Brigman Masonboro Boat Yana and Marina, Inc. 609 Trails End Road Wilmington, North Carolina 28403 Re: Request to Modify State Permit No. 131-83 Dear Ms. Brigman: Roger N.Schecter Director I have reviewed your request to modify State Permit #131-83 by adding a 12' x 25' fork lift ramp, a 6' x 50' floating dock, and a 6' x 35' floating dock, by changing the approved 3-story open pole building to a dry stack storage area with a roof and enclosed ends, and by adding a new office building. I find your request consistent with existing State rules and guidelines and in keeping with the intended use and practice of the project. I hereby submit this letter of refinement authorizing the requested changes as Shown on Your sketches dated September 27, 1990 with the following stipulations: 1. The dry stack storage area must be restricted to the same dimension as the originally approved building and the stormwater must be collected and directed by gutters to a subsurface area. 2. Before construction of the proposed new office building you must provide this office doclmlentation that the necessary calculations were performed to determine that the new structure does not cause the project impervious area to exceed the 30% coverage regulation. If the 30% coverage regulation will be exceeded, you must provide evidence that an innovative stormwater collection system has been designed for the project which will meet the 30% coverage regulation. This authorization is contingent upon approval by the U. S. Army Corps of Engineers. Please contact Bob Stroud if you have any questions. merely, James H. Lowe, Jr. (for Masonboro Boatyard and Marina) Date: November 8, 1990 • Mr. Lowe has recently submitted information and plats requesting the change of his project from a 3 story open pole constructed building to a dry stack storage with roof and two ends enclosed. The unit would hold 72 boats. Since the approved building was the same dimension as the proposed dry stack and the stormwater was to be collected and directed by gutters to a subsurface area we do not deem. this as a significant change. The 12' x 25' fork lift ramp and the floating docks are not considered as a significant change or as having a significant impact. I would recommend a letter of refinement to Ms. L. B. Brigman authorizing the above changes. With respect to the new office this may cause the impervious area to exceed the 30% regulation. I am requesting Ms. Brigman to have calculations performed and if necessary an innovative system designed before we authorize the construction of the office. If there are questions, please advise. Brigman 609 Trails End Road Wilmington, North Carolina 28403 Dear Gentlemen: Through coordination with the North Carolina Division of Coastal Management, we have learned of a second refinement of your State permit which authorized maintenance of marina facilities on Whiskey Creek and the Atlantic Intracoastal Waterway (AIWW), New Hanover County, North Carolina. The first refinement provided for excavation of a 63-foot-long, 12-foot-wide area and construction of a bulkhead. This second refinement authorizes a 12-foot by 25-foot forklift ramp, two floating docks and highground alterations. Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. CESAW-CO80-N-000-0291. Therefore, you may commence construction activity in strict accordance with the refined State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in civil and/or administrative penalties. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration.
