This permit, issued on 01-Nov-16, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terns may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: I O' x 16' Bird Viewing Deck and Osprey Nesting Tower. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on 28-Oct-16. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re- evaluation and modification of this permit. (6) Unless specifically allowed in 15A NCAC 07H-0209(d)(10), and shown on the permitted plan drawing, all development/construction shall be located a distance of 30 feet landward of Normal High Water. No portion of the roof overhang shall encroach into the 30 foot buffer. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (8) Any proposed for grading within the 30' buffer from the Normal High Water level must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. Based on my search I could not find an active jurisdictional determinations (wetland determinations) on the back side of the Founders Club, nor could I find any preservation documents that would prohibit impacts to wetlands. I can't say whether or not its wetland without a visit but the preservation was what I was most interested in searching. Being that there does not appear to be preservation, even if the activity is in wetlands and does not involve anything more than a couple poles being set to hold the nest, it would not be something the Corps would regulate in non -tidal marsh. If within tidal marsh (which would also make it CAMA marsh) then the Division of Coastal Management (DCM) would be the lead agency and we have a non -notifying general permit that would accompany the DCM Decision. Either way it appears your client is OK with the construction of the osprey nest they just need to minimize ground disturbance around the poles.
