In an area of environment concern pursuant to Sectlon 113A-118 of the
General Statutes, "Coastal Area ManagemenC
Issued to Marty Davis, authorizing development in the Estuarine Shoreline - ORW (AEC) at 1322 Tidalwalk Drive, in
Wilmington, NC, as requested in the permittee's application, dated June 21, 2016. This permit, issued on August 9,
2016, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a
fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: Construction of an in -ground swimming pool and deck.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on June 21, 2016.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaiva6on and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 798-7116 for a final inspection at
completion of work.

This permit action may be appealed by the penniltee or other qualified persons
within twenty (20) days of the issuing dale. This permit must be on the project
site and accessible to the permit officer when the project is inspected for
compliance. Any maintenance work or project modification not covered under
this permit, require further written permit approval. Al work must cease when this
permit expires on:
DECEMBER 31, 2019
In issuing this permit ft Is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This pemilt may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) The amount of impervious surface shall not exceed 25% of the lot area within 575 feet of Normal High Water
(Estuarine Shoreline - ORW Area of Environmental Concern) in this case, 432 sq. ff. of new impervious is
authorized.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Pdor to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been propedy stabilized with a vegetative cover.
(7) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional
stom»vater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in
a vegetated state.
(8) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.

Ms. Kearney:
At your request, Dudek Consulting, P.C. (DC) has evaluated the fiberglass one-piece
swimming pool installation by San Juan Pools of Eloy, Arizona and Lakeland, Florida
(SJP) against flotation. The pools can very from a small pool of approximately 2,650
gallons to a large pool of 22,000 gallons. Of concern is the bouyancy of the pools
and their anchorage to prevent floating during flood conditions and becoming an
obstruction that would result in damage to nearby buildings. This letter is to explain
the anchorage of the pool against flotation. See the attachments.
This evaluation is with respect to the requirements of the North Carolina Department
of Crime Control and Public Safety Division of Emergency Management Floodplain
Management Branch specifically, Swimming Pcols in VE Zones. The pools are to be
installed per ES Report ER-2417 by ICSO Evaluation Services, Inc. The edge beam
and walkway section in Figure 1 provided the dead weight to resist flotation and
shows the extent of the concrete placed around the pool as a recommended
minimum. As evaluated by DC, the each pool installation has a balanced bouyancy
when the pool water level is below the adjacent ground water level. The allowable
level difference against buoyancy depends upon the size of the pool in area and in
capacity in gallons. If this difference is greater than the allowable the pool has the
potential of becoming buoyant and floating. It is reported that the Able Installations
method of installing pools uses the recommended section in Figure 1, often an
additional 3.5-inch of concrete on the top of the coping. The additional dead weight
increases the level difference. For this evaluation, Figure 1 will be used as Detail "A"
as the basis of all edge beams and dead weight.

details for perimeter dead weight or anchorage are structurally acceptable for
installation against flotation by either the proper filling of the pool as recommended by
