permit modification. No non -water dependent uses of structures shall be conducted on, in or over

ADDITIONAL CONDITIONS
The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure to the south and the adjacent property owner's riparian access corridor.
Should the permittee's adjacent property to the north (225 Florida Ave.) be sold prior to the initiation of
construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new
property owner prior to the placement of any structures within the 15 foot riparian corridor.
The authorized structures and associated activity shall not exceed the established Carolina Beach pier head
line.
Bulkhead
The bulkhead shall be constructed in the same alignment as depicted on the attached workplan drawing.
General
This Minor Modification shall be attached to Permit No. 69-16, which was issued on 6/17/16, and copies
of both documents shall be readily available on site when Division personnel inspect the project for
compliance.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
No excavated or fill material shall be placed at any time in any Coastal Wetlands or surrounding waters
outside of the alignment of the fill area indicated on the workplan drawing.
All conditions and stipulations of the active permit remain in force under this Minor Modification unless
specifically altered herein.

OTI: Future development of the permittee's may require a modification of this permit. Contact a
representative of the Division at (910) 796-7215 prior to the commencement of any such activity
for this determination. The permittee is further advised that many non -water dependent activities
are not authorized within 30 feet of the normal high water level.
TE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
TE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permits
197800056, 197800080, and 197800125 (Action ID No. SAW-2016-00963), which was issued
on 5/23/16.
The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
16-0390.
A minor modification application processing fee of $100 was received by DCM for this project.

Tongue and Groove, LLC, has submitted a request, on behalf of Steven and Dale Matthews, to modify CAMA Major Permit No 69-16,
which was originally issued on June 17, 2016. The subject permit authorized a single family residence, a 4-slip docking facility that
extends into Myrtle Grove Sound, replacement of an existing boat ramp and installation of a bulkhead at 223 (actually 221) Florida
Avenue, in Carolina Beach, New Hanover County. The permit is scheduled to expire on December 31, 2019. Please note that the
applicant has requested to correct the address on this permit from 223 Florida Avenue to 221 and 225 Florida Avenue.
Through the most recent permit modification request, the permittee was seeking authorization to install four (4)13 ft. by 13 ft. boatlifts
within existing slips at the terminal end of the existing docking facility at 221 Florida Avenue, to abandon the existing 15 ft. wide boat
ramp and install an approximately 20 ft. long bulkhead along the normal high water line (NHW) at 221 Florida Avenue only. The
permittee was also proposing a reconfiguration of the existing decking on the rear of the residence. On November 18, 2016 a site visit
was conducted by DCM staff and additional fill within the 30 ft. coastal shoreline buffer was observed. A follow up site visit was
conducted on November 28, 2016 with DCM staff, the property owner, contractor and agent to discuss project modifications. During this
site visit a Stop Work Order was officially given in order to review the new set of plans for both lots (221 and 225 Florida Avenue),
including all upland development, underthe Minor Modification process. On November 28, 2026 this office received a request to please
revoke the prior modification request to the CAMA Major permit at 221 Florida Ave from the agent.
The current modification request is to modify the fill and grading plan (including stormwater retention) for both lots (see Sheet 1 of 1 dated
received on 12/28/16), to add a retaining wall on the outer property lines of the entire project area (see site plans dated received on
1 /6/17). The new site plan includes the original request for four (4) boatlifts, bulkhead modification and boat ramp abandonment. No
additional changes were proposed to the authorized docking facility located at 221 Florida Avenue. The adjacent riparian property owner
statement for property located at 227 Florida Avenue was received on 12/19/16 with comments (Attached). RECEIVED

CAMA Major Permit — Modification Request

This is a request from Tongue & Groove LLC to modify the existing CAMA Major Permit on behalf
of Steve and Dale Matthews, owners of 221 Florida Ave (Lots 11-11A, Lot 12-12A) and 225 Florida Ave
(Lot 13-13A). I have enclosed copies of the permit application package (permit application forms and
appropriate work plan drawings) for your approval.
At one time, the two lots in the attached plan were labeled as one address (225 Florida Ave), but
have been split into two and now have two separate addresses. The current CAMA Major Permit is
labeled with the address "223 Florida Avenue" — this is incorrect. The correct address label is "221
Florida Avenue', which is a recombination of Lots 11, 12 where the single family home, and pool will be
constructed (Lots 11-11A and 12-12A, Parcel ID#8807008010001). 225 Florida Avenue is the smaller
adjacent parcel of land (Lot 13-13A, Parcel ID #8807008010003) which is also part of the project and
should be included in this LAMA Major Permit modification as it is a common plan of development.

Hi Heather,
The contractor has satisfied the town's concerns with the fill and retaining wall proposal. We are ready to issue the fill
permit once the CAMA MOD has been issued. The building permit was applied for separately and is still being
reviewed. The owner is not proposing to install an engineered stormwater infiltration system. The original permit had a
condition that an approved stormwater management plan will be required. They submitted a drainage plan to the town
that was approved. My interpretation of this condition is a stormwater plan that is acceptable to the town must be
submitted, but doesn't require the owner to do a stormwater infiltration system. Let me know if you concur?

One change the contractor submitted to the town from the plan that you sent dated January 6'^ is that the side retaining
walls are now extending to the front property line. This area is located outside the AEC. I have attached their latest
submittal. I know the contractor is eager to get started on the site work. Let me know if you have any issues.

Hi Heather,
I am checking on the status of the CAMA Modification for 221 & 225 Florida Ave. We talked to Debbie today from the NC
Division of Coastal Management and she said that you will actually be writing the permit.
As of this morning when I spoke to Carolina Beach, the Fill/Grade Permits for both lots have been approved and are
awaiting the go-ahead from CAMA before they provide us with their signed permit to allow us to proceed with work.
I understand that the length of the processing stage is hard to measure, but as a few weeks have passed, I am wondering
if you have an estimation as to when we will have CAMA's approval.

Do you have any comments on the Matthews minor mod request that went out on or around 1/6 to include four boat

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff-colored'form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be'aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.
