. That the applicant shall fully comply with all of the specific requirements stated in the Ordinance for the proposed use, as well as any additional conditions hereinafter stated. B. If any of the conditions imposed by this special use permit shall be held invalid beyond the authority of this Board of Commissioners by a court of competent jurisdiction, then this permit shall become void and of no effect. C. Other: 1) All other applicable federal, state and local laws. 2) Extra care be taken in the protection of the live oaks on the property with minimal impacts on the root system. We have arranged for Pour Season's Earthworks, Inc, to handle the demolition of the buildings. They have advised me that the materials from the demolition will be disposed of at Wilmington Materials or New Hanover Landfill. The asbestos will be disposed of properly at the New Hanover County Landfill, We hope to complete the demolition no later than xanuary 31, 2006. Ross Jr., Secretary Steve Morrison with Land Management Group, Inc. and acting agent for Masonboro Boatworks, LLC, has submitted a request to modify State Permit No. 131-83. Permit No 131-83 was originally issued on September 13, 1983 to Ed Lowe for Masonboro Boat Yard & Marina, Inc., authorizing the development of a marina facility with associated dry -stack facility, clubhouse and parking. State Permit No. 131-83 was transferred from Ed Lowe for Masonboro Boat Yard & Marina, Inc. to Masonboro Boatworks, LLC on June 7, 2005 and expires on April 30, 2006. At this time the agent is requesting a modification to State Permit No. 131-83 to authorize an additionl dry -stack facility, which would be 3 stories and provide storage for up to 45 boats. The agent states that the new dry -stack facility would be located on existing concrete and rock impervious surfaces. The agent is also requesting authorization, in conjunction with the new dry -stack facility, an additional overflow parking area. The agent states a special use permit from New Hanover County is be requested by the applicant to authorize this parking area on the R15 parcel. A stormwater control submittal would also be made to the N.0 Division of Water Quality. The agent states that no changes or modifications are being requested to the existing dock system. The agent has submitted a check (check No. 25577) in the amount of $100 for the modification request. This office has no objections to the proposed modifications. A special use permit from New Hanover County is being requested by the applicant to authorize this parking area on the RI parcel.
