This permit, issued on January 27, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Mark Lewis ADDITIONAL CONDITIONS 'I 12Permit No3 -16' Page 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third parry. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 4 formalized boat slips. 6) The pier/dock and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the west. 7) Should the adjacent property to the east be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 8) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-02427), which was issued on 12/29/15. NOTE: The N.C. Is it correct that your revised plan submitted on December 16 shows a 6' wide pier leading to a 20' x 20' uncovered platform entirely over open water and an overall fixed pier/dock length of 175'? Also, if that's the case, we need to revise the MP- 4 form to indicate a 20' x 20' platform instead of the previously proposed 20' x 22' platform. Would you like to come in to change this or would you like to authorize me to make this revision for you on the form? In this document I have indicated that, as the manager of South Beach Yacht Club, I do have objections to this proposal and do not wish to waiver the 15' setback. The main objection is the length of the dock at 175 feet when South Beach Yacht Club's adjacent dock system is 150 feet. There are pilings that extend into Banks Channel in addition to the 150' length but having a solid structure 25 feet further out into the sound will cause navigation issues for the end slips, numbers 34 & 35, along with the other 11 slips, numbers 36 through 46 that face north toward the proposed dock extension. I met with the owner, Mark Lewis, on Saturday, October 3, 2015 to discuss the proposed use of the facility and he indicated he had already discussed the length of the dock with the proper authorities at the Division of Coastal Management and was told the 175 feet was acceptable. This goes against what we thought the rules were regarding an imaginary line running from the both adjacent neighbors which would have negated the length to something less than the 175. The other points of Mr. Lewis's business and operational plans seem to address most other concerns such as waste disposal, odor and health/environmental issues and he certainly expressed his desire to be a good neighbor to our facility. This was also verified by a representative of the Town of Topsail Beach. Please accept this letter as authorization to act on South Beach Yacht Club's behalf to go on record with the Division of Coastal Management as to our objection cited above. To find the property from the Wilmington Regional Office, take Highway 17 North from Wilmington approximately 20 miles and turn right on N.C. State Highway 210. Travel approximately 2.8 miles to the intersection ofNC 210 and NC 50. Turn right onto NC 50/NC 210 and travel approximately 1.9 miles onto Topsail Island. Turn right onto S. Topsail Dr. /NC 50 and travel approximately 6.8 miles to Crews Avenue and turn right. Travel approximately 0.10 miles on Crews Avenue and the property will be located straight ahead, in the bend of Crews Road at 822 Carolina Blvd. Existing man-made features include a 3,190 sq. ft. building, 144 sq. ft. concrete slab, gravel driveway, bulkhead and dilapidated pier. The high ground portion is elevated approximately 4'-6' above the normal high water (NHW) level. Vegetation on the tract consists of lawn grasses and ornamental landscaping. There is a narrow section (6-10' in width) of Coastal Wetlands along the western shoreline bordering the bulkhead that traverses the majority of the shoreline. The property has approximately 57 linear feet of shoreline which is stabilized by an existing wooden bulkhead. Water depths in the vicinity of the existing water dependent structure(s) range from -0' to -7.0', relative to normal low water (NLW). Residential and commercial properties border the site to the north, south and east and Topsail Sound to the west. This site formerly operated as the Jean Beasley sea turtle hospital and was sold to the applicant, by the Town of Topsail Beach, this past summer. The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Based on visual observations made by DCM staff in the beginning of 2015, there does not appear to be any Submerged Aquatic Vegetation (SAV) in the vicinity of the proposed project. PROPOSED PROJECT: The applicant is requesting approval to demolish the existing pier and install a new 6' x 175' fixed elevated pier and 20' x 22' platform adjacent to the subject property. As proposed, the pier would originate along the southern side ofthe property and would extend toward the west, terminating approximately 175' from the existing bulkhead. Just north, and immediately adjacent to the existing bulkhead, the applicant proposes to install a 20' x 22' fixed platform. A portion of the platform would be located over high ground (12' x 15'); however, as designed it would be elevated, uncovered and slatted, and less than 200 sq. ft. in size. The remaining portion of the platform would be partially located over Coastal Wetlands from 4' of covera&1,;>�' of coven, with the vast majority of the platform being located over open water. a applicant is requesting -a -platform of this size in order to store equipment and/or supplies that are associated with the proposed commercial fish house/pack house operations. As planned, up to four (4) vessels would be docked at the proposed facility. Vessel docking would include two large shrimp boats (50'-60') and potentially a couple of run-abouts. Water depths in the vicinity of the proposed structure range from -1.0' (at normal low water) to -7.0' near the pier terminus. 10. ANTICIPATED IMPACTS: The proposed structure would incorporate approximately 440 sq. ft. of Estuarine Waters and Pubic Trust Area along the western side of the bulkhead. The proposed structure would extend approximately 175' feet offshore and terminate just inshore of the existing pier -head line.The structure would conform to both the 1/4 width rule and the established pier lengths. In addition, the proposed structure would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement. Minor increases in turbidity should be expected during construction. The project is located at 822 Carolina Blvd., adjacent to Topsail Sound in Topsail Beach, Pender County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT. Waters at the site are classified as SA and are open to shell fishing. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Topsail Beach Land Use Plan and offer the following comments. The general area of the project is classified Developed, while the AECs impacted by the work are classified as Conservation. In general, the Topsail Beach Land Use Plan allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Topsail Beach Land Use Plan contains some policies, which exceed the State''s minimum use standards. However, none of these more restrictive policies appear to be applicable to this project. This project is consistent with the Topsail Beach Land Use Plan Update. The construction would provide docking space for the total up to four (4) vessels at this location. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the '/. width rule, the eight square foot rule and the pier width rule. The proposed structures would primarily be located over open water; however, there is one section of the platform (+/- 180 sq. ft.) that would be located over high ground.
