No non - water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2) The Division of Environmental Management approved this project under stormwater management rules of the Environmental Management Commission on 12/20/94. Any violation of or deviation from the plan approved by the DEM will be considered a violation of this CAMA permit. 3) This modification must be attached to the renewal and attachments authorized on 2/15/88 and all subsequent renewals and modifications, and all documents must be readily available on site when a Division representative inspects the project for compliance. All conditions and This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on April 30, 1997 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. SUSIE BRIGMAN OFFICE MANAGER Dear Mr. Lowe: 1� UEHNR JAN � 1A1996 MANAGEMENT I meet with Mr. Brian Bullers this morning to discuss the proposed maintenance dredging for the work authorized by State Permit k 131-83 for Masonboro Boat Yard (MBY), New Hanover County. From the information provided, the work area will be located near the AIWW end of the existing access channel. The purpose of the work will be to remove material down to the project depth of -8' mlw in order to allow fixed -keel vessels the continued use of the facilities offered by MBY. The dimensions of the cut will be approximately 30' wide by 60' long. Approximately 300 to 350 cu. yds. of material will be removed by mechanical excavator. The material will be transported to a spoil site owned by Shore Acres Company, Inc. located on the east side of the AIW W. A letter authorizing the use of this site, from Dr. Lawrence Lea, has been submitted by the dredger. This letter authorizes the proposed work and allows for the use of the alternate disposal site. Mr. Butlers has been directed to utilize silt curtains to control the material he places on the Shore Acres Property. At no time should material excavated from your channel be allowed to reenter the State waters or wetlands. Lowe Masonboro Boatyard & Marina 609 Trails End Road Wilmington, NC 28409 Dear Sir: The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A- 121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, P.O. Dmwer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. Mr. Lowe has been the owner since the original permit was issued. The request is to add two restrooms to an area that would be considered impervious currently because of the gravel lain in the area. Mr. Lowe has purchased and installed two septic tanks on an adjacent lot in the past year to serve as an innovative stormwater design because his impervious coverage greatly exceeds that allowed. DEM has approved this design, and Mr. Lowe has tied his drainage system into it. The waste from the restroom facilities would discharge into the county sewer system. Mr. Lowe also requests the relocation of a dock previously approved. The dock was approved with tie pilings to allow for 8 slips. The pilings were never installed, and Mr. Lowe now wishes to utilize the structure for a working dock in the new location. I recommend the modification be authorized as proposed. The bathrooms will be built under the existing eve of the breezeway. The waste will go to the county treatment center. A certificate of compliance with stormwater regulations, Stormwater Project No. SW8 940912 has been issued. I would also like to modify my dock layout behind the repair shop The eight slips that were permitted were never built. The attached drawing shows that only the dock colored green was built. No tie pilings for the 8 slips were driven. Permission to place the dock colored hot pink to indicate the location on the attached sight plan is requested. Thank you for your assistance with this. Your proposal continues to be consistent with the provisions and objectives of general permit No. CESAW-CO80-N-000-0291. It is understood that all conditions of the original permit remain applicable and that the expiration date is unchanged.
