The total area of floating docks and platforms was calculated as follows:
Shoreline length = 55' x 8 sq. ft. = 440 sq. ft. allowable
Existing Access Pier— 6' x 32'= 192 sq. ft. (credit applied for access)
Existing Covered Fixed Platform = 16' x 12' = 192 sq. ft.
(Credit applied for access (12' x 6') remaining 12' x 10'= 120 sq. ft.)
Existing Floating Dock = 6' x 26' = 156 sq. ft. (credit applied for access)
Total =120 sq. ft.
The proposed facility would provide docking space for up to three (3) vessels at this location. It appears that the
project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the '% width rule and
the pier width rule. The adjacent riparian property owner to the northeast has waived the 15' Riparian Corridor
Setback. The proposed structures would be located entirely over open water. If the project is determined to be
consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include standard
docking facility conditions:
1. This permit authorizes a maximum of three (3) boat slips. At no time shall more than three (3) vessels
be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel
types, including but not limited to motorboats, sailing vessels and personal watercraft.

Subject: Consistency Determination, Major Permit Application, oel Killion,
Wrightsville Beach — New Hanover County
Date: March 7, 2016
Consistency Determination:
. INFORM IF
This project is consistent with the W ' htsville Beach Land Use Plan
The applicant proposes to reconfigure an existing private docking facility within Motts
Channel. The project is located at 12 Island Drive in Wrightsville Beach, New Hanover
County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Town of Wrightsville Beach
Land Use Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation/Resource Protection.
In general, the Town of Wrightsville Beach allows development in
Conservation/Resource Protection classified AECs which is consistent with the State's
minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some
policies, which exceed the State's minimum use standards including those for piers and
marinas. However, none of these more restrictive policies seem to be applicable to this
project.
This project appears to be consistent with the Town of Wrightsville Beach Land Use
Plan.

9. PROJECT DESCRIPTION:
The project site is located at 12 Island Drive, adjacent to Motts Channel, between the Atlantic Ocean and
Greenville Sound. The site is located within the Town of Wrightsville Beach, in New Hanover County. To
locate the property from the Wilmington Regional Office, travel east from Military Cut -Off Road (N.C.
Highway 76) approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading
east on Causeway Drive (N.C. Highway 76) approximately 1.0 miles then turn right onto Island Dr. The
property of interest will be located on the right hand side.
The applicant currently maintains a one-story single family residence on the project site. The property is
adjacent to residential properties with existing single family structures and private docking facilities.
Highground vegetation consists of maintained lawn grasses and ornamental landscaping. The lot is
approximately 0.15 acres in size and has an average elevation of approximately 6' above normal water
level. The project site has approximately 55 linear feet of shoreline frontage stabilized by a sloped
concrete wall which is attached to a derelict concrete landing on the northeast side of the pier. The landing
extends approximately 28' waterward into Motts Channel.
The applicant currently maintains a private docking facility within Motts Channel. An existing pier extends
from the shoreline, measuring approximately 6' in width by 32' in length. The waterward end of the pier
attaches to a 16' in width by 12' in length covered platform with a ramp leading down to a 6' in width by
26' in length floating dock, which runs perpendicular to the shoreline. The existing docking facility meets
both of the 15' Adjacent Riparian Corridor Setbacks. The current docking facility currently accommodates
two (2) vessels within water depths of approximately -4' to -6' at Normal Low Water (NLW).
The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of project
site as Conservation. There are no known archaeological sites located in the project vicinity. The waters
of Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the
harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to reconfigure and existing private docking facility within Motts Channel. The
project calls for the installation of a boatlift measuring 15' in length by 15' in width and two (2) tie pilings.
The boatlift would be located adjacent to the northeast side of the existing covered platform. The
application states that the new configuration would accommodate up to three (3) slips within existing
water depths of -4' to -6' at NLW (See Sheets 1 and 2 of 2 and Project Narrative).
10. . ANTICIPATED IMPACTS:
The proposed boatlift and tie pilings would incorporate approximately 227 sq. ft. of Estuarine Waters and
Public Trust Area. The proposed boatlift and would encroach approximately 10' into the adjacent 15'
Adjacent Riparian Corridor Setback Area to the northeast, however the applicant received a waiver from
the property owner to the northeast (H. King). The docking facility extends approximately 78' into a
waterbody, which measures 1,170' across. This distance conforms to the 1/4 width rule and the locally
established pier head line. Minor increases in turbidity should be expected durinREetcWnriED

Drive, Wrightsville Beach, N.C. 28480 is to add a boatlift and two tie pilings
to the existing dock facility.
A signed waiver is included with the application, from the adjacent neighbor,
as the boatlift and tie pilings extend into the 15'r1parian corridor setback.
There are currently two boat slips and with the addition of the boatlift,
there will be a total of three slips
The existing dock facility with the boatlift addition is for the applicants'

The Division of Coastal Management hereby acknowledges receipt of your application, submitted on behalf of Joel
Killion, requesting authorization under the Rules of the N.C. Coastal Resources Commission for development activities at
12 Island Dr., adjacent to Motts Channel, in Wrightsville Beach, New Hanover County. It was received as complete on
January 21, 2016, and appears to be adequate for processing at this time. The projected deadline for making a decision on
your permit application is April 5, 2016. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you
should consider the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from January 21, 2016 you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will
be held within five working days from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State
or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of
my field report and/or comments from reviewing agencies.
