Any violation of these terms may =be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the boatlift, pilings, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered "hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that jyour project is consistent with the North Carolina Coastal Management Program. Killion Permit No. 37-16' Page 2 of 2 ADDITIONAL CONDITION'S <;3)," The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 75) This permit authorizes a maximum of 3 formalized boat slips. `6) - Should the adjacent property to the north be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 7);' The authorized structures and associated activity shall not exceed the established Wrightsville Beach pier head line. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. "NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2016-00286), which was issued on 2/10/16. The N.C. Division of Water Resources assigned the proposed project DWR Project No. 16-0116. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. An application processing fee of $250 was received by DCM for this project. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the '% width rule and the pier width rule. The adjacent riparian property owner to the northeast has waived the 15' Riparian Corridor Setback. The proposed structures would be located entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include standard docking facility conditions: 1. This permit authorizes a maximum of three (3) boat slips. At no time shall more than three (3) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. I have reviewed this proposal for consistency with the 2005 Town of Wrightsville Beach Land Use Plan and offer the following comments. The general area of the project is classified Developed, while the AECs impacted by the work are classified as Conservation/Resource Protection. In general, the Town of Wrightsville Beach allows development in Conservation/Resource Protection classified AECs which is consistent with the State's minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some policies, which exceed the State's minimum use standards including those for piers and marinas. However, none of these more restrictive policies seem to be applicable to this project. This project appears to be consistent with the Town of Wrightsville Beach Land Use Plan. PROJECT DESCRIPTION: The project site is located at 12 Island Drive, adjacent to Motts Channel, between the Atlantic Ocean and Greenville Sound. The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property from the Wilmington Regional Office, travel east from Military Cut -Off Road (N.C. Highway 76) approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (N.C. Highway 76) approximately 1.0 miles then turn right onto Island Dr. The property of interest will be located on the right hand side. The applicant currently maintains a one-story single family residence on the project site. The property is adjacent to residential properties with existing single family structures and private docking facilities. Highground vegetation consists of maintained lawn grasses and ornamental landscaping. The lot is approximately 0.15 acres in size and has an average elevation of approximately 6' above normal water level. The project site has approximately 55 linear feet of shoreline frontage stabilized by a sloped concrete wall which is attached to a derelict concrete landing on the northeast side of the pier. The landing extends approximately 28' waterward into Motts Channel. The applicant currently maintains a private docking facility within Motts Channel. An existing pier extends from the shoreline, measuring approximately 6' in width by 32' in length. The waterward end of the pier attaches to a 16' in width by 12' in length covered platform with a ramp leading down to a 6' in width by 26' in length floating dock, which runs perpendicular to the shoreline. The existing docking facility meets both of the 15' Adjacent Riparian Corridor Setbacks. The current docking facility currently accommodates two (2) vessels within water depths of approximately -4' to -6' at Normal Low Water (NLW). The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of project site as Conservation. There are no known archaeological sites located in the project vicinity. The waters of Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to reconfigure and existing private docking facility within Motts Channel. The project calls for the installation of a boatlift measuring 15' in length by 15' in width and two (2) tie pilings. The boatlift would be located adjacent to the northeast side of the existing covered platform. The application states that the new configuration would accommodate up to three (3) slips within existing water depths of -4' to -6' at NLW (See Sheets 1 and 2 of 2 and Project Narrative). 10. . ANTICIPATED IMPACTS: The proposed boatlift and tie pilings would incorporate approximately 227 sq. ft. of Estuarine Waters and Public Trust Area.
