This permit, issued on +Z'/9 ` DA , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may subject
perrtittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The project must be carried out in keeping with eight (8) plats dated received
6/15/83 including mod. Sheet A of E which deletes dredging at "Oyster Rock"
and two boat slips 'near "Existing Repair Shop"; three (3) sheets for new
marina layout with sheet 1 of 2 dated "mod. Oct. 23, 1984," sheet 2 of
2 dated "Sep., 1904" and "Modification of Marina Expansion" or "Mod. C
of E" dated Oct. 23, 1984; and 2 sheets dated received 1/17/86. (Note:
Where there is an apparent discrepancy between plats, the more recent plats
apply.)
(2) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between the dates -of April 1 through September 30 of
any year without the prior approval of the N. C. Division of Coastal Management.
(3) In order to minimize the loss of oyster resources, those organisms growing
within the proposed work area must be relocated to an approved rock under
the direction of the DCM and the Division of Marine Fisheries (re: sheet,
"mod. C of E ") .
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
Ibis permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
Ali work must cease when the permit expires on
December 31, 1986
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(4) The completed diked disposal area must be inspected and approved by a repre-
sentative of the Division of Coastal Management and/or the Corps of Engineers
prior to any dredging.
(5) All excavated materials' will be confined landward of the mean,,:high:,water

due to financial difficulties there will be a delay in completing our total
building project as outlined in North Carolina permit number 131-83 issued on
August 13, 1984.
This delay could extend over a period of several seasons. During this time
we will maintain renewal of our permit by requesting the renewal in writing
one month prior to its expiration. If there are any additional requirements

penmittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
2(l) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between the dates of April 1 through September 30 of any
3(y) year without the pripr approval of the N.C. Office of Coastal Management.
Use of the AIWW Federal easement area for disposal of dredged material
N f e is at the discretion of the Corps of Engineers and any future maintenance
activity utilizing this area must be approved by same.

4 ('3) The completed diked disposal area will be inspected and approved by a represen-
tative of the Office of Coastal Management and/or the Corps of Engineers
prior to any dredging.
'(A) All excavated materials will be confined landward of the mean high water
elevation within adequate dikes or other retaining structures to prevent
spillover of solids into any marsh or surrounding waters.
(-(5.) The terminal end of the pipeline from the dredge into the diked retention
area will be positioned at or greater than 50 feet from any part of the
dike and at a maximum distance from spillways to prevent dike erosion and

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
N December 31, 1986
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

•-)('6) A water control structure will be installed at the intake end of the effluent
pipe leading from the retention area in order to insure maximum settlement
of suspended solids.
6 (�) Flow from the diked retention area will be confined by pipe, trough, or
similar device to a point at or below the mean low .water to prevent gully
erosion and resultant unnecessary siltation.
� (8) No marshland will be excavated and/or filled.
iv (g) Prior to occupancy of any new slips authorized under this .permit, the permittee
will permanently equip the marina with a pump -out facility to service boats
with holding tanks.
(M) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations
for on -shore sewage treatment.
!?-Ml) A locked head policy must be posted and enforced at .the marina.
NOTE: It is strongly recommended that the permittee exercise -all available
precautions in the day-to-day operation of the facility to prevent sand
blasting residue and/or other facility waste from entering the adjacent
waters. Such discharge, .either directly or indirectly, to adjacent waters
could contravene state water quality standards, thereby violating state
law.

be permitted between the dates of April 1 through Septerrber 30 of any year
without the prior approval of the N. C.-Of-f-4ce of Coastal Management.

(3) In order to minimize the loss of oyster resources, those organisrns growing with—
in the proposed work area mast be relocated to an approved rock under the direc—
tion of the-GCM and the Division of Marine Fisheries (re: sheet, " mod. C of E")
(4) The conpletedd diked disposal area mast be inspected and approved by a represen-
tative of the-O.f•fi-ee of Coastal Management and/or the Corps of Engineers prior

This permit action may be appealed by the perrittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1986
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(5) All excavated materials will be confined landward of the mean high water eleva-
tion within adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters.
(6) The terminal end of the pipeline from the dredge into the diked retention area
will be positioned at or greater than 50 feet from any part of the dike and
at a maximum distance from spillways to prevent dike erosion and to allow ade-
quate settlement of suspended solids.
(7) A water control structure will be installed at the intake end of the effluent
pipe leading from the retention area in order to insure maximum settlement of
suspended solids.
(8) Flow from the diked retention area will be confined by pipe, trough, or similar
device to a point at or below the mean low water to prevent gully erosion and
resultant unnecessary siltation.
(9) No marshland will be excavated and/or filled.
(10) Prior to occupancy of any new slips authorized under this permit, the permittee
will permanently equip the marina with a purrp-out facility to service boats
with holding tanks.
(II) All floating structures, other than boats, used for habitation or com erce (as
defined in 15 NCAC 7M .0602) shall be in conformance with local regulations
for on -shore sewage treatment.
(12) A locked head policy must be posted and enforced at the marina.
NOTE: It is strongly recommended that the permittee exercise all available precau-
tions in the'day-today operation of the facility to prevent .sand blasting
residue and/or other facility waste from entering the adjacent waters. Such
discharge, either directly or indirectly, to adjacent waters could contravene
state water quality standards, thereby violating state law.
NOTE: Use of the AINW Federal easement area for disposal of dredged material is
at the discretion of the Corps of Engineers and any future maintenance acti-
vity utilizing this area rrust be approved by same.

Enclosed please find plans for a building that would complete my rebuilding
from Hurricane Diana.
The building will be a pole building 251 wide x 160' long. It will be constructed
immediately south of and attached to my existing stationary dock and boat shed.
The building will be constructed of heavy osmose timbers, the roof of corrugated
tin. Rain water will be guttered on both the new building and the boat shed.
The run off will be deposited through leach fields under the gravel parking lot.
The structure will be built with open sides and will be enclosed with walls as
they are needed. There will be no enclosed space over mean high water. The
structure will exceed all building codes for coastal construction.
The aftermath of Hurricane Diana has been quite an education. I would like to
thank you for all the help and consideration that has been given to the rebuilding
of Masonboro Boat Yard.

Attached is Mr. Lowe's request for the relocation of his office and marina
service area to the indicated location. He has indicated that all roof drains will
be guttered to the area landward of the proposed building and will be placed in Peach
fields. The initial construction of the building will be semi -open. No areas
over the water will be enclosed.
We discussed this by telephone on January 21, 1986 and I recommended a minor
modification and/or letter of refinement.
