This permit, issued on January 27, 2016 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No.13 ,16 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 5 formalized boat slips. 6) The new floating dock and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: The permittee is advised that in accordance with 15A 07H .0208, the Rules of the Coastal Resources Commission prohibit new dredging or excavation of submerged aquatic vegetation (SAV). The presence of SAV has been identified around the project area. Dredging within any SAV habitat in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-02428), issued on 12/30/15. NOTE: The N.C. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The proposed project consisted of the addition of a floating dock to an existing docking facility. The proposed project has been determined to comply with the Rules of the Coastal Resources Commission and as such, a permit has been issued to authorize the development. Upon review of the documentation provided, I have several questions which requi.m clarification. )Earlier this year, Clements Marine obtained a permit to remove the floating dock, raid replace it with a. fixed dock'for tie four existing boat slips/lifts. This work was performed in the spring. The current request is to add two additional slips for a total of six slips (F4rin DCt,,l MP- 4). While the current stated purpose of these slips appears to be their use as "a" floating dock slip (Form DCM MP-1, Page 4), once in place, it is possible that one or both of these slips could be converted into actual boat slips with or without lifts in the fixture. 1f this.is true, I would object to the additional two slips as proposed. Further, page 4 of the application references "a" floating dock implyiag onc, rather than two. as indicated elsewhere in the paperwork. Please consider this correspondence to be a letter of objection pending additional clarification and resolution of the above. You indicated the original was forwarded to the office in Morehead City During our conversation this morning, yoq mentioned that Mr. Clements had stated that the pilings referred to in the attached letter of objection had coincidentally washed up in the marsh in the area located between the Kings Villa property alad my property, and that these pilings were not the result of his previous work at the King's Villa dock. This is absolutely false. The pilings are the same pilings that were removed during work performed by Clements Marine earlier this spring at the King's Villa dock and left behind, unsecured. I will be happy to provide your office with a sworn affidavit stating the same. As of this date, the pilings have not been removed by Clements Marine. The submitted dock proposal would require additional piling installation. Arc. the pilings from the previous work at King's Villa going to be used? Is it acceptable for them to be stoned, unsecured for $ months --or more? In January, 2015, Mr. Clements obtained a permit to replace the floating dock with a fixed dock. When he finished in April, he left six, 24 foot long round pilings lying loose in the spartina grass and extending into the water. It was my understanding these pilings would be removed following completion of the fixed dock. Unfortunately this was not the case. With the incoming and outgoing tides, the unsecured pilings began migrating toward the intracoastal waterway. Concerned that they would find their way into the channel and become a danger to boaters, I spoke with a resident of the King's Landing town homes. It is my understanding that Mr. Clements was contacted several times regarding the removal of the pilings, yet he did nothing. During a high tide in late September, several of the pilings floated into the water and 2 actually floated under my dock, lifting it upward. I removed the pilings from beneath my dock, and then pulled the other pilings toward the King's Villa dock where I tied them up. Six months have passed since the original construction work. The pilings should have been properly secured by Clements until their removal. Had I not secured them, they would have floated, partially submerged, into the channel, endangering boaters' lives. Field staff .has indicated no current SAV presence, though recent aerial imagery indicates the potential presence of SAV within the immediate area and throughout the surrounding area. Though indicated depths appear to be adequate forthe presence of.a floating dock, the use of the facility during periods of low.water increases.the'potential of"prop kicking" and. can. cause damage to SAV and SAV habitat. North Carolina ranks second behind Florida in SAV presence. Observations since 2000 have indicated that SAV coverage in North Carolina is expanding into previously unobserved areas. Page 2 PROJECT DESCRIPTION The project site is located at 202 Kings Landing Court, adjacent to the AIWW, in Hampstead, Pender County. To find the property from the Wilmington Regional Office, take Highway 17 North from Wilmington approximately 14 miles and turn right onto Country Club Drive. Continue along Country Club Drive approximately 1.0 miles and turn right onto Kings Landing Road. Follow Kings Landing Road approximately 1.1 mile and turn left at the 90 degree curve onto Kings Landing Court. The subject property will be located on the right hand side of the road, approximately 0.10 miles from the entrance, at unit # 202. Existing structures on the project site include a 4-unit condominium complex, storage building and 4-slip private docking facility. The project site is approximately 19,602 sq. ft. (0.45 acres) and is vegetated primarily with native trees, domestic grasses and ornamental landscaping. The project site has approximately 85 linear feet of shoreline fronting the AIWW. The existing 4-slip docking facility was constructed in the late 80's and the permit history has been difficult to locate; however, a CAMA general permit (#65086) was issued to Kings Landing Villas c/o Vern Hawkins in January 2015 for the conversion from a floating horseshoe shaped dock to a fixed horseshoe shaped dock (same location). The current docking facility consists of a 6' x 240' access pier, 10' x 16' platform, 6' x 40' fixed - "spine" connecting two 4' x 25' fixed finger piers. Four boat lifts are currently installed, one on each side of the existing finger piers. The Pander County 2006 Land Use Plan classifies adjacent waters and high ground portion of the property as Resource Protection. The waters of the AIWW in the location of the existing structure(s) are classified SA by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to expand the existing docking facility by adding an 8' wide x 20' long floating dock section along the northern side of the existing platform, within the interior footprint. The proposed floating dock would connect to the existing fixed platform (along the landward side) and would extend approximately 33' toward the high ground. According to the applicant, the floating dock is necessary for safe water access while loading/unloading passengers and gear throughout all tide cycles. As designed, the expansion would increase the total number of possible slips at this property from four to five. Currently, water depths surround the existing facility, and the proposed expansion, range from -2.0' to -5.0', relative to Normal Low Water. 10. ANTICIPATED IMPACTS The proposed structure would incorporate approximately 160 sq. ft. of Estuarine Waters and Pubic Trust Area along the northern side of the existing docking facility. The proposed structure would extend approximately 20' landward of the existing facility and should not be considered a hazard to navigation. The proposed structure would be located within the existing footprint of the existing docking facility. The structure would conform to both the 1/4 width rule and the established pier lengths. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement. Minor increases in turbidity should be expected during construction.
