Edward Lowe, President Masonboro Boat Yard and Marina, Inc. 609 Trails End Road Wilmington, NC 28409 Dear Mr. Lowe: This is with reference to your request to modify State Permit # 131-83 which was issued on September 5, 1995 and will expire on April 30, 1997. The action proposed in your submittal is the relocation of an existing structure from one area to another and the addition of stories to the bathroom facility, the footprint of which was approved recently and both of which are located in the Estuarine Shoreline Area of Environmental Concern. All approved stormwater measures must be utilized in order to satisfy the approved septic tank system approach to the management of run-off from the facility. The project is located within the Masonboro Boatyard property in New Hanover County. Upon reviewing the submittal I have determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit # 131- 83 as described in your letter and plans dated February 28, 1996 and received in our office on that same date. By copy of this letter we are also notifying the U. S. Army Corps of Engineers of our action. If you have any questions concerning the above or if I can be of any other assistance, please advise. BOX 1890 WILMINGTON, NORTH CAROLINA 29402-1890 REPLY TO ATTENTION OF January 30, 1996 Regulatory Branch Action ID No. 198300193 and State Permit No. 131-83 Mr. Ed Lowe, President Masonboro Boatyard and Marina, Inc. - 609 Trails End Road Wilmington, North Carolina 28409 Dear Mr. Lowe: Through coordination with the North Carolina Division of Coastal Management (NCDCM), we have learned of your request for authorization to maintenance dredge approximately 300 to 350 cubic yards of material from a 30 foot wide by 60 foot long section of an existing access channel to the Atlantic Intracoastal Waterway, at the Masonboro Boatyard and Marina, in Wilmington, New Hanover County, North Carolina. Your proposal continues to be consistent with the provisions and objectives of general permit No. CESAW-0080-N-000-0291. Therefore, you may continue your construction activities in strict accordance with your approved State authorization and the conditions stated in the January 8, 1996, letter from NCDCM. Failure to comply with the State authorization or conditions of the general permit could result in civil and/or administrative penalties. If there is a need to further extend the duration of this Federal authorization, or if any change in your work is required because of unforeseen or altered conditions or for any other reason, a written request for renewal of authorization or plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Such action is necessary as specific renewal of authorization must be obtained or revised plans must be reviewed and the authorization modified. A request for extension of authorization must be received no later than thirty (30) days before expiration of the permit.
