"Coastal.Area Managemene Issued to WBLumina LLC, authorizing development in the Ocean Hazard (AEC) at 123 South Lumina Avenue, in Wrightsville Beach, North Carolina as requested in the permittee's application, dated June 24, 2016 and accepted as complete on July 11, 2016. This permit, issued on July28, 2016, issubject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. THIS PERMIT AUTHORIZES: Re -grading of the lot, the installation of a:30" tall landscape wall along the sides and rear property lines, re -shaping the dunes to match the existing topography of the dunes to the north and south of the property, planting sea oats to stabilize the dune system. The applicant has indicated that a second wail will be installed if needed to retain the fill on the southern portion of the property. According to Mr. Josh Mihaly, a North Carolina registered landscape architect, he has designed the landscape retaining wall to retain the mound of sand that is primarily located on 123 South Lumina Avenue but is also partially located on the northern portion of 129 South Lumina Avenue. (9) Mr. Mihaly has stated that if a second wall is needed, then the applicant will install a second landscape retaining wail near the property boundary between 123 and 129 South Lumina. In the event that a second landscape retaining wail is needed then a new CAMA Minor Permit and Zoning Permit will need to be obtained in, addition to any other permits or certifications required by local, state, or federal entities. MINOR DEVELOPMENT PERMIT In 1974, the North Carolina General Assembly passed the Coastal Area Management Act (LAMA) and set the stage for guiding development in fragile and productive areas that border the state's sounds and oceanfront Along with requiring special care by those who build and develop, the General Assembly directed the Coastal Resources Commission (CRC) to implement clear regulations that minimize the burden on the applicant. This application for a minor development permit under CAMA is part of the Commission's effort to meet the spirit and intent of the General Assembly. It has been designed to be straightforward and require no more time or effort than necessary from the applicant. Please go over this folder with the Local Permit Officer (LPO) for the locality in which you plan to build to be certain that you understand what information he or she needs before you apply. Under CAMA regulations, the minor permit is to be issued within 25 days once a complete application is in hand. Often less time is needed if the project is simple. The process generally takes about 18 days. You can speed the approval process by making certain that your application is complete and signed, that your drawing meets the specifications given inside and that your application fee is attached. Other permits are sometimes required for development in the coastal area. While these are not CAMA-related, we urge you to Fheek with the Local Permit Officer to determine which of these you may, need. A list is included on page two of this folder.
