This`pennit, issued on July 21, 2016 is subject to compliance with the application (where consistent wtthihe permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may lie ,subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization The alignment of the permitted bulkhead shall be verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. The bulkhead shall not extend waterward more than 8 feet from the normal high water level at any point along its alignment at the time of construction. No backfrll material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. The bulkhead shall be constructed prior to any backfilling activities. No excavation, or other land disturbing activities, is permitted except for that which may be required for the construction of the bulkhead wall. This permit does not authorize any excavation waterward of the approved alignment. 8) All backfill material shall be clean and free of any pollutants except in trace quantities. 9) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 10) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. Sedimentation and Erosion Control i 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General No open water areas or vegetated wetlands shall be excavated or filled, even temporarily, outside of the area as indicated on the attached workplan drawing. "14)! Staff review of the plans and specifications on May 19, 2016 has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. Yacht and NE 16th Street, adjacent the Atlantic Intracoastal Waterway (AIWW), in the Town of Oak Island, Brunswick County. To find the project site, travel south on US Highway 17 to NC Highway 133 South. Travel approximately 22 miles south on NC- 133 to Dosher Cutoff SE/ NC-133.Turn onto Dosher Cutoff and then turn right on Southport -Supply Rd. SE/ NC-133. Travel approximately 0.8 mile and turn left onto NC-133. Travel on NC-133 to Oak Island and turn right on East Oak Island Drive. Travel approximately 4.4 miles to NE 16th Street. Make a right onto 16th Street and the property will be located at the corner of E. Yacht and NE 16th Street. The project site is an AIWW front lot that measures approximately 60 feet in width by approximately 168 feet in depth. The elevation of the high ground area of the lot averages approximately 5-7 feet above normal high water (NHW). High ground vegetation consists primarily of lawn grasses, woody shrubs, and native trees. The shoreline of the property has not been stabilized and erosion along the shoreline is evident. An erosion escarpment is approximately 3-5 feet in height and mean high water is present along the eroded bank. No coastal wetlands are present water ward of the erosion escarpment along the shoreline. The high ground of the adjacent property to the east extends approximately 55 feet water ward of the erosion escarpment of the project site. The adjacent property to the east has been stabilized with a bulkhead parallel to the AIWW and a return wall/wing wall extends toward the shoreline of the project site for a distance of 30-35 feet (figure 3 of 5). The existing return wall is failing and concrete rip rap has been installed along the eastern property boundary to stabilize the shoreline and prevent erosion. The adjacent property to the west, also owned by the applicant, has been stabilized with a bulkhead. The MHW boundary on the adjacent properties is located along the bulkheads. The project site is bordered by E. Yacht Drive to the south and the AIWW to the north. No known archaeological sites are within the project vicinity. The Town of Oak Island Land Use Plan classifies the high ground portion of the project area as Residential. The waters of the AIWW are classified SA by the Division of Water Resources and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to install approximately 60 linear feet of new vinyl bulkhead with approximately 293 square feet of shallow bottom fill. As proposed, the bulkhead would be installed a maximum of 8 feet water ward of the existing erosion escarpment near the western property boundary. The bulkhead would be aligned at the erosion escarpment along the eastern property boundary. As proposed, the bulkhead alignment would connect to the existing bulkhead of the adjacent riparian property to the west, and would extend to the east approximately 60 feet in length, with a 10 feet return wall on the eastern property boundary. The existing rip rap along the eastern property boundary would be redistributed within the existing footprint to prevent additional shoreline erosion. On March 24', we had a meeting with agency personnel at the DCM office to discuss the proposed project. The original concept at that time was to align a bulkhead across the lot 3 shoreline diagonally connecting the existing bulkheads on the adjoining lots. After discussion, Mr. Jordan agreed to reposition the proposed bulkhead to extend in a straight alignment with the existing bulkhead face on lot 4 to his eastern property line, effectively reducing the amount of intertidal bottom impact. As also discussed, there are no coastal or 404 wetlands on the shoreline of lot 3 and no oysters present. The resulting bulkhead alignment extends 61' along the shoreline and will feature a 10' landward wing wall along the eastern property line. The amount of bottom impact has been reduced to 293 square feet below the normal high water line, representing the least impactful but most beneficial design. A small amount of existing riprap at the eastern end of the alignment will be excavated to allow for the installation of the structure. Following construction, the riprap will be reinstalled along the outer face of the face of the bulkhead in its original footprint. The anticipated area of disturbance behind the bulkhead is 1,800 square feet to allow for the installation of a typical deadman tie -back system and bulkhead backfill.
