This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between the dates of April 1 through September 30 of any
year without the prior approval of the N.C. Office of Coastal Management.
(2) Use of the AIWW Federal easement area for disposal of dredged material
is at the discretion of the Corps of Engineers and any future maintenance
activity utilizing this area must be approved by same.
(3) The completed diked disposal area will be inspected and approved by a represen-
tative of the Office of Coastal Management and/or the Corps of Engineers
prior to any dredging.
(4) All excavated materials will be confined landward of the mean high water
elevation within adequate dikes or other retaining structures to prevent
spillover of solids into any marsh or surrounding waters.
(5) The terminal end of the pipeline from the dredge into the diked retention
area will be positioned at or greater than 50 feet from any part of the
dike and at a maximum distance from spillways to prevent dike erosion and

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1986
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(6) A water control structure will be installed at the intake end of the effluent
pipe leading from the retention area in order to insure maximum settlement
of suspended solids.
(7) Flow from the diked retention area will be confined by pipe, trough, or
similar device to a point';at or below the mean low water to prevent gully
erosion and resultant unnecessary siltation.
(8) No marshland will be excavated and/or filled.
(9) Prior to occupancy of any new slips authorized under this permit, the permittee
will permanently equip the marina with a pump -out facility to service boats
with holding tanks.
(10) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations
for on -shore sewage treatment.
(11) A locked head policy must be posted and enforced at the marina.
NOTE: It is strongly recommended that the permittee exercise all available
precautions in the day-to-day operation of the facility to prevent sand
blasting residue and/or other facility waste from entering the adjacent
waters. Such discharge, either directly or indirectly, to adjacent waters
could contravene state water quality standards, thereby violating state
law.

Upon completion of the review of the project as proposed, we have determined that the
following inconsistencies with CAMA standards are present:
1. Inconsistent with 7H .0208 (b)(1) - in that areas classified as primary nursery
areas are located within the project proposal.
2. Inconsistent with 7H .0208 (b)(5)(A) - for the above reason.
3. Inconsistent with 7H .0208 (b)(5)(B) - that shallow water areas will be dis-
turbed - non -wetland sites are not utilized.
Also, we find that the project is inconsistent with G.S. 113-229 (e)(2) may exist.
Based on the contents of the letters of objection received from adjacent riparian
owners, inconsistencies with G.S. 113-229 (e)(2) may exist.
There also appears to exist the probability that the project is inconsistent with
the Land Use Plan. We will ask for a determination from the County.
We have informed Mr. Lowe that due to the primary nursery areas involved, our recom-
mendation would be against the issuance of a permit to cover the new work. We also
explained that he has a right to appeal. It appears that from the supplemental
information presented in the application, he intends to build a case for an appeal.
We recommend that the permit be denied based upon the inconsistencies stated above.

I have reviewed the permit application for the proposed project at Masonboro
Boat Yard. The project is located in an area designated as a primary nursery
area by the Division. Post -larval finfish and crustaceans utilize these
areas when they first recruit to a system because they afford food, cover and
protection from predation. Deepening of a primary nursery area changes its
character so that it is not conducive to the recruitment and survival of
these post -larval forms. The cumulative loss of primary nursery areas along
the coast due to dredge and fill activities caused the Marine Fisheries
Ccamission to pass a regulation protecting these areas from further altera-
tion. The new work at Masonboro Boat Yard would represent a permanent loss
of nursery area to the system. Maintenance of the existing channel and dock-
ing areas would not represent any additional loss of nursery to the area.

We have received the above permit application and would like to comment.
This area of the state is extremely rich in prehistoric occupation
sites. Several different types of archaeological sites have been
recorded within this area, ranging from temporary hunting camps, to
larger base camps, to more sedentary occupation sites. Several archaeolo-
gical sites of the historic period are also recorded within the study
area.
Although there are no archaeological sites recorded within the project
boundaries, twenty archaeological sites are recorded within a 2000 meter
radius. Several of these sites contain evidence of both historic and
prehistoric occupations. The topographic setting of the project area
and the abundance of recorded sites suggest a high probability for the
location of unknown resources within the proposed area of excavation.
It is recommended that a comprehensive survey be conducted by an ex-
perienced professional archaeologist to identify the presence and
significance of archaeological remains that may be damaged or destroyed
by the proposed marina basin enlargement. Potential effects on unknown
resources should be assessed prior to the initiation of any construction
activities.
We have also reviewed the proposed project in terms of submerged cultural
resources. Staff members inspected the project specifications carefully
and determined that the enlargement dredging constitutes a major bottom
disturbance.
We do want to notify you, however, if during this proposed project
cultural materials are encountered, it is the -responsibility of the
Corps of Engineers -Wilmington to notify this office immediately, pursuant
to Section 106 of the National Historic Preservation Act of 1966. In
addition, the area is protected by North Carolina legislation (Salvage
of Abandoned Shipwrecks and Other Underwater Archaeological materials on
all bottoms from low water to one marine league seaward, and bottoms of

other navigable waters, shall be "subject to the exclusive dominion and
control of the State"). This law is supported by federal legislation in
the Submerged Lands Act (P.L. 8531; 67 Stat. 29). The Federal law gives
the states jurisdiction over the lands and natural resources beneath
navigable waters.

Members of the staff of the Wilmington Regional Office have reviewed
the application for the subject project. The applicant proposes to maintain
and enlarge an existing marina and to construct a fixed pier and floating
docks. All work is to be to -8' MLW and is to connect with the AIWW channel.
In total, approximately 53,000 cubic yards of silty sand and shell are to be
excavated by hydraulic dredge and deposited in an existing Corps disposal
area. As indicated in a memo dated December 22, 1982, it appears that the
project meets the conditions of the General Certification for Diked Disposal
Areas.
There are presently approximately 25 full time residents living in boats
in the marina. Additionally, there are five floating homes that are occupied.
The management has a stated "closed -head" policy, and provides toilet and
shower facilities on shore. It is estimated, however, that the majority of the
boats have the old style marine toilets and may, on occasion, discharge.
Several of the boats have holding tanks and several have Coast Guard approved
marine sanitation discharging facilities which may be used on occasion. Of
the floating homes, two are connected to septic tank systems on shore, one has
no toilet, and two have discharging marine sanitation devices which are used
regularly. Because of the confusion concerning responsibility for regulation
of floating homes, the management does not intend to allow additional homes to
locate at the marina until this is resolved.
The proposed project will approximately double the number of boat slips.
On January 21, 1983, in response to an inquiry from our Wilmington Office,
Captain Edward Grace, Commanding Officer of the USCG Marine Safety Office,
Wilmington, stated that in his opinion, floating homes are vessels as defined
by 33 CFR 159.3(0). The general requirement is that any vessel equipped with
installed toilet facilities must utilize a Coast Guard approved processing
marine sanitation device or have the capability of holding the waste on board
until it can be pumped ashore. A vessel that is connected to a shoreside sewer
system would also meet the criteria of the latter device.
Discharges from vessels at this marina, however, have been the source of

citizen complaints and concern on the part of regulatory agencies. This
office is particularly concerned about the potential for additional discharges
posed by this project.
The waters of Whiskey Creek and the Intracoastal Waterway in the vicinity
are classified "Class SA". Since our regulations prohibit discharges to these
waters, it would seem inconsistent to certify that no adverse impact to water
quality would result from what is anticipated to be increased discharges of
inadequately treated domestic wastewater due to increased availability of boat
slips resulting,from the proposed project.
It is recommended that the applicant be required to provide a marine
pumpout facility and a suitable (i.e. approved) means of treatment and disposal
of the resulting waste.

Dear Mr. Lowe:
The enclosed permit constitutes authorization under the Coastal Area
Management Act and where applicable, the State Dredge and Fill Law, for you
to proceed with your project proposal. The original (yellow form) of the
permit is retained for your files and must be available on -site when the
project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope at your
earliest convenience. Signing the permit and proceeding indicates your
agreement with the conditioned permit. This act also means you have waived
your right of appeal described below.
If you object to the permit, as conditioned, you may request an appeal
hearing before the Coastal Resources Commission pursuant to NCGS 113A-122 or
113-229. Such hearing must be requested within twenty (20) days of your re-
ceipt of this letter. You should also be aware that, by law, if another
qualified party submits a valid objection to the issuance of this permit with-
in twenty (20) days the objection must be resolved prior to work initiation.
In other words, work started within the next three (3) weeks could be stopped
if objections are submitted.
The project plan is subject to those conditions appearing on the permit
form. Otherwise, all work must be carried out in accordance with your ap-
plication. Modifications, time extensions and future maintenance require
additional approval. Please read your permit carefully prior to starting
work and review all project plans, as approved. If you are having the work
done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time Department personnel will visit the project site. How-
ever, if questions arise concerning permit conditions, environmental safeguards,
or problem areas you may contact Department personnel at any time for assis-
tance. By working in accordance with the permit, you will be helping to pro-
tect our vitally important coastal resources.
