Re: Request for Modification of State Permit #131-83 Dear Mrs. Brigman: I have reviewed your request to modify State permit #131-83 by increasing the amount of dredging and the addition of a new bulkhead. I find your request consistent with existing State rules and guidelines and in keeping with the original intended use and practice of the project. I hereby submit this letter of refinement authorizing the modification as described in your letter dated May 22, 1989. Herstine From: Marc Botbol Subject: Request for Permit Modification of Permit #131-83 Masonboro Boat Yard and Marina, Inc. Date: June 7, 1989 Mrs. Louise Brigman, Manager of the Masonboro Boat Yard and Marina, Inc., is requesting the following modification to their existing permit to include: a) Maintenance dredging along the existing bulkhead approximately 63' x 12' x +/- 7' mlw. b) Addition of a new bulkhead along the perimeter of the repair shop. Total length of the new bulkhead will be approximately 80- (see attached plan) . I have discussed the project with James H. Herstine, District Manager in our office, and we have no objection to the proposed modification. We recommend that the request for modification be granted. BOX 1890 WILMINGTON, NORTH CAROLINA 28402-1890 November 15, 1989 IN REPLY REFER TO Regulatory Branch SUBJECT: File No. CESAW-0083-N-065-0193 and State Permit No. 131-83 Ms. Louise Brigman Masonboro Boat Yard and Marina, Incorporated 609 Trails End Road Wilmington, North Carolina 28403 Dear Ms. Brigman: Through coordination with Mr. James Herstine of the North Carolina Division of Coastal Managment, we have learned of the refinement of your State/Federal permit which authorized maintenance of marina facilities on Whiskey Creek and the Atlantic Intracostal Waterway (AIWW), southeast of Wilmington, New Hanover County, North Carolina. This refinement provides for maintenance excavation of an additonal 63-foot-long, 12-foot-wide area and construction of approximately 80 linear feet of bulkhead. This proposed modification has been reviewed and found to be consistent with the provisions and objectives of general permit No. CESAW-0080-N-000- 0291. Therefore, you may commence construction activity in strict accordance with the refined State authorization. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any additional change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration.
